Call meeting to order Approve minutes of previous meeting Discussion on Fox Lumber with Commissioner Kennedy & Mr. Fichtner Activity Report Minutes of the Yellowstone County Air Pollution Control Board meeting held October 8, 2002 at the Yellowstone County Air Pollution Control Office. Members Present: Mr. L.D. Collins, Dr. Mark Waddington, Mr. Wade Steinmetz, Mr. Rich Schilf, Ms. Michelle Reed, and Mr. Bill Shikany. Others Present: Mr. Russell Boschee, Mr. Stuart Hannah Chairman L.D. Collins called the meeting to order at 7:38 P.M. Ms. Reed moved to accept the minutes of the September 10th meeting. Mr. Schilf seconded, and the motion passed. In the first order of business, Mr. Boschee discussed that there had been no industrial compliance taken in the past month, and that the budget was in good standing. Mr. Boschee discussed in detail the past months complaints and actions taken with the J&E Builders project on Hawthorne Lane, the sandblasting operations at Fmnch's Sandblasting and Painting, and Robert Sos Signs. Concerning the fire ban, Mr. Boschee informed the board that he had been present at a meeting with Mr. Jim Kraft. The board, in general, discussed the merits of a permanent ban on open burning in Emerald Hills and questioned if the County could build fire access roads in this area. Discussion also was held on whether permanent fire bans are presently legal or not. Regarding Fox Lumber in Laurel, Mr. Boschee informed the board that he had heard no further complaints since his inspection oftbe site on September 11, 2002. In other business, the board discussed the merits of having local enforcement ability, or whether it is best to continue to have the state be responsible for enfomement of violations. Discussion consisted of what previous enforcement authority the board has had, and what would be needed to regain this authority on a local basis. Mr. Boschee informed thc board members that he would provide each member with the current Air Pollution Program at the next meeting. In the final order of business, Mr. Boschee informed the board that a new job reclassification study will be conducted in January of 2003. Chairman L.D. Collins adjourned the meeting at 8:20 P.M. Activity Report for the month of October 2002 for submittal to the Yellowstone County Air Pollution Control Board on November 12, 2002. I. INDUSTRIAL COMPLIANCE A. There was no industrial compliance action taken this month. II. ADMINISTRATION A. With 25% of our fiscal year completed, we have expended approximately 20% of its budget. B. I investigated a coal ash co~nplaint by Doug Dreesen on Road 22 South near Ballantine. C. I sent the material for classification of our agency's positions to the Human Resource Depa~nent. D. I wrote a letter to Marvin Lange concerning hazardous waste in his area. III. SCHOOLS & MEETINGS A. Mr. Hannah and I attended and passed the Visible Emissions School in Helena. I met with State DEQ officials, Mr. Klemp (Permitting), Ms. Wolfe (Planning), Mr. Haheck (Planning), Mr. Norton (Compliance), and Mr. Alheim (Enforcement) - concerning our agency's enforcement. They said our agency could not do any enforcement until our agency reinstated its regulations. C. I met with the County Commissioners concerning open burning. The open burning ban was lifted except in the Emerald Hills area. Do I attended a Clean Air Act Advisory Committee meeting in Helena. Also, 1 met with Ms. Jan Brown, DEQ Rules Writer, concerning reinstating our agency's enforcement regulations. IV. E. I attended a month-long Supervisor Training Program sponsored by Yellowstone County. F. I met with Mr. Dwight Vigness, Human Resource Director, concerning our agency's classification and discussed other agency benefits. AIR QUALITY A. During the month of October, 63 open burning permits were issued. B. E. ENFORCEMENT: DEQ shall initiate all enforcement actions against Regnlated Sources in Yellowstone County. Yellowstone shall notify the DEQ Yellowstone Couuty Air Compliance Coordinator of all Regulated Source violatious within 30 calendar days following occurrence and provide timely notification to the DEQ of violation(s) discovered at auy source withiu Yellowstone County. DEQ shall take m~y necessary enforcemeut action consistent with the requirements of the State-EPA Enforcement Agreement. To the extent its resources allow, Yellowstone shall assist DEQ with enforcement actions against any Regulated Sources located in Yellowstone Couuty. Within 10 calendm' days following any air pollution episode in which concentratious exceed a level 20 percent below any state or federal ambieut standard or in which concentrations exceed any state or federal alnbieut standard, Yellowstone shall draft a brief report summarizing the episode including a sulnll~ary of tile preliminary data (TEOM or carbon monoxide data prior to quality assurance checks), possible causes, and any con'ective action taken (e.g. alerts issued). IlL PERI¥11TTING: A. COUNTY PEI~vlITS: Yellowstone shall process open burning pemfits in accordance with local regulations and consisteut with the requirements of Montana's open burning regulations. By June 30, 2003, Yellowstoue shall submit to the DEQ Air Pernfitliug Section Supervisor (1) one copy of an open burning permit issued by Yellowstone duriug lhe term of this Agme~nent, aad (2) the Yellowstone County Open Burning pemfit application form. As part of the Quarterly Report referenced in Section X, Yellowstone shall submit to the DEQ County Air Contract Coordiuator the number of open burning permits issued, and if
