COUNCIL CHAMBERS A Council Workshop was held in the Council Chambers and called to order by Mayor Bud Johnson at 7:02 p.m. on October 8, 2002. COUNCIL MEMBERS PRESENT: _x_ Lauren Van Roekel x Ken Olson _x_ Gay Easton Dan Meats _x_ Doug Poehls x Mark Mace Daniel Dart x John Oakes OTHERS PRESENT: Casey Joyce Cal Cumin Matt Erekson HOME Program - Casey Joyce · HOME Grant/Loan Program - under Department of Commerce · 1996 application and grant received was reviewed · HOME Application being prepared by Casey for home rehabilitation · 1994 household income figures were more restrictive than the current program. o In 1994, low income - $13,300; moderate income - $21,300 o In 2002, low income - $17,000; moderate income - $27,200 o More households will qualify - broader application base · Some resources of other areas will be used (needs assessments) · Deadline for application submittal is November 1, 2002 · HOME Program from 1994 still has $30,000 left in it from loan repayments · CDBG Program has $38,000 still in it from previous grunt/loan programs. These monies can be used to supplement the new HOME grant/loan program or can be used for other community needs such as parks with DOC approval; must benefit whole community · CDBG Program - also under State Department of Commerce · October 1, 2002 was the deadline for submittal of a new CDBG application - no application for new funds for two years · Housing Rehab Program being applied for will be administered by Casey, through a locally appointed Loan Review Board if we are successful in obtaining the grant/loan. · HOME Program provides homebuyer assistance and help in housing rehab in conjunction with a commercial bank. · 20% match is required · $500,000 grant max · HRDC will provide the on-site assessment and building inspection services required to properly review applications for loans. City Council Workshop minutes of October 8, 2002 Comprehensive Plan - Cai Adopted in 1979 - still valid for community planning guidelines Can be an~ended, but is a formal process that usually occurs when rezoning is requested that does not conform to the Plan, and the City supports the proposed change. · Adopted land use plan for Laurel in the 1979 Plan; needs to be updated and adopted again · Compact downtown business district is a central theme of the 1979 Plan · Last Legislature changed name "Comprehensive Plan" to "Growth Management Plan" · State set a deadline for the preparation of new GMP's of October 1, 2000 - very few counties or incorporated communities in Montana have accomplished this; Yellowstone County and the City of Billings are just starting theirs. · New OMP must cover the whole City-County Planning Jurisdictional Area, which the old Comprehensive Plan does not. · Review of state code (76-1-601 MCA, attached) Ordinances - Matt · Nothing Internet and E-mail policy. · Nothing Ent .ryway Zoning District - proposed changes · Addresses off-premise signs only · Addresses only new uses; everything that is in place, all businesses, landscaping, signs, etc., (except billboards), are exempt from this EZD ordinance. · Interpretation of"subdued color" is by normal dictionary definition · Landscaping: the smaller the buffer, the more landscaping needed (developer's discretion) · Small signs for church signs might need updating: Cai to check · Ordinance 17.56 - "grandfathered uses section" o This section of the existing City Zoning Ordinance provides that any land use existing at the time of adoption of new zoning regulations is exempt from the new ordinance, i.e., it is grandfathered in and becomes a legal, non-conforming use. This section of the City Code is Chapter 17.56, and Section 17.56.010 specifically states: "Any lawful use of the land or buildings existing at the date of passage of the ordinance codified in this chapter, and located in a district in which it would not be permitted as a new use under the regulations of this chapter, is declared to be a nonconforming use, and not in violation of this title..." · The only place where such uses are not grandfathered is for off-premise billboards, which must be brought into conformance within seven years. · East Main and West Main are not covered in the EZD; maybe someday once we get through the proposed EZD, these entries can be included. Discussion on lot purchase · Description of need and plan for use will be presented at workshop 2 City Council Workshop minutes of October 8, 2002 Ci .ty/State holiday - November 5th -- reschedule council meeting · Staff direction for resolution changing council meeting to November 6th Agenda discussion · South Fourth Street cold storage units that have requested a zoning change/variance and for which a public hearing has been advertised by the Council may be allowed under a previous variance granted about 15 years ago by the Board of Adjustment. This meeting is for information and discussion by the Council. GROWTH MANAGEMENT PLAN (Required by State law--by October 1, 2000) 76-1-601. Growth policy -- contents. (1) The planning board shall prepare and propose a growth policy for the entire jurisdictional area. The plan may propose ordinances or resolutions for possible adoption by the appropriate governing body. (2) A growth policy must include: (a) community goals and objectives; (b) maps and text describing an inventory of the existing characteristics and features of the jurisdictional area, including: (i) land uses; (ii) population; (iii) housing needs; (iv) economic conditions; (v) local services; (vi) public facilities; (vii) natural resources; and (viii) other characteristics and features proposed by the planning board and adopted by the governing bodies; (c) projected trends for the life of the growth policy for each of the following elements: (i) land use; (ii) population; (iii) housing needs; (iv) economic conditions; (v) local services; (vi) natural resources; and (vii) other elements proposed by the planning board and adopted by the governing bodies; (d) a description of policies, regulations, and other measures to be implemented in order to achieve the goals and objectives established pursuant to subsection (2)(a); (e) a strategy for development, maintenance, and replacement of public infrastructure, including drinking water systems, wastewatar treatment facilities, sewer systems, solid waste facilities, fire protection facilities, roads, and bridges; (f) an implementation strategy that includes: (i) a timetable for implementing the growth policy; (ii) a list of conditions that will lead to a revision of the growth policy; and (iii) a timetable for reviewing the growth policy at least once every 5 years and revising the policy if necessary; (g) a statement of how the governing bodies will coordinate and cooperate with other jurisdictions that explains: (i) if a governing body is a city or town, how the governing body will coordinate and cooperate with the county in which the city or town is located on matters related to the growth policy; (ii) if a governing body is a county, how the governing body will coordinate and cooperate with cities and towns located within the county's boundaries on matters related to the growth policy; (h) a statement explaining how the governing bodies will: (i) define the criteria in 76-3-608(3)(a); and (ii) evaluate and make decisions regarding proposed subdivisions with respect to the criteria in 76-3-608(3)(a); and (i) a statement explaining how public hearings regarding proposed subdivisions will be conducted. (3) A growth policy may: (a) include one or more neighborhood plans. A neighborhood plan must be consistent with the growth policy. (b) establish minimum criteria defining the jurisdictional area for a neighborhood plan; (c) address the criteria in 76-3-608(3)(a); (d) evaluate the effect of subdivision on the criteria in 76-3-608_(3)(a); (e) describe zoning regulations that will be implemented to address the criteria in 76- 3-608(3)(a); and (f) identify geographic areas where the governing body intends to authorize an exemption from review of the criteria in 76-3-608(3)(a) for proposed subdivisions pursuant to 76-3-608. (4) The planning board may propose and the governing bodies may adopt additional elements of a growth policy in order to fulfill the purpose of this chapter. History: Ap. p.
