Minutes of the Yellowstone County Air Pollution Control meeting held
December 11, 2001 at the Yellowstone County Air Pollution Control
Office.
Members Present: Mr. L.D. Collins, Mr. Bill Shikany, Mr. Wade Steinmetz, and Mr.
Rich Schilf, Dr. Mark Waddington
Others Present: Mr. Steve Duganz, Mr. Russell Boschee
Chainnan L.D. Collins called the meeting to order at 7:35 P.M.
Concerning old business, the tabled Odor Regulation was brought before the Board. The
Board discussed various amendments and definitions to be incorporated into the Odor
Regulation. Dr. Waddington moved to approve both the newly revised public nuisance
definition and also the elimination of the Emergency Episode procedure. Mr. Schilf
seconded, and the motion passed.
In other business, Mr. Duganz presented a working paper from Jim Kraft, Emergency &
Disaster Director, concerning the allocation of office space in the County Courthouse
after the Sheriffs Department moves to its new location. It suggested moving our
agency to the 3 d floor of the Courthouse. The Board discussed moving our agency to the
Courthouse or staying at its present location. Mr. Steinmetz moved that the Air Pollution
Control should remain at its present location. Mr. Shikany seconded, and the motion
passed.
Concerning November's Industrial Compliance, Mr. Duganz said he inspected Cremation
or Funeral Gallery on 8°i Street West. He found no visible emissions, and our agency has
had no complaints concerning its operation. He updated the Empire Steel Manufacturing
situation saying the DEQ detennined they needed no pennit. He said one individual has
complained about this situation for several years without merit.
Regarding November's Administration, Mr. Duganz said our agency's budget is in good
order, and our agency has received the yearly contribution to our program fiou; the City
of Billings. He noted the final report concerning the EMPACT project has been sent to
the EPA. He noted no money was set aside for expenses with the County Commissioners
concerning these expenses in the near future.
Concerning November's Air Quality, Mr. Duganz said our agency issued a few permits
in November, and our agency's yearly total should be around 1950 pennits.
Chairman L.D. Collins adjourned the meeting at 8:20 P.M

Activity Report for the month of January, 2002 for submittal to the
Yellowstone County Air Pollution Control Board on February 12, 2002.
1. INDUSTRIAL COMPLIANCE
A. The crematory at Laurel Bast Veterinary Service was inspected and found
to be in good operating condition. They continue to incinerate more
animal remains each year.
B. Another letter was written to a complainant regarding Empire Steel
Manufacturing explaining that enforcement action cannot be taken when
no laws or regulations are being violated.
IL ADMINISTRATION
A. With 58% of our fiscal year over, we have expended approximately 53%
of our budgeted funds. We have requested funds from the City of Laurel
and the DEQ.
B. Mr. Jack Johnson has been appointed to the Board by the City of Billings.
I have included an updated copy of the Board members.
III. MEETINGS
A. Public hearings were held before the Town Council of Broadview, the
City Council of Billings, and the Yellowstone County Commissioners
regarding updating our regulations. All approved the proposed changes.
B. During the mid-year budget review meeting with the Commissioners,
several itetns were discussed.
1) We have asked EPA for funding to add the Mount Olive site to the
EMPAC'r web page.
2) Requests for local funding should remain the same for this year rather
than asking for a 5",% increase.
3) The Commissioners still want us to move into the Courthouse in July.

IV. AIR QUALITY
A. During the month of January, we issued 150 open burning permits.
B. I have included two data summaries for 2001, one with monthly data and
the other with the high one, eight or 24-hour value.
