Board discussed a COml~cns`alion package I~escnlcd by l)ircclor Boschce. l)r. Waddington
moved to set Dircclor Boschcc's salt`ay al $47,049 per year wilh a review of Iris salary no later

Concerning M`ay's Industrial Compliaacc, Mr. Bt~schee said Mr. Duganz inspected Schesslcr
Ready Mix in Laurel and JTI. Grtmp on Shiloh Road, nad hc found bolh to be ia compliance and
no dust visible on their haul roads.
Concerning Mny's Admiaistralion, Mr. Boschee said oar agency's budget is in good shape, but
lhe year-end budge[ may be distodcd dae lo Steve D`aganz's retirement. Mr. Boschce said he and
Mr. I)uganz mci wilh Iht Ctmaly Cmnmissitmcrs Ibr o0r Agency's b`adgcl review. Money was
taken out o1' reserve Ik~r Steve I)uganz's scrota`acc pay, and to balance lifts ycm"s budget. This
shmdd bring our Agency's reserve [kinds down lo an acceptable accounting reserve level.

month. Mr. Boschec noted the S()2 `and CO levels wcrc Iow this nlonlh, as they usually are
during the summer moaths.

Activity Report for the mouth of July 2002 for submittal to the
Yellowstoue County Air I'olluiiou Control Board.on August 13, 2002.
I. INDUSTRIAL COMPLIANCE
A. Coors Barley Storage and Processing facility on Road 4 South near
Huntley was inspected and found in compliance. This is a state-of-the-art
facility to process and store barley. No visible emissions were found
during the load t~ut of trucks, and no fugitive dust was present around the
£acility.
11. ADMINISTRATION
A. Last year's budget had a $13,000 deficit due to Steve Duganz's severance
package. The hudget For fiscal year 2002-2003 has been finalized and
included in the Board material.
B. A letter was written to Ms. Donna lluston of the City-County Planning
Department concerning Mr. Mm'yin Lange's complaint about Empire
Steel's sandblasting and painting operation. It is included in the Board
material.
C. Mr. Stuart tlannah has been hired by the Board to fill the vacmit
Enviromnental Specialist position. He started his employment July 29,
2002. The minutes of the special session of the Board concerning his
employment are included in the Board material. Also, an outline of the
hiring process is included. · '
D. 1 investigated a dust complaint on Hawthorne Drive in Billings Heights.
A new subdivision is being built, and the roads have not been paved nor
the curb and gutter installed.
II1. MEETINGS
A. I met with the County Comtnissioners concerning Lockwood Fire
Department's request to permanently ban open burning in the Emerald
Hills area. 1 believe a permanent ban to be illegal, and the Lockwood Fire
Department needed to work through our agency for any open burning ban.
The request was approved, but the matter will be addressed again next
spring.
IV. AIR QUALITY
A. During the month of June, 30 open burning permits were issued before the
Couuty Commissioners banned open burning on July 16, 2002.

The Yellowstone Counly Air I'ollution Control is an investigative agency, not all
cnlbrcemcnt agency. Therein lie many ul'thc problems concerning tile complaint Mr.
Marvin Langc has made contel n ing Empire Slccl's sandblasting and painting opcratiou
on 6th Ave. North in Billiugs, Mt. The enlbrcement in this matter lies with tile
Department ol Enviromncntal Qt al'ty's Enl'orccment Division and its agent, Mr. Larry
AIhcim.
Fomier Director Steve Duganz inspected Empire Steel's sandblasting and
painting operation, talked with Mr. Lange, and ~cportcd his findings to Mr. Alheim. As
the new Director, 1 inspected Empire Steel's sandblasting and painting operation, talked
with Mr. Lange, and reported my linding to Ivlr. Alheim. lu the file, there is
correspondence between our agency and Mr. Lange as we tried to resolve this situation.
Our agency was ilot succcsslhl, alld you have asstlnled thc lead agent and agency in this
matter. You need to wolk with Mr. Alheim and his ageucy in the £uture, especially if any
cnl;orcetncnt is necessary ill this case.
1 would be willing to work together wilh you and your agency to address the
complaiuant's concern. I would be willing to serve on your observation team and lend
my twenty-live years ol'cxpcficncc ia thc air tlualily 'field Io your discussion of thc
sandblasting and painting Ol)cratioa at Empire Steel.
Since your agency has become the lead agency in this matter, 1 will deactivate my
file conccraing this matter uutil Mi'. Lange soblnils his petition or'thirty neighbors who
share his concerns about the Empire Steel's operation to our office.
