Call meeting to order Approve minutes of previous meeting Activity Report Discuss proposed changes to YCAPC Program Director Boschee's salary review Minutes of the Yellowstone County Air Pollution Control Board meeting held March 11, 2003, at the Yellowstone County Air Pollution Office. Members Present: Mr. L.D. Collins, Ms. Michellc Reed, Mr. Jack Johnson, Mr. Rich Schilf, Mr. Bill Shikany, Dr. Mark Waddington, and Mr. Wade Steinmctz Others Present: Mr. Russell Boschee, Mr. Stuart Hannah. Chairman, Mr. L.D. Collins, called the meeting to order at 7:35 p.m. Ms. Reed moved to accept the minutes of the January 14th meeting, Dr. Waddington seconded and the motion passed. In the first order of business, Mr. Boschee highlighted the January activity report, and thc board discussed the December air sampling in the North Park area. Mr. Boschee gave an overview of his inspections under industrial compliance, the procedures of the 2002 Emissions Inventory, the complaints he has responded to, and the written/verbal communications he has had with Fox Lumber, French's Sandblasting, and with the Department of Environmental Quality. Mr. Boschee also explained the meetings he had with Mr. Dwight Vigness, Mr. Mark Kaufman, and Mr. Fichtner. Concerning the proposed changes to the Yellowstone County Air Pollution Control program, Mr. Boschee explained the requirements to adopt these changes. Mr. Boschee also highlighted the general provisions and the board discusses these provisions, protocols, regulations, and the proposed changes. Chairman L.D. INDUSTRIAL COMPLIANCE A. There was no industrial compliance done during the month of March. Il. ADMINISTRATION A. With 67% of the fiscal year co~npleted, we have expended approximately 58% of our budgeted funds. B. I wrote letters to the individuals involved with the wood stove complaint on Bison Road. C. Stuart investigated a sawdust complaint at Fox Lumber in Laurel; they were releasing sawdust from the overfull hopper. D. I investigated a wood stove complaint at 708 St. John's. E. Laura and I worked on several revisions to the proposed changes to the Program. We sent a copy of the latest edition in the mail. III. MEETINGS A. i met with the Commissioners concerning our agency's proposed changes in our Program. They indicated they would like to discuss these changes with the Board. I invited them to our April 8th meeting. B. I traveled to Helena to meet with DEQ monitoring officials concerning Network Review. They agreed to move the Lower Cobum monitoring site to a location in the Heights not yet determined. IV. AIR QUALITY A. During the month o£ March, 595 open burning permits were issued. B. Let me Again explain, to you, as 1 have had to explain to the others that you misled on the fact o£ that and another picture of that same time. I enclose them in this letter and number them I and 2. (Please include in lile) These pictures was taken years ago whea 1 Ih'st reported this massive polluting, at that time Yefiowstone county pollution was then even denying this was happening. If you would check the records of MDEQ, Empire Steel claimed that this was only an "isolated incident" so 1 continued to take pictures o£ the same area, the same fence line to show the large drills, how did these drills get there since the first two pictures? That was thc point then and is still the point now, as I explained m a letter in the state file, Yellowstone county pollution continues to deny tile facts and cover for the sandblasters in lhe North Park area, I don't think it would be so thnny if this finds the way to the courts and City, Counly and State could have "potential liability", as stated in Mr. Brown letter to the county. 1 believe you should read the huge amonnt of warnings on Silica sandblasting, Silicosis, and the deadly effects, from NIOSH and the dept of Health and Human services, as is mentioned Dr's can now identify Silicosis from other respiratory problems. I hope to see everyoae in this area that are on oxygen or any respiratory and related problems be tested just as is happeni,g in Libby. Even tho you are on the record That this is no different than sandbox or beach sand, how is it you know more than the Dept of Health and Human Services?? I feel you don't care at all about the many children of North Park School or the rest of us in the North Park area, but hopefully Dept of Itealth will eventually help us out as they are in Libby. I understand wily you like to focus on that one picture rather than the dozens of other pictures taken aud some of which should be in your file, and many others that are itl the MDEQ and city file, 1 Quit sending pictures to you long ago, as I and many others feel it is a waste o£time to send them to you, but they all are in my file Notice picture # 1, the fence line, ofyears ago when I first tried to get this stopped, then notice picture # 3, the fence fine of 2002. There ale many many more facts in the pictures and file that are being iguored, 1 hope the couaectioa be exposed, wily this deadly pollution is allowed to continue itl the very populated North Park area and even all are on the boarder of the School. On August 29, 2002, I ordered Elnpire Steel to take corrective action on its fugitive sand problem. They were ordered to clean up Iheir lot, to install a nol'tb wall Olr its sandblasting facility, and to put tarps up oil the fence ou North 15~h. Ou Decelnbcr 13, 2002, I wrote a letter to Einpire Steel stating they have complied willl Ibc order lo lake corrective aclion inchlding putting up ti l)el'lnanent harrier oil North 15'1'. I stated 1 bclieved they were in COlnpliance with ARM 17.8.308, and I closed the case. At that time, all pictures of Empire Steel taken belbre that date became historical in uature. Once a source has complied with an order to take corl'cctive action, all evidence which Icad to that order becomes part of the past invcstigatiun. Il'you want lo reopen the case against Enrpire Stccl's fugitive sand problem, we nmst start a new investigation and a new picture file dated after 12/13/2002. On December 6, 2002, I sent a letter to Robert SOS Signs stating they had colnplied with the order to take corrective action of.September 19, 2002. They cleaned up thcir Iol, and Ihcy Cl'Cctcd a pcrmancnt cnclosnrc in which lo sandblast. I slated I bclicvcd Ihey were in compliance with ARM 17.8.308, and I closed thc case. You must start a new picture file dated aller 12/6/2002 on Robert SOS Signs to reopen this case to prove the corrective actions were illsulticicnt. Frencb's Sandblasting and Painting was ordered to take corrective action on Jalmary 16, 2003 to control its fugitive sand. They were required to erect a temporary enclosure ofscaffi~Idiag and tarps in which to sandblast. Upon completion of this project (see enclosed picture), all pictures in your file prior to January 16, 2003 becalne historical in nature. Wilco lite case has been resolved, it will return to my jurisdiction. Until that lime, I have uo involveinent in the case. If you disagree with the decisiolrs I have lnade concerning these cases, you call request a hearing before the Yellowstone County Ail' Pollution Control Board. The Board meets tile second Tuesday of every monlh, aad you can call our agency at 256- 6841 to request addition to the Age~da. I have addressed your health concerns o~ several occasions.
