Meeting called to order at 7:55 p.m. with the following members

Minutes of previous meeting read and approved. Bills read and
approved for payment: Laurel Outlook, $20.00 advertising Graham annexa-
tions (first time); Building & Safety Dept., $300.00 administrative
services Dec. and Jan.; Cumin Assoc., $2,500.00 advisory services
Oct., Nov. and Dec., 1976. Bob Graham agreed to pay the bill from
the Outlook. Recommendations from Cumin Assoc. read regarding to-
night's hearings, copy in each file.
File #PB 76 -9 GRAHAM Annexation has been requested on Lots 7 - -12,
Block 8, Nutting Bros. Subdivision, with a zone designation of R -3.
General location of the property is the north end of Juniper Avenue
between 7th and 8th Streets being contiguous to the City of Laurel.
Cumin Assoc. recommends approval subject to compliance with the "Planned
Community Development Act." Discussion of City Council annexing less
than a block at a time. Bob Graham stated that Mr. Jerry Klein is the
developer and not himself. Does this involve the Simpson property on
Locust? No. This is the reason for only asking for the 1/2 block to

be annexed. The house and barn on Locust would have to be moved if
the whole block were to be developed. Mrs. Workman, spokesman for
the group of protesters, owns property south of the proposed development
and would like the property to be kept R -1, does not want to see rentals
on the adjoining properties. John MacMartin states that the adjoining
area is already zoned R -3. Land useage in the area is single family
dwellings. Motion from Otto Preikszas to recommend to the City Council
that they annex this property with compatible R -3 zoning subject to
compliance with State laws and regulations, seconded by William Siegel.
Passed 6 - -0.
File #PB 76 -10 GRAHAM Annexation has been requested on Blocks
2 - -5 of Casa Linda Subdivision, with a zone designation of R -1 for
Blocks 2 and 5. Blocks 3 and 4 are requested to be "split zoned."
In culdesacs the pie shaped lots are requested to be zoned R -1, and
the rectangular lots (south of pie shaped lots) are requested to be
zoned R -3. General location of the property is West 9th Street between
9th Avenue and 12th Avenue being contiguous to the City of Laurel.
Cumin Assoc. recommends approval subject to compliance with the "Planned
Community Development Act." Mr. Graham has tentative plans to cover
the drain ditches and to provide off -street parking. Mr. Graham pre-
sented pictures of 4- plexes and /or 6- plexes being planned. Discussion
of townhouses and condominiums. Ron Brown, representing a group of
protesters, lives in Casa Linda Subdivision and would like to see
this adjoining property remain R -1. He feels that R -3 would introduce
transient movement, property values would decrease, traffic and parking
problems, and garbage pickup problems. He states that he and his
neighbors purchased their properties with the idea that the surrounding
property would remain R -1 throughout the area to the Golf Club. Otto
Preikszas asked: Did you get a deed restriction from the seller? It
should be on file in the Yellowstone County Courthouse. Discussion
of 9th Street becoming a "collector" street and perhaps becoming
commercial along that road. Discussion of gas and energy hookups.
Graham said he did sell the property as R -1 but since has changed
his mind on the rest because of the costs involved in developing the
remaining 3 blocks. By putting in some multiple units he can defray
some of the costs incurred. Discussion of validity of the protests.
Motion by Otto Preikszas to recommend to the City Council that they
annex this property with zoning requested by the developer subject
to compliance with the "Planned Community Development Act," seconded
by William Siegel. Discussion of culdesacs and garbage pickups.
Passed 5 for, 1 against (Ken Christian voted "no ").

William J. Schweyen, Associate Planner with the Planning Division
of the Montana Department of Community Affairs in Helena, introduced.
Discussion of Supreme Court decision regarding State Board of Health's
jurisdiction. Discussion of parks, public use of lands, schools, etc.
Discussion of proposed legislative changes in subdivision laws regarding
occasional sales. Suggested raising to 40 acres requirement to come
under the subdivision act, do away with the occasional sale and propose
promise of a speedy review.

File #PB 76-11 GIBLIN /PELICAN revised minor plat. Motion to approve
by Ken Christian, seconded by Don Ronan. Passed. John Hawley Smith
and Otto Preikszas signed the plat. Subject to John MacMartin's
comments, the plat will come before the Council on January 18th for
their review and the Mayor's signature.
