Minutes of previous metting read and approved. Bills
approved for payment: advertising in the Laurel Outlook for
$18.00; administrative services, July, to the'eng. /bldg dept
for $200 contingent upon budget being approved. Letter read
appointing Bus Roberts to the board for 2 years.
PB 78 -6 CHERRY HILL SUB., 2nd filing "an addition to
the City of Laurel"
Alden Pedersen representing Bob Mace states his client
wants a good subdivision - one that the City of Laurel can
live with, etc. Jerry Cormier presented written items to be
addressed concerning this subdivision gegarding basis of
need, effects on agriculture, effects on taxation, effects
on environment, effects on wildlife habitat, and effects on
public health and safety. Question: What is the status of
the interceptor grant applied for from HUD? Ans.: IN limbo
Discussion. Owner wants approval of plat contingent upon
providing the sewer and water. Discussion. Harlan Lund
says it is possible to go to 1/2 acre lots so that septic

tanks would function and the State Board of Health would
approve this plat. It would be possible to divide those
lots later on. Subdivider would rather have this plat
approved as is. Mr. Stepper states he is an adjoining land
owner and is opposed to this subdivision. He is a farmer,
and is worried about kids and dogs running loose. He has
horses that could hurt somebody. Question regarding irri-
gation ditch and what happens to that irrigation ditch?
What happens with the REA power line which is on the south
property line? What provisions are made for run -off which
will be far in excess of present times? All the water
would run off onto his land as there is a 12' strip on the
south boundary continuing the alley platted in the first
filing. At the present time the alley is not being used.
12' is the bare minimum the city can live with. The other
footage would have to come at a later time. The ditch
handles several properties south of the proposed subdiv-
ision How much lowering of the water table is anticipated?
Harlan Lund answered. The water table is rather low and
would be east of Stepper's area. Ditch is in process of
being covered in Casa Linda Sub. There is an open drain
which dumps into the old Italian Ditch. The present storm
sewer can not handle the run -off. 6 people present
opposed to proposed subdivision. Harlan Lund stated the open
ditch is the first filing. Curb and gutter would take
run -off over to first filing. Drainage would be from the
street mostly. More discussion. The development will
reduce the run -off about 25 %. Ed LaPrath questioned the
1/2 acre platting. More discussion of drainage ditches
being tiled, etc. regarding open ditch on first filing.
Dave Frickel questioned 1/2 acre, septic tanks, etc.,
and what that will do to the present wells south of the
proposed subdivision.
John MacMartin stated the plat did not show the con-
tinuation of 17th Ave. or Maryland Lane. 2 alternate pro -
posals were submitted with alleys and without alleys. 17th
will eventually be an arterial according to the Transpor-
tation Plan and Maryland Lane will be a major collector.
A 1' "no access strip" onto 17th Ave. lots will be necessary.
Underground utilities must be placed underground. Waiver
of protest needs to be changed to read "traffic control
devices ", /add water and sanitary sewer lines and waiver
of protest for a future bridge crossing of the Big Ditch on
17th Ave. 112 lots. Plat Review Committee recommends
conditional approval contingent upon these points. Ditch
crossing will be shared by 'orth /south subdivisions by
SID at some future date. Waiver should show up in an abstract.
The ditch will have to be moved and continued with the
approval of ditch owners or users. Drainage is a problem.
The city's system is not adequate. Half acre lots are based
on the premise that city water would be available. City
water will not be available. The park dedication will be
based upon 3 acres at $10,000 per acre as adopted by the
board at its last meeting or about $30,000. Water system
should be 2 mell. gal. per. da. The present water and
sewer plants are in process of updating and are being
designed to handle a greatly expanded population in Ll.
Question regarding grades for pumping water. What about
capacity of reservoir? Capacity is 4 mill gal per da.
and can service 9 - -10 thousand people coupled with 4 mill
gal plant before major expansion will be necessary.
