Others present: Cheryll Lurid, City Secretary Motion by Doug Poehis, second by Laurel Haggart, to approve the minutes of the June 5, 2003 meeting. Motion carried 8 0. Special Review - 20 7th Avenue - Friendship Veterina.w Center Sharon Mohr (Kober) spoke regarding her veterinary hospkal. She will be treating companion animals' only, no large animals. Animals will only stay overnight when it is medically necessary. There will be no outside kennels. Cai recommended that this application be approved, subject to no animals being kept outdoors, and that the landscaping she plans becomes part of the approval, and that the City Council not hold a second public hearing. (Cai was not present at the meeting due to his military commitment. He submitted his recommendations in writing to the board.) Motion by Laurel Haggart, second by Steve O'Neil that the board recommends to the City Council that the ]Friendship Veterinary Center at 20 7t~ Avenue be allowed, subject to CaPs recommendations, and that the City Council not hold a second public hearing. Motion carried 8-0. Public Heafin~ - Preliminary Plat - Vista Buttes Subdivision Mr. Clay Schwartz, PLS, spoke as a proponent of the preliminary plat. The proposed subdivision consists of 10.094-acres of land. The proposed number of lots will be 5, with each lot being between 1 to 2 acres. The intended use of the lots is for single-family dwellings. Mr. Schwartz questioned the ditch easement. Mr. Schwartz stated that the roads will be standard roads. Mr. Schwartz then requested a variance on the 600-foot distance for the dead end road until such time that future development is done. At that time they will extend the road westerly to Buffalo Trail. Doug Poehls requested that Mr. Schwartz bring a written request for the easement to be put into the record. He also questioned ditch access. Chairman Shay stated that the ditch concern was addressed in Cal's recommendations. The board reviewed the letter from the Laurel Volunteer Fire Department that listed their requirements. Two letters of concern/protest were received from lira & Valorie Craft, 2344 S. 80~ Street and Ed Kraft, Ir., 7428 Neibauer Road. Mr. Schwartz asked if they could talk to Mr. Colley for any alternates from the LVFD's recommendations? Chairman Gerald Shay stated that Mr. Colley would be the one to talk to. Opponents: Jim Kraft spoke with some concerns he had. The ditch easement was one of the concerns, but that seems to be addressed. He is curious as to the types of homes allowed in the subdivision. The other concern is the dust on the road and asked if they planned some kind of dust suppression? The opponents were questioned on the dust suppression. They stated that thesndo not have any plans at this time to use dust suppression. The public hearing was dosed at 7:15 pm. Discussion by board. Several members were concerned w/th the amount of items that have not been addressed such as the fire suppression. Motion by Ed Thurner, second by Betty Hart, to table the preliminary plat application for Vista Buttes until the September meeting so as to g/ye them time to work on items that have not addressed. Motion carried 8-0. Betty Hart suggests that the developers look at dust suppression for the road. Mr. Schwartz addressed the chairman and stated that he has not received any of the communication from the Fire Department or Cal's comments. The Chairman gave him the information. Public Heating - Preliminary_ Plat - Clarks Fork Estates - JeffLaszloffy JeffLaszloff3, spoke regarding the preliminary plat. The plat consists of 7.6 acres of which will be split into 5 lots. It is located about 3 ~A miles south of Laurel. McGee and Company is doing the consulting work on the subdivision. The 716 acres has previously been agriculture. Thus that will take away 7.6 acres, but it will not interfere with irrigation systems or agriculture within the vicinity. The subdivision will use on-site water system and sewage disposal. Most of the fire department suggestions axe already in place and he will comply with the ones not in place. The main road coming into the subdivision is already in place. The driveways coming offthe main roads into the subdivision will be done to specifications as the homes are built. The water source for the fire department has not been addressed but will be done to LVFD specifications. Approximately $5000 will be added to the county tax base from the 5-lot subdivision. The natural environment will not be effected by this subdivision. There will be no significant water nm- off from this subdivision. Culverts are already in place. The subdivision will not effect the natural vegetation. Areas that will be graded will be seeded the same season. This will not be located in any significant wildlife habitat or cause any road closures to hunters or fishermen. This meets all the requirements of the Montana Subdivision Platting Act. No easements will be necessary for utilities as they are akeady in place. Access will be provided offof Highway 212. The road will go across BNSF tracks. He has been in touch with BNSF and will follow the proper procedures given to them by BNSF. This conforms to the Comprehensive Plan adopted by the City of Laurel for the City-County Planning area. Mr. Laszloffy stated that he received a letter from Cai with some items he needed to address. Mr. Laszloffy has taken care of most of the items, and will comply with the ones he hasn't. Types of homes will be a minimum of 2000 square foot stick-built single family home. The children in the subdivision will attend Laurel schools. Mr. Laszloffy owns 50 acres contiguous to this land. Some of the land is in Carbon County, some in Yellowstone County. The reason they are subdividing is so they can build a home. They have no plans to sell any more of their property. Opponents: None. The public hearing was closed at 7:30 pm. Discussion by board. Ed Thurner questioned Mr. Laszloffy regarding whether or not the state legislators feel pressure from Realtors during the legislative process? He asked whether or not they had a lot of control in the legislature? Mr. Laszloff3, said that the realtors do have concerns, so they are in the debates, but he doesn't feel they exert any more pressure than anyone