HomeMy WebLinkAboutOrdinance No. O02-09ORDINANCE NO. 002-9 ORDINANCE AMENDING CHAPTER 2.60.170 OF THE LAUREL MUNICIPAL CODE RELATING TO POLICE COMMISSION DECISION - ENFORCEMENT APPEAL WHEREAS, changes have been recommended to bring the Laurel City Code into compliance with state laws; and WHEREAS, it is in the best interests of the residents of the City of Laurel to pass such an ordinance; IT IS HEREBY ORDAINED by the City Council of the City of Laurel, Montana, that the LAUREL MUNICIPAL CODE is hereby amended as is set forth below. Chapter 2.60.170 shall be amended as follows: 2.60.170 Police commission decision-Enforcement Appeal. A. When a charge against a member of the police force is found proven by the board, the mayor must make an order enforcing the decision of the board, and such decision or order shall be subject to review by the district court of Yallowstone County on all questions of fact and all questions of law. B. The district court of Yellowstone County shall have jurisdiction to review all questions of fact and all questions of law in a suit brought by any officer or member of the police force within a period of sixty days attcr thc decision of thc police commission or order of thc mayor has been filed with the city clerk-treasurer. (Ord. 972 § 4 (part), 1997; prior code § 2.20.220) This ordinance shall become effective thirty (30) days after final passage by the City council and approved by the Mayor.
