Dear Mr. Schessler:
Administrative Rules of Montana (ARM) 17.8.308 (2) states "No person shall
cause or authorize the use of any street, road, or parking lot without taking reasonable
precautions to control emissions of airborne particulate matter". On August 14, 2003, I
investigated a complaint about the fugitive dust leaving your property. We talked about
controlling the fugitive dust from your unpaved lot with crashed gravel. I am ordering
Schessler Ready Mix to control their fugitive emissions in one of four ways: (1) apply a
dust suppressant, such as, magnesium chloride, (2) apply a layer of crashed gravel
without any sand content, (3) apply a layer of recycled asphalt chips from a repaving
project, or (4) pave the lot with asphalt. Also, you must clean up your lot by removing
the excess "concrete clean-up" material on the west end of your property. You have
thirty days to respond with a plan to control your fugitive emissions, and you have an
additional sixty days to complete the project.

NATURE OF COMPLAINT: Schessler Ready-Mix has a fugitive "lime" dust
problem; it has been going for ten years. She is going to file a class action suit.
She wants Schessler Ready-Mix to discontinue doing business at that location.

FINDING OF INVESTIGATION: I talked with Mr. Robert Schessler
concerning his fugitive "lime" dust and fugitive dust from his unpaved lot. He
said he would address these problems.
SUGGESTED ACTION: I will write a letter to Schlessler Ready-Mix giving them
90 days to address these fugitive dust problems.