else. Ed went on to say that a lot of times the board feels helpless because there is so much the board can't address that are in the state law, like school impact. Ed feels like the tavern owners and realtors can get together and have a stronger voice than the Planning Board members do. He questions what can be done about that? Mr. Laszloffy states that every group possible has a lobbyist in Helena. He seems to think that Planning Boards should be able to do the same. Betty Harts want to go back to Cal's recommendations. She felt Mr. Laszloffy wasn't given all of the recommendations from Cal and is wondering if he hasn't had a chance to address the issues. Mr. Laszloffy stated that he wasn't sure when Cai left, but Cai did send him some hand-written correspondence. Betty inquires about the increase in traffic this subdivision will cause on Highway 212. Has this been addressed? Mr. Laszloffy states that this shouldn't bring a significant amount of increase. Once the highway is redone the amount of traffic should drop dramatically. Question on the high water mark on Lot 1. Mr. Laszloff-y states that this piec* of property is in the 500- ' year floodplain. Question on ditch access across this property? Mr. Laszloffy states that there is a dedicated head gate . that serves his farm. Question by Steve O'Neil as to how we can approve this preliminary plat when we didn't approve the last one because of unsolved issues? Kate Stevenson stated that the issue offlre protection was not addressed for Vista Buttes Subdivision, except to ask for a variance from the Fire Department but Mr. Laszloffy addressed it for Clark's Fork Estates subdivision. Motion by Doug Poehls, second by Betty Hart to recommend approval of the preliminary plat for Clarks Fork Estates, subject to the conditions set by Cai and the Fire Department recommendations. Motion carded 5-3. Motion by Doug Poehls, second by Steve O'Neil to pull Vista Buttes preliminary plat offthe table. Motion failed by a vote of 3-5. Preliminary plat will stand as a tabled item. At this time Steve O'Neil tendered his resignation. Preliminary Plat, Vista Buttes Minor Subdivision: Recommend approval of this plat to the County Commissioners subject to the following conditions: A. Approval by the Montsna Depattment of Environrnental Quality; B. the Subdivision Improvements Agreement (SI.A) must spell out what improvements are planned, when such improvements will be installed, and who will pay for them and how. The issues are access roads, road surfacing, turning radius, dead ends, addresses, and water supply. The collector road shall have an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. The mmarounds shall have an inside mining radii of not less than 30 feet and an outside turning radii of not less than 45 feet. These roads shall be all-weather surface roads. Access to individual properties via the collector road shall be addressed within the 1997 Uniform Fire Code Article 9. Without knowing where the structures are to be placed upon individual properties, the driveways leading to the structures located on these properties shall provide an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches when any portion of an exterior wall of the first stopy ora building is located more than 150 feet fi.om the collector road. Access roads of less than 150 feet in length shall provide an unobstructed width of not less than 12 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. Dead-and fire apparatus access roads in excess of 150 feet in length shall be provided with approved provisions for the turning around of a fire apparatus. These roads shall be all-weather surface roads. Addresses shall be posted on collector road and on residences as outlined in Uniform Fire Code Article 9 Section 901.4.4. We have requested that a 4X4 posts be placed next to the collector road at the lane or road leading to residence. This post will have a blue reflector placed near top to identify it and below have the residence number. These numbers shall be clearly visible and readable fi.om collector road. The subdivion shall provide the Laurel Volunteer Fire Department with a supply of 10,000 gallons of water for the proposed 5 residences. TNs supply will be an underground storage tank with piping and fittings to meet the fire department standards and needs. Access to tank shall meet the approval of the Fire Department and that at least two (2) truck lengths be reserved off of the road for positioning of apparatus. The tank will be purchased, installed, and rnaintalned by the property owners. We request that the tank be installed proir to completion of the first structure. City Of Laurel is an EEO Employer Equal Housing Opportunity Once tank is complete the department will request that use of it in emergencies in the area be allowed and refilling of it will be the departments responsibility in those cases. All other times it will be the responsibility of the subdivision to keep it full. Should more than 5 residences be established and additional water supply will be required. We have established that in rural areas we will need 10,000 gallons of storage for five residences. As a sixth residence is established you will need to provide us with an additional 10,000 gallons of water, located at an agreed location, prior to its completion. With these issues being addressed prior to the subdivsion being built the Laurel Volunteer Fire Department should be able to adequately service this subdivision. Box 549 Billings, Montana 59103 Dear Sirs, In reviewing the proposed Vista Buttes Subdivision, the Laurel Volunteer Fire Department recommends the following issues be addressed so we can adequately service this subdivision. The issues are access roads, road surfacing, turning radius, dead ends, addresses, and water supply. The collector road shall have an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. The tumarounds shall have an inside turning radii of not less than 30 feet and an outside turning radii of not less than 45 feet. These roads shall be all-weather surface roads. Access to individual properties via the collector road shall be addressed within the 1997 Uniform Fire Code Article 9. Without knowing where the structures are to be placed