HomeMy WebLinkAboutOrdinance No. O02-26ORDINANCE NO. 002-26 ORDINANCE AMENDING CHAPTER 9.20.010 OF THE LAUREL MUNICIPAL CODE RELATING TO LOITERING PROHIBITED. WHEREAS, changes have been recommended to bring the Laurel City Code into comphance with state laws; and WHEREAS, it is in the best interests of the residents of the City of Laurel to pass such an ordinance; IT IS HEREBY ORDAINED by the City Council of the City of Laurel, Montana, that the LAUREL MUNICIPAL CODE is hereby amended as is set forth below. Chapter 9.20.010 shall be amended as follows: 9.20.010 Loitering prohibited. It is unlawful for any minor under the age of eighteen years to loiter, idle, wander, stroll, or &rive a car, truck or other motor vehicle, or ride in the same, or play in or upon the public streets, highways, roads, alleys, parks, playground, public places and public buildings, places of amusement or entertainment, vacant lots or other unsupervised places between the hours of eleven p.m. and five a.m. of the following day, official city time, for all days of the week excepting Friday and Saturday, and on Friday and Saturday it is unlawful for any minor under the age of eighteen years to do any of the above-named things or be in the above-mentioned places between the hours of one a.m. and five a.m.; provided, however, that the provisions of this section do not apply to a minor accompanied by his or her parent, guardian or other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or legitinmte business directed by his or her parent, guardian or other adult person having the care and custody of the minor. Each violation of the provisions of this section constitutes a separate offense. It is an affirmative defense to 9.20.010 that the minor is engaged in a legitimate First Amendment activity. (Prior code § 9.28.010) This ordinance shall become effective thirty (30) days after final passage by the City council and approved by the Mayor.