Probably would require 2 separate pressure systems in the
future rather than the 1 we have now. When Langve Sub
went through the board it got conditional approval from the
board. The Council could not approve because it was
platted as "an addition to the city of L1 ", and the city
could not gaurantee water and sewer. County Commissioners
approved the Langve plat. It is now in limbo. Plat
Review Committee recommends approval by the County Commission-
ers on Cherry Hill, 2nd filing, as with Langve Sub.
Discussion of 17th Ave as arterial. Discussion of
drainage. Tom Bradley suggested allocating how much land
to annex each year. Suggested a moratorium until the city has
a definite storm drain and sanitary sewer solution.
Suggested a moratorium on growth until these things are
done. Subdivider would be willing to wait for this study for
a few months. A joint public hearing will be held next month
on the Transportation Plan and also on extending zoning to
within one mile of city limits. This might be a good time to
discuss the drainage. Meeting will be August 10th. Tom
Bradley moved to table this until September 14th and until
council can look at the drainage situation, seconded by Ken
Christian. Carried.
The ditch will be fenced by Mace in 1st filing. More
children drown in little ditches. "Who is liable ?" asked Bob
Graham. Could be considered an attractive nuisance stated
Tom Bradley. The other argument is that the parents know the
ditch is there and the children are not supervised. September
metting would hamper Cormier's EIS duties. John MacMartin
stated he would be in contact with the Council and all involved
to help the developer if they so desired. Tom Bradley suggests
recommending to council regarding drain system.
Bob Graham commented on Casa Linda Sub that 8th Ave
drains 42,000 acres according to a Denver /FHA engineer.
Bob Mace says this acreage takes into account if the Big
Ditch breaks, etc. 12th Ave and Maryland Lane will not be in
trouble in Cherry Hill, 1st filing. FHA is talking about 70
sections of land. More discussion. Cormier states this
subdivision meets a basic need of Ll.
PB #78 -5 RED BRIDGE SUBDIVISION
Jerry Cormier presented items to be addressed concerning
this subdivision such as basis of need, effects on agri-
culture, effects on local services, effects on taxation,
effects on environment, effects on wildlife habitat, effects
on the public health and safety. 1 acre plots with individual
wells and septic tanks are planned. Mr. Reiter wants to sell
his land, use the profit to put back into the rest of his land
to more properly use his land for agricultural purposes.
Ground water should be acceptable on most lots.
John MacMartin reccommends denial based on the follow-
ing items: Basis of need - -the property is located within an
area delineated as reservation for agricultural uses on the
LUE map. Substantial amts of land have been reserved for
residential use to meet the needs of Ll for the next 20
years; thus, this is far in excess of what is needed for
residential expansion. 2) Effects on Agriculture -- the
EIA states that the property is 85 -90% prime agricultural land.
Land that is subdivided and developed in rural areas does
have an adverse effect on the surrounding agricultural uses.
Some of these adverse effect are improper management of
irrigation water, improper management and fencing of irrigation
ditches, uncontrolled running of dogs causing damage to
livestock and many other things which have an adverse effect
on the agricultural productivity of a larger area. John
commented further on effects on local services, effects on
taxation, effects on the natural environment, effects on wild-
life and wildlife habitat, and effects on the public health
and safety.
Discussion of on -site soils. Discussion of LUE. Dis-
cussion of bus service for school children. Discussion of
taxation. Question regarding interior road. Is it a county
road? Yes. SCS says it is prime agricultural land, but .
actual on -site inspection reveals it is sand and gravel most-
ly. No protestors. Discussion of county roads.
Otto Preikszas moved to deny because plat does not agree
with the master plan, seconded by Bus Roberts. Passed with
Shay and LaPrath voting "no", Seaton abstained, and Bradley
excused himself because of a conflict of interest.

Discussion of 1 -mile zoning. Hearing set for August
10th metting. Use quarter lines. John MacMartin will pre-
pare the zoning map to correspond with the LUE. No agri-
cultural zone in the present zoning ordinance.
