Members Present: Dr. Mark Waddington, Mr. Rich Schilf, Mr. Charles Brooks, Mr. John Cakes, Mr. Jack Johnson, and Mr. Wade Steinmetz Other Present: Mr. Steve Duganz, Mr. Russell Boschee, and Mr. Stuart Hannah. Mr. Hannah gave a brief overview to the board on the new monitoring site at Beartooth School in the Heights. He also detailed the citizen complaint concerning this site. Chairman Waddington called the meeting to order at 7:40 p.m. In the first order of business, Mr. Waddington introduced former YCAPC director, Mr. Duganz. Mr. Duganz was invited to this meeting to give historical information. Mr. Duganz detailed the following topics and board discussion followed: · The 1983 agreement between the City of Billings, Yellowstone County, and the City of Laurel. · The history of pay plans/matrixes in which YCAPC has participated. The legislature eliminated the State-County matrix about nine or ten years ago, and since then, each year the YCAPC looked for a good matrix to follow. The State matrix was used, and it worked well for a number of years, then they stopped using it. · The history of budget procedures. The procedure has been that a best estimate of the budget is presented to the Board for review, and it has typically matched predictions. · Air quality regulations, and how the State reduced/eliminated local County regulations. These regulations were changed recently at the State of Montana DEQ's request. There has been a long time history since 1967 with the State Board of Health, and everything we do is still under the State Board of Environmental Review. · State and local enforcement. It is the job of the YCAPC to make the community a better place to live by enforcing air quality standards. YCAPC is also responsible for open burning permits. · EMPACT - the Internet broadcast of air monitoring data. Concerning the minutes, Mr. Schilf asked for more detailed minutes and suggested the use of a recording device and have the agency secretary transcribe the minutes from these recordings. Mr. Johnson moved to accept the minutes of July 8, 2003. Mr. Brooks seconded and the motion passed. Concerning the minutes of August 26, 2003, Mr. Schilf made a motion to review notes and recording to verify motions and actions of the board. Mr. Johnson seconded and the motion passed. Mr. Schilf opens discussion on the budget and the board discussed the reason for the seven months of expenditures versus the six months, the new funding formula and the future agreement between Billings, Yellowstone County, and Laurel. The board reviewed the historical salary of the director, discussed compensation, longevity pay, and the freezing of salaries to "pre-May" figures. Mr. Brooks moved to set the director's salary at $50,675. Mr. Schilf seconded and the motion passed. Mr. Brooks also made a motion to submit the budget as written. Mr. Cakes seconded and the motion passed. Concerning Schessler Ready Mix, Mr. Boschee gave a brief overview of the plan to reduce dust from this business site. Mr. Boschee asked the board for a motion to recommend approval of the wall. Mr. Brooks requested more information concerning the total square footage that needs dust control. Mr. Steinmetz moves to have Schessler Ready Mix apply magnesium chloride on all roads and heavy traveled areas in the yard of Schessler within 60 days, with a stipulation that Schessler can appeal to the YCAPC Board if needed. Mr. Brooks seconded and the motion passed. Mr. Johnson made a motion to have the board and staff consider the advantage/disadvantages of YCAPC staying at its present location at 3306 2nd Ave North, or moving into the County Courthouse, and that these considerations be placed on next month's agenda. Mr. Brooks said the law library will be vacant and also an area within the Public Works Director's facility. After discussion, Mr. Brooks seconded and the motion passed. Mr. Schilf moved to adjourn. Mr. Johnson seconded and the meeting was adjourned at 9:45 p.m Minutes of the Yellowstone County Air Poll[,tion Control Board meeting held August 26, 2003, at the Yellowstone County Air Pollution Office. Members Present: Dr. Mark Waddingto[i, Mr. Rich Schilr, Ms. Michelle Reed, Mr. Charles Brooks, Mr. John Oaks, and Mr. Jack Johnson. Chairman Waddinglon ended the executive session and opened the meetin9 to the public at 8:45 p.m. Mr. Wadding[on discussed lhe needs of tile air pollution agency in respect to both the public and to the employees. Chairman Waddington explained that the board, during the executive session, had passed a resolution to roll back salaries of Yellowstone County Air Pollution Control employees lo the previous levels of fiscal year 200212003. Mr. Waddington also explained that the board wants to limit expenditures and to set a ceiling of no more than $5000 be spent from the reserve fund. Mr. Boschee outlined the reports, lellers, and communications that had been sent to board members in regards to Fox Lumber, SOS Signs, aod French's Sandblasting and Painting. Mr. Boschee and the board discussed these cases and [he Empire SLeet case. Mr. Boschee explained to the board the meeting in Helena on August 18, with the Montana DEQ, and with the Montana Environmental Information Center. Mr. Boschee and the board discussed what enforcement and compliance meant. The board discussed the proposed change of wording in the state/county contracL, future local en[orcement procedures, and the procedures of the Board of Environmental Review. Also, the coml)letion ofthe fence surrnunding the enclosure will help put lbgitive emission to a lninimum. You must apply the magnesium chloride to all haul roads and heavily traveled areas within sixty (60) days. Schessler Ready Mix can appeal this decision to the YCAPC Board at its next scheduled meeting on October 14, 2003. If'you want to appeal, contact my o['lice al' 256-6841 Io be put on the October 14th Agenda. Our agency required you to clean up the washout on the west end of your property. Building a concrete block wall along Railroad Street will help alleviate the fugitive dust problem in the fi~ture. Would you send a copy of your building permit for our files?
