Isaacs, City Building Official Larry D. Herman, Mayor John A. Ramsey Minutes of previous meeting approved as mailed. Bills from Eng. /Bldg. Dept. for Administrative Services, Feb., $150; Cumin Assoc. for photo -copy costs $41.50 approved for payment. Letter read appointing Gerald Shay as Member -at- Large until June 30, 1977. RE: PB #78 -1 RAMSEY ANNEXATION REQUEST Annexation has been requested on Lots 12, 13, and 14, Block 6; Lots 2, 7, 8, and 9, Block 9; and Lots 2, 3, 4, 5, and 6, Block 10, Murray Heights, 2nd filing, with a zone designation of R -1. General location of the property is north of Laurel being contiguous to the City of Laurel. Murr S. Isaacs indicated an agreement had been made with the city prior to his employment with the city. Murr has no objections to the annexation as requested. Letter read: "Box 1075, Laurel, Montana, 59044, September 7, 1976, TO: LAUREL CITY COUNCIL MEMBERS "My intentions are to build ten to twelve homes per year and bring that many sites into the city limits at the time construction is begun on the homes. These building sites also will be adjacent and contingent to the city limits -1- n Minutes - Planning Board February 9, 1978 and will not create any islands. "After the signing of my contract with Dave Murray, I would consider bringing the entire subdivision into the city limits and pay city taxes. I would be willing to pay pest control for the area, but I would like some consideration given to the garbage tax, which I understand is three plus dollars per lot. I feel this charge should be waived until such time as the service is being furnished. Very truly yours, /s/ J. A. Ramsey." Discussion of recent garbage law. John MacMartin recommended request be denied as annexations from the Murray Heights area should meet the following criteria: 1) The proposed annexation would annex completely a platted block or group of lots around a cul -de -sac. 2) The proposed annexation would complete the annexation of a platted block or group of lots around a cul -de -sac where a partial annexation previously occurred. Ideally the remaining portion of Murray Heights should be annexed rather than annexing a block at a time. Discussion. Dave Murray has voiced his objections to bringing the entire plat in at this time because of the high taxes. Dave says there would be an additional 65 mills per lot based on the assessed valuation. Less than $2 per lot are being paid right now. County mill is 35.90. It would cost about $3 per lot more for city taxes. John Ramsey stated these lots are all he has deeds for at the present time. Jack Mayes moved to allow the annexation as requested, seconded by Leo Kamp, Jr. Passed unanimously. Recommendation will be forwarded to City Council. Discussion of coal tax monies from the county to be spent on the Transportation Study. The gentleman who was to be here to explain the program could not make it for this meeting due to inclimate weather and airline problems. A special meeting has been tentatively set for next Wednesday evening at 7:00 p.m., February 15th. John MacMartin presented a map outlining land suitability noting prime building sites and indicating the service area of the present plan for the water plant. This map is to help work towards Goals and Objectives of the Board. Discussion of zoning around Highway #10 East, neighborhood commercial should be allowed in residential area, need to allow for schools, sewers, extend Industrial area and consider Mossmain area, airport zoning, etc. Respectfully submitted, Otto s Preiiks as Exec.
