Minutes of the May 3, 2001 meeting were reviewed and accepted as written.
At this time the Planning Boazd was closed and the Zoning Commission opened.
Special Review -Day Care Center - 313 Forrest Avenue
Tacy Desjazlais spoke regarding the proposed Day Caze Center. The Center is already established and
has been since December. She is licensed through the State of Montana for up to 12 kids. At this time
she has 12 kids ages infant to 10 years old. She has one hired helper. The hours aze 7:00 am to 6:00 pm
Monday through Friday.
One letter of protest was received from Paul & Rita Kroll at 309 Forrest (see attached letter).
OPPONENTS:
Neil Fox, 315 Forrest, spoke in opposition. He says there are several issues that bother him. One issue
is the amount of traffic and how they pazk the wrong way on the street and up on the sidewalk and curb.
He is also questioning how a day caze center can be in a residential area?
Gerald Shay states that a day Caze center can be in a residential area if they go through the special review
process. The Board can place stipulations on the applicant to help alleviate some of the neighbors
concerns.
Mr. Fox states that the Desjarlais are good people but the day care center has created a lot more traffic
on very narrow streets. He is also questioning how this will affect the value of the homes in the area.
He also says that the noise the children create is also a factor in his opposition. _.
Gerald Shay questions if Mr. Fox has had any problems with rocks or items being thrown at his house
by the children?
Mr. Fox states that he hasn't had any problems with the kids. The pazking has been somewhat of a
problem due to the small lots.
Clarence Minch, 401 Durland, spoke in opposition. He states that there are quite a few illegal day cares
in the area and a lot of the people that are leaving their kids there are last minute people who drive very
fast on the narrow streets. He lives about a block away.
Mrs. Fox, 315 Forrest, states that her only problem is with the bawling and screaming kids. All day long
they bawl and scream and it upsets her.
Tacy Desjarlais states that kids are kids. They aze going to make noise. They are not outside all day
long and she and her helper monitor them.
Mr. Desjarlais states that day cares need to be in residential areas by the schools, although he wouldn't
want to live by one.
Mr. Minch states that the house seems to small to have 12 kids in it on a daily basis.
Mr. Fox states that there is no driveway into that property and that people drive over the curb and onto
the sidewalk.
At this time the public heazing was closed. (7:15 pm)
Tacy Desjazlais spoke regarding the letter of protest from Mr. Kroll.
In the letter Mr. Kroll stated that the kids were riding razor scooters and going up his driveway. Tacy
stated that the kids were doing that and once she saw what the kids were doing that she put a stop to it
by not allowing them to bring their scooters to day care.
She also stated that Mr. Kroll said they were pazking in his driveway. She states that her father did pazk
in Mr. Kroll's driveway but it was only while they were fixing up the day care last December when Mr.
Kroll was in Arizona. The only way Mr. Kroll would of known about them pazking in the driveway
would have been from the person that was watching his house. She did not think it was a big deal
because they weren't home. She would of thought that someone would of told her if it was a problem.
Kate Stevenson questioned Tacy on the amount of kids she has at any given time.
Right at this time she has 12 kids on and off. She does have one helper. She can have 6 to 8 kids before
she needs to have a helper on the premises.
Cal questions Tacy as to what she suggests could be done about the traffic?
Tacy states that there aze only 1-2 cazs at the same time dropping off or picking up kids. She hasn't seen
any pazents going fast down the street. She will advise the parents to obey the traffic regulations.
Cal questions as to how long she plans to keep this business?
Tacy states thate she hopes to have the business for many yeazs.

Cal recommends approval with the following conditions: 1) that the owners of the day caze advise the
parents to obey the traffic regulations; 2) that a 6 foot privacy fence be constructed per City code
between 309 and 313 Forrest (north property line); and, 3) that the City Council hold a public hearing
on the proposed day care.
Motion by Bud Johnson, second by Kate Stevenson, to recommend approval of the Special
Review for 313 Forrest, subject to the above 3 conditions. Motion carried by a 5-1 vote.
The Zoning Commission was closed and the Planning Board meeting reconvened at 7:28 P.M.
A letter from the County Commissioners was received ni regards to the application of Betty Hart and
Kurt Baltrusch for reappointment to the Planning Boazd.
Motion to recommend approval of Baltrusch and Hart to the County Commissioners was made
and seconded. Motion carried 6-0.
Laurel Haggart asked about the Sundance Lodge on Thiel Road on the Altman property. BLM has
finally fmished it's Management Plan for Sundance Lodge, and suggested ways that it be left in a natural
state with no motorized traffic. The Planning Boazd should write a letter to the BLM in support of the
proposed application.
Motion by Laurel Haggart, second by Bud Johnson to write a letter to the BLM in support of the
Altman application. Motion carried 5-0 with Ed Thurner abstaining.
The meeting was adjourned at 7:35 pm.

After review of the special review of a proposed Day Care Center for Tacy Desjairlais at 313 Forrest
Avenue, Laurel, Montana at our regularly scheduled meeting of June 7, 2001 the City-County Planning
Board recommends approval of the proposed Day Care Center at 313 Forrest Avenue, Laurel, Montana,
subject to the following conditions:
1. That the owner of the Day Care Center inform her clientele that they
obey the traffic laws when dropping off and picking up their children;
2. That a 6 foot privacy fence be constructed between 313 and 309 Forrest Avenue (north
lot line);
3. That the City Council set and hold a second public hearing on the proposed Day Caze
Center.

NOTICE IS HEREBY GIVEN that the Laurel-Yellowstone City-County Planning Board
will hold a Public Hearing on Thursday, June 7, 2001 at 7:00 pm in the Council
Chambers of City Hall, 115 W. 1st Street, Laurel, Montana, for the purpose of reviewing
a request for Special Review to allow a Child Caze Center in a Residential Limited Multi-

Q: You stated to me that you have been having problems with your neighbor for quite some time can you
tell me when these problems started.

Q: Have you ever seen your neighbors throwing anything at your property?
A; Yeah, we've seen the kids throwing rocks, and footballs, basketballs, anything.
Q: You stated to me that the neighbors you've been having problems with live at 313 Forrest is that
correct?
A: Right
Q: You also stated that you have had problems other than the rock throwing, can you tell me what else has
happened?
A: The kids aze playing in the driveway with the razor bikes and they run out into the street.
