HomeMy WebLinkAboutAndy S. Muri September 4, 2003 Dear Mayor Johnson, As of this date, I am resigning from the Board of Adjustments after serving for more than 18 years. I served as chairman of the Board for the past 14 years. My decision was prompted by the following incident. As advertised and with proper notice, the Board met at 7:00 p.m. August 12 to consider the Stdcker's request for a variance. Cai Cumin, City Planning Director, recommended to the Board that the vadanoa be granted. With only 2 Board members present, we could neither grant nor deny the request. However, had there been 4 or 5 members present, it is possible that we would have granted the variance. On August 20, at your request, Mr. Mayor, City Attorney Mark Anderson informed me by mail that he had determined that the Board had no authority to grant the variance and prohibited us from doing so. It appears that had we granted the request August 12, we would have done so without any authority or legal right to do so. I so informed the Board and Mrs. Stdcker that same evening at our scheduled 7:00 p.m. meeting. I question why, Mr. Mayor, a request for vadance is sent to the Board of Adjustments when they have no dght to act on it. Because the Board was prohibited from rendering a decision in this case, I no longer feel comfortable being a member of the Board~ SEP - 4 3003 b CITY OF LAUREL AndyS.
