HomeMy WebLinkAboutCity Council Minutes 11.06.2002MINIJTES OF THE CITY ( OI.I'NCIL OF IAU'REL November 6, 2002 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor Bud Johnson at 7:00 p.m. on November 6, 2002. COUNCIL MEMBERS PRESENT: Lauren Van Roekel Ken Olson Gay Easton Doug Poehls Mark Mace Daniel Dart John Oakes COUNCIL MEMBERS ABSENT: Dan Mears Mayor Johnson asked the council to observe a moment of silence. Mayor Johnson led the Pledge of Allegiance to the American flag: Mayor Johnson stated that the zoning variance under scheduled matters was for a 2~3773-acre site, not a 20-acre site. MINUTES: Motion by Alderman Oakes to approve the minutes of the regular meeting of October 15, 2002, as presented, seconded by Alderman Mace. Motion carried 7-0. Letter of October 15, 2002 regarding presentation to CORRESPONDENCE: Yellowstone Historic Preservation BOard: council. CONSENT ITEMS: · Claims for the month of October 2002. A complete listing of the claims and their amounts is on file in the Clerk-Treasurer's Office. · Approval of Payroll Register for PPE 10/13/02 totaling $108,713.40. · Approval of Payroll Register for PPE 10/27/02 totaling $111,693.68. · Receiving the Committee Reports into the Record. --Budget/Finance Committee minutes of September 30; 2002 were presented. --City Council Committee of the Whole minutes of October 15, 2002 were presented. --Public Works Committee minutes of October 7, 2002 were presented. --Council Workshop minutes of October 29, 2002 were presented. · Resolutions. Resolution No. R02-74: Establishing a compensatory time off policy for non-exempt, non-union employees. Resolution No. R02-75: Resolution declaring that an emergency exists with regards to the City Shop. The mayor asked if there was any separation of consent items. There was none. Motion by Alderman Olson to approve the consent items as presented, seconded by Alderman Poehls. Motion carded 7-0. Council Minutes of November 6, 2002 COMMUNITY ANNOUNCEMENTS (ONE-MINUTE LIMIT): None. Kenneth Beven read the following statement to the Mayor and the Council: I wish to clarify the remarks I made to the Mayor in our conversations. I did not intend that my comments be taken that I opposed the zone change on the property north of the City belonging to the Laurel Masonic Temple Association. I am not opposed. I only wanted to convey that I did not support the manner in which things seemed to be happening. In my opinion, I felt that it was beneath the philosophy and the code we are inculcated to uphold in this fraternal organization. Having been a supervisor for this city and worked with city mayors and council members, I am confident that you will make a decision in this matter consistent with the obligations of your respective offices and with due regard for the best interests of the City o£ Laurel. Thank you for this time and please accept my apologies if I have misled you with any of my comments. Thank you. SCHEDULED MATTERS: · Confirmation of Appointments. Board of Appeals: one position - unspecified length of term Zoning variance to allow zone change from Agricultural Open-Space to Community Commercial adjacent 'to Airport Road for 2.3773-acre site in the NE ¼ of Section 4, T2SR24E. Planning Board recommends denial. Public hearing was held on October 15, 2002. Motion by Alderman Poehls to approve the zoning variance to allow zone change from Agricultural Open-Space to Community Commercial adjacent to Airport Road for 2.3773-acre site in the NE ¼ of Section 4, T2SR24E, seconded by Aldemaan Olson. Motion carried 5-2, with Aldermen Poehls and Oakes voting nay. Ordinance No. 002-31: Community Entryway Zoning District (public hearings held on August 6, 2002, August 20, 2002, September 3~ 2002, September 17, 2002, October 1, 2002, October 15, 2002) Second reading. Motion by Alderman Easton to adopt Ordinance No. 002-31, Community Entryway Zoning District, seconded by Alderman Poehls. Motion by Alderman EastOn to amend Ordinance No. O02-31, Community Entryway Zoning District, as changed through October 29, 2002, inclusive, seconded by Alderman Poehls. Motion carried 7-0. Motion by Alderman Easton to continue the vote on Ordinance No. 002-31, Community Entryway Zoning District, as amended, to November 19, 2002, seconded by Alderman Van Roekel. Motion carried 7-0. · Ordinance No. 002-36: Ordinance amending Chapter 12.04 of the Laurel Municipal Code relating to sidewalk repair. First reading. Motion by Alderman Van Roekel to adopt Ordinance No. 002-36, seconded by Alderman Olson. A roll call vote was taken on the motion. All seven aldermen present voted aye. Motion carried 7-0. The public hearing for Ordinance No. 002-36 will be on the council agenda on November 19, 2002. · Ordinance No. 002-37: Ordinance amending Chapter 12.12 of the Laurel Municipal Code relating to bond required. First reading. Motion by Alderman' Olson to adopt Ordinance No. O02-37, seconded by Alderman Van Roekel. A roll call vote Was taken On the motion. All seven aldermen present voted aye~ Motion carried 7-0. The public hearing for Ordinance No. O02-37 will be on the council agenda on November 19, 2002. 2 Council Minutes of November 6, 2002 · Ordinance No. 002-38: Ordinance amending Chapter 12.16 of the Laurel Municipal Code relating to authority to remove obstruction. First reading. Motion by Alderman Easton to adopt Ordinance No. 002-38, seconded by Alderman Poehls. A roll call vote was taken on the motion. All seven aldermen present voted aye. Motion carried 7-0. The public hearing for Ordinance No. 002-38 will be on the council agenda on November 19, 2002. · Ordinance No. 002-39: Ordinance amending Chapter 16.12 of the Laurel Municipal Code relating to application requirements. First reading. Motion by Alderman Easton to adopt Ordinance No. 002-39, seconded by Alderman Olson. A roll call vote was taken on the motion. All seven aldermen present voted aye. Motion carried 7-0. The public hearing for Ordinance No. 002-39 will be on the council agenda on November 19, 2002. Ordinance No. 002-40: Ordinance amending Chapter 16.16 of the Laurel Municipal Code relating to minor plat application requirements. First reading. Motion by Alderman Oakes to adopt Ordinance No. 002-40, seconded by Alderman Dart. A roll call vote was taken on the motion. All seven aldermen present voted aye. Motion carried 7-0. The public hearing for Ordinance No. O02-40 will be on the council agenda on November 19, 2002. · Ordinance No. O02-41: Ordinance amending Chapter 16.40 of the Laurel Municipal Code relating to mobile home parks: First reading. Motion by Alderman Dart to adopt Ordinance No. O02-41, seconded by Alderman Oakes. A roll call vote was taken on the motion. All seven aldermen present voted aye. Motion carried 7-0. The public hearing for Ordinance No. 00241 will be on the council agenda on November 19, 2002. Ordinance No. 002-42: Ordinance amending Chapter 16.52 of the Laurel Municipal Code relating to monumentation. First reading. Motion by Alderman Mace to adopt Ordinance No. 002-42, seconded by Alderman Poehls. A roll call vote was taken on the motion. All seven aldermen present voted aye. Motion carried 7-0. The public hearing for Ordinance No. 002-42 will be on the council agenda on November 19, 2002. ITEMS REMOVED FROM THE CONSENT AGENDA:' None. AUDIENCE PARTICIPATION (THREE-MINUTE LIMIT): None. COUNCIL DISCUSSION: The council discussion was held during the Committee of the Whole. UNSCHEDULED MATTERS: None.
