Call meeting to order Approve minutes of previous meeting Activity Report Minutes of the Yellowstone County Air Pollution Control Board meeting held September 10, 2002 at the Yellowstone County Air Pollution Control Office. Members Present: Mr. L.D. Collins, Dr. Mark Waddingtnn, Ms. Michelle Reed, Mr. Nick Shyne, Mr. Rich Schilf, Mr. Jack Johnson, and Mr. Bill Shikany. Others Present: Mr. Russell Boschee, Mr. Stuart Hannah Chairnmu L.D. Collins called the meeting to order at 7:33 P.M. Ms. Reed moved to accept the minntes of the June I ItI' meeting. Mr. Shyue seconded, and the motion passed. In the first order o£ busiaess, Mr. Boschee reminded the board about the election of Board Officers. Ms. Reed motioned the officers to remain in the same position. Mr. Shikany seconded, and the motion passed with Mr. L.D. Collins as Chairman, Mr. Mark Waddington as Vice- Chairman, and Mr. Wade Steinmetz as Secretary. Mr. Boschee gave a brief overview o['the hiring process of Mr. Ilannah. Mr. Boschee also reviewed the salary and longevity pay associated with the Director's position, and a correction to the budget was noted that the City-County llealth Department did not fund $1200 tt*the Air Pollution Control budget. It was part of the Health Insurance Levy enncted by Yellowstone County. Dr. Waddington moved to accept the budget. Ms. Reed seconded, and the motion passed. Concerning July's ludustrial Compliance, Mr. Boschee discussed the industrial inspections he conducted with Empire Steel Sand & Gravel, JTL Group, Inc., and Ostermiller, Inc. During the discussion, it is noted that all three businesses were within the linfits allowed and showed no visible signs o£emissious or fugitive dust. Mr. Boschee also gave a brief overview of air pollution complaints received From local citizens, which were investigated. Regarding Empire Steel's sandblasting, Mr. Boschee and the board members discussed and reviewed the situatioa. Time lines o£ events and letters .w. ere discussed in regards to Mr. Marvin Lange and his complaiuts against Empire Steel. Mr. Boschee explained the standards required which would determine if the state or the county would be responsible for enforcement. Concerning July's Administration, Mr. Boschee said that office files were being reviewed, and the agency's budget is in good shape. Regarding July's Air Quality, Mr. Boschee briefly reviewed the air quality reports for the month of July, and he discussed the open burning ban and when it may be lifted by the County. Chairman L.D. I. INDUSTRIAL COMPLIANCE A. There was no industrial compliance action taken this month. II. ADMINISTRATION A. With 17% of the fiscal year completed, we have expended approximately 12% of our budgeted funds. I investigated a dust complaint concerning the new J&E Builders project on Hawthorne Lane. This was the third time I investigated this development. This is a typical residential development in our area. The only difference is the ~lay soil in the area, which is easily airborne during dry and windy conditions. i investigated the dust complaints from the sandblasting at French's Sandblasting and Painting on North 18th Street and Robert Sos Signs on 6th Avenue North. I enclosed a letter sent to the complainant concerning this matter. lI1. MEETINGS Ao I met with Mr. Jim Kraft, Emergency and Disaster Director, concerning the open burning ban and the permanent open burning ban in Emerald Hills in Lockwood. I met with Mr. Jim Stevens, Code Enforcement Officer in Laurel, and Mr. Marc Kaufman, Manager of Fox Lumber in Laurel, concerning the fugitive sawdust problem at Fox Lumber. Later, I met with Mr. Steve Klotz, Public Utilities Director, concerning this matter. A letter of my investigation is enclosed. IV. AIR QUALITY A. During the month of September, two open burning permits were issued for essential agricultural burning. The ban is still in effect. B. We discussed the sawdust complaints from neighbors. During the inspection, we toured manufacturing plant/ti which has been in operation for about two years. We inspected the sawdust containment system, which included a duct system, a cyclone, and a hopper storage facility. This containment system had just been completed, and it was operating with little fugitive sawdust visible. This system, when operated correctly, should contain most of the fugitive sawdust produced in manufacturing plant # 1. During the inspection, we toured manufacturing plant #2 which has been in operation about two months. We inspected the sawdust containment system, which included a duct system, a cyclone which dropped the sawdust into a haul aWay trailer picked up by McKenzie Garbage Service. This system was inadequate as much of the sawdust was piling up on the ground, although it is being hauled away on a timely basis there is the potential of fugitive dust to be blown off the premises. We talked with Mr. Kaufman about our concerns. He said he met with company officials and a contractor ou September 10, 2002 concerning this matter. They determined that they could duct the manufacturing plant #2 fugitive sawdust into the cyclone and hopper system from manufacturing plant #1 with a few modifications. They would need another cyclone and a negative pressure system to complete the project. Mr. Kaufman said Fox Lumber had agreed to fund these improvements, and they requested ninety (90) days to complete this project. I granted them ninety (90) days, and I requested that Fox Lumber put their commitment to these improvements in writing and send it to my office. When these improvements are completed, Mr. Stevens and I will again inspect the manufacturing plants to insure compliance with ARM 17.8.308. Respectfully, Russell Boschee Director
