Minutes of the Yellowstone County Air Pollution Control Board
meeting held December 10, 2002, at the Yellowstone County Air
Pollution Office.
Members Present: Dr. Mark Waddington, Mr. Rick Schilf, Ms. Michelle Reed, Mr. Bill
Shikany, and Mr. Jack Johnson.
Other Present: Mr. Russell Boschee, Mr. Stuart Hannah.
Vice Chairman, Dr. Mark Waddington, called the meeting to order at 7:33 PM. Ms. Reed
moved to accept the minutes of the October 8th meeting, Mr. Johnson seconded, and the
motion passed.
In the first order of business, Mr. Boschee explained why there had been no industrial
compliance actions during the past several months and that the budget is still in good
standing.
Regarding Fox Lumber in Laurel, Mr. Boschee detailed the operations and the control
equipment that Fox Lumber has installed.
Concerning the complaint against the businesses in the North Park area, Mr. Boschee
gave an overview of the actions these businesses have completed to control fugitive dust,
the actions of the Yellowstone County Air Pollution Control in regards to air monitor/ng,
collecting soil samples in the North Park area, and the test results of the before mentioned
soil samples that were conducted by Energy Labs Inc. Mr. Boschee also discussed the
timeline of communications with State Representative Ron Brown and the State
Department of Environmental Quality in Helena. Mr. Boschee explained that the
Yellowstone County Air Pollution Control Office caB only test and monitor ambient air
quality under the guidelines mandated by the Environmental Protection Agency and not
guidelines outlined by the National Institute of Occupational Safety and Health, which
deal solely with the conditions within a work place.
In regard to the analyzing of soil samples and air filters gathered from the North Park
area, Mr. Boschee informed the board that outside agencies were chosen to test and
analyze this material, so that the Yellowstone County Air Pollution Control could not be
accused of manipulating the data and/or results. Mr. Boschee informed the board that a
representative fi.om the State Department of Environmental Quality observed samples
that were gathered by the Yellowstone County Air Pollution Control.
In other business, the board discussed the procedures and merits to regain local
enforcement capabilities.
In the final order of business, Mr. Boschee informed the board about the total number of
fire permits issued for November and the year.
Vice Chairman, Dr. Mark Waddington, adjourned the meeting at 8:20 p.m.

1. INDUSTRIAL COMPLIANCE
A. There was no industrial compliance done during the month of December.
II.
ADMINISTRATION
A. With 42% of the fiscal year completed, we have expended approximately
35 % of our budgeted funds.
B. The yearly reimbursement from the City of Billings has been requested
and received.
C. The case was closed on Robert Sos Signs, Inc. The report is enclosed.
D. The case was closed on Empire Steel Manufacturing, Inc. The report is
enclosed.
E. A letter was written to Mr. Marvin Lange concerning the sandblasting in
the North Park area. It is enclosed.

We have sent letters to our agency's minor sources concerning emission
inventory. We will process this information when we receive the
information back.

MEETINGS
A. Commissioner Bill Kennedy and I met with Mr. Marc Kaufman, Plant
Manager at Fox Lumber, concerning their sawdust abatement system.
IV. AIR QUALITY
A. During the month of December, our agency issued five open buming
permits for recreational buming campfires. Our agency issued 1947 open
burning permits last year.
B. Our agency completed its PM-10 particulate study in the No,ch Park area,
and we are awaiting results from the state DEQ.