upon individual properties, the driveways leading to the structures located on these properties shall provide an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches when any portion of an exterior wall of the first story of a building is located more than 150 feet fi-om the collector road. Access roads of less than 150 feet in length shall provide an unobstructed width of not less than 12 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. Dead-end fire apparatus access roads in excess of 150 feet in length shall be provided with approved provisions for the turning around of a fire apparatus. These roads shall be all-weather surface roads. Addresses shall be posted on collector road and on residences as outlined in Uniform Fire Code Article 9 Section 901.4.4. We have requested that a 4X4 posts be placed next to the collector road at the lane or road leading to residence. This post will have a blue reflector placed near top to identify it and below have the residence number. These numbers shall be clearly visible and readable from collector road. The subdivion shall provide the Laurel Volunteer Fire Department with a supply of 10,000 gallons of water for the proposed 5 residences. This supply will be an underground storage tank with piping and fittings to meet the fire department standards and needs. Access to tank shall meet the approval of the Fire Department and that at least two (2) truck lengths be reserved off of the road for positioning of apparatus. The tank will be purchased, installed, and maintained by the property owners. We request that the tank be installed proir to completion of the first structure. City Of Laurel is an EEO Employer Equal Housing Opportunity Once tank is complete the department will request that use of it in emergencies in the area be allowed and refilling of it will be the departments responsibility in those cases. All other times it will be the responsibility of the subdivision to keep it full. Should more than 5 residences be established and additional water supply will be required. We have established that in rural areas we will need 10,000 gallons of storage for five residences. As a sixth residence is established you will need to provide us with an additional 10,000 gallons of water, located at an agreed location, prior to its completion. Dear Cheryll, I own the property directly adjacent to the north of this proposed subdivision. I am quite alarmed by this development way out west of Billings in an agricultural open area. Subdivisions usually aren't real compatible with agriculture for a vadety of reasons: 1. People living next to open range feel they have the freedom to let their dogs stray onto to the neighbors property. Dogs are no friend to cattle and livestock, and when in packs, can do a lot of damage. Unfortunatelywhen the damage is discovered, the dogs are long gone. Granted there are many responsible dog owners, but there are just as many un responsible ones. Agriculture economics is strained enough already, we don't need dogs or packs of dogs cutting into our narrow profits 2. Neibauer Road is a narrow farm to market road that will break down with heavy traffic since the county just used old millings to construct the road between 72nd and 80th St. West. The increased traffic will also hinder ag operations with the movement of machinery and equipment between my farro lands. Most suburbanites aren't patient with slow moving farm equipment and tend to have road rage reactions. I've experienced this many times on 72nd St. West, and now it will move also onto Neibauer Road and 80th St West. 3. I've noticed in the SIA that one of the evaluation criteria is wildlife habitat. Living in this area all my life of 61 years, there are numerous antelope, roany whitetail and mule deer, along with fox, coyote, raccoon, pheasant, sage grouse and other wildlife inhabiting these hills. A mountain lion was even spotted by a neighbor last winter and also this summer. A subdivision in these hills will just push this wildlife into other areas or farther west. 4. I and my family live and make our livelihood in the country and we have a certain quality of life and quietness. With a subdivision next door to my property, that goes away. Is that fair to me and my heirs who want to continue with this occupation and way of life? 5. Finally, a philosophical observation. The migration of subdivisions west of Billings is eating up prime agricultural ground at a faster pace than it can be replaced. How does any planning department determine this is a good thing for the overall sustainability of agriculture? Since we apparently have no County Zoning Regulations, a residential subdivision in agricultural land is allowed unchecked. I realize this is evident all over the country, but when does agriculture, the very industry that feeds all of us, have a higher priority than subdivisions and houses? When will planned development really ever occur? Years ago our forefathers had the foresight to develop ditches to irrigate the fertile lands west (and east) of Billings and Laurel, and taxpayers spent millions of dollars to make this land productive for agriculture. Now we are reversing that whole purpose for the land and will someday undoubtedly regret it when we are lacking the very food and fiber to sustain us. I hope the Planning Board will take a close look at the this subdivision and deny this first filing and any future filing, which will be the start of a subdivision that really doesn~ belong in these hills. I am an adjacent property owner of CS 1569 at the corner of Neibauer Road and 80th Street West. I would just like to offer a few comments and concerns: · My irrigation ditch runs through the property designated as park. I take water out of the Hi-Line Ditch for irrigating pasture and lawn, and have done so for the past 27 years. I would like to continue to have access through this park for ditch maintenance, headgate control, etc. · I am somewhat concerned about dust that will be generated from the traffic on the new road serving the subdivision since I live so close to the road. It was only 3-4 years ago that we received pavement on 80th Street West, stopping the dust from the gravel road that we had to put up with for 23 years.
