Meeting called to order by John Hawley Smith, President,
at 7:07 p.m., with the following members present:

Minutes approved as sent out. Bill from Eng. /Bldg. Dept.
for Administrative Services in the amount of $200 approved for
payment.
JOHN STRICKER, 810 W. Maryland Lane, inquiring about a home
occupation for Minute Man Gourmet Foods. Distribution through
dealers, reference orders only. Two dealers normally come to
the house once a day. Storage of supplies. John MacMartin
recommends "no." How much food will be stored? Ans: Four (4)
26 cu. ft. freezers which are now at a warehouse in Billings.
Discussion.
Motion from Ken Christian to deny this home occupation,
second from Ed LaPrath. Carried.

Procedure for public hearings read aloud.
SHERROW PARK SUBDIVISION file #79 -8: Motion from Ken Christian
to conditionally approve as per Plat Review Committee recommenda-
tions, second from Ed LaPrath, to include:
1) The water line in Ridge Drive should be a 12" line
2) The fire hydrants placed as requested by the Fire Chief
3) As requested, 6 -inch water lines will be allowed in
the cul -de -sacs
4) The water lines be located in the streets as per the
request of Public Works Director
5) Change Alberta to Idaho and all the use of "Drive"
to "Street" where noted
6) A determination of the need for vacation of right of
way along the northern property line
7) Work with the Public Works Director to determine the
exact sewer connection
8) The garbage cans taken out of the cul -de -sacs
9) Stop signs on the local streets where they intersect
the collector
10) Explore the creation of a maintenance district for storm
sewer and create, if possible
11) Grading of Nutting Drain through the site
NOTE: The conditional approval should be for an overall design
on the entire tract, a preliminary plat on the entire
tract, the annexation of phase I, and the zoning change
on Phase I.
Jim Straw led discussion regarding rollback taxes. Sub-
division is presently used for a poor hay crop (about 24 acres).
Present zoning is RE 20,000. Copy of County Attorney's directive
presented to the Board, which reads as follows:

Gentlemen:
Because of the current problem with rollback taxes (Section 15 -7 -201,
et seq., M.C.A.), my office recommends the Commissioners adopt the
following policy:
1) Upon preliminary plat approval, the assessors office be
notified so they can compute the rollback tax and record
it as a tax lien against the property.
2) That the developer be required to pay the rollback tax
before final approval of a subdivision plat and that the
status of the rollback tax lien be placed of record on
the plat document.
3) That when each Certificate of Survey is filed, the
Clerk and Recorder notify the assessor who will compute
the rollback tax and record it as a tax lien against
the property."

"4) If the subdivider does not believe the rollback tax
is applicable to all or a portion of the property, he
can challenge the assessor's determination through
existing tax procedures.

John Eisen representing Sherrow Park Assoc. states this
subdivision is about 50 acres in size, proposes single family
dwellings, 162 lots, 7500 sq. ft. minimum to be developed in
three phases: Phase I on west, Phase II on the south, and
Phase III on the north. Subdivision fits basis of need as com-
prehensive studies have indicated, no public adverse opinions,
no adverse effects on agriculture, local services are available,
taxes would increase approximately $22,420 with residential
development (present rate is about $140 per lot), traffic would
be normal for a residential subdivision of this size, would be
annexed to the city, holding ponds for run off, would not affect
wildlife, 6 acres park dedication, city fire and police would
service the area. They are asking for acceptance of the over
all design plan, Phase I of 34 lots to be zoned R 7500, annexation
request, and preliminary plat approval on entire subdivision
(Phase II with 86 lots, and Phase III with 42 lots). Discussion.
David Sprague questioned regarding subdivision location
and single family dwellings. Geraldine Stevick questioned taxes
being raised when 12th Street is continued through their front
yard. No assurances can be given. Discussion.
John MacMartin recommends adding to Plat Review conditions:
12) Rollback taxes to be addressed and
13) Subdivision Improvements Agreement to be revised.
He recommends Phase I be approved for annexation as R7500 and
recommends leaving zoning of rest of phases at RE 20,000 until
a later date. Sidewalks will be installed when the sites are
developed.
Discussion of length of streets in Phase II being 3 blocks
long. Leon Howe explained this is the short side of the block,
not the long side. Traffic impact study explained. Should have
no congestion at intersections. Alder Avenue and Maryland Lane
will be the major collectors of traffic. 12th Avenue will be
a minor collector when completed. Discussion Add:
14) Ditches should be covered or possibly left open
Additional discussion of rollback tax situation.
Motion to amend original motion to include 3 additional
conditions from Ken Christian, seconded by Ed LaPrath. Both motions
carried.

EAST LAUREL TRAILER COURT file #79 - Hearing on this file
postponed from September 13, 1979, at the request of the developer.
Plat Review Committee recommends conditional approval subject to
annexation to the City of Laurel as well as compliance with the
following:
1) The delineation of the single wide vs double wide lots
2) A central parking /storage area
3) An office or marquee area delineated
4) Additional right of way, no access strip, and landscaping
along Yard Office Road
5) A park which meets either the zoning or subdivision
regulations
6) A redesign of the intersection along Santa Fe Drive
7) A right of way dedication along the eastern property
edge (Ronan Road)
8) Draft of rules for the court
9) A delineation of possible phases
10) The plat put into proper form
11) An adequate handling of the storm drainage
Staff recommends denial based on the County subdivision concept.
Discussion.
Gary Waddell wants to know if Laurel needs that many trailer
spaces and objects to same. Flooding is a problem. Curtis Mc-
Kenzie verified that flooding is a problem, storm sewer being
installed will not help the situation, other problems are in-
volved. Rick Collins questioned dividing line at 1 -mile inter-
section. Would be a private road and probably would not be a
dedicated road. Zoning is extended only one mile outside present
city limits (about half of the proposed subdivision is involved).
Doug Miller complained about overloading classrooms at Graff
School. Objects to possible flooding. Gary Waddell wants to
know if Board ever went out to walk across the acreage. Test holes
show water 6 inches from the surface. Rick Collins objects to
flooding, etc. What about the maintenance in the subdivision?
Bill Towler objects to overloading school system and taxes.
Discussion of taxes. Gary Waddell wonders about the number of
trailer courts needed in Laurel. County says there is a shortage
of trailer spaces. Post Office says 1/2 of 1% vacancy in mobile
home sites in county. Discussion.
Motion from Ken Christian to conditionally approve as per
Plat Review Committee recommendations adding:
12) Include rollback tax review
seconded by Ed LaPrath. Carried.
PUBLIC HEARING, CHANGE CHAPTER 17.64 OF ZONING ORDINANCE: Motion
from Ken Christian to recommend acceptance of revised ordinance
as discussed, seconded by Gerald Shay. No objections submitted.
Carried. Council to hold public hearing on December 4th after
newspaper publications.
