Board has been scheduled for Thursday, June 9, 1988
at 7:00 P.M. at the Laurel City Hall, 115 W. First Street
in the Council Chambers.

Meeting was called to order at 7:09 p.m., by John Hawley 1
Smith, President, with the following members present:

Joe Keener, Home Occ. applicant- ULTRAFIT
Albert Dean Nepstad, Home Occ. applicant- 520 1st Ave.
Home Occupations
Joe Keener, of 511 Cottonwood, has applied for a Home Occupation.
Joe does computerized testing to check for fat content, through
ultrasound. He plans to do all his testing at various businesses
and there will be no testing done at his home.
Motion by Cal Cumin to approve with the stipulation that there
be no home testing, and no extra traffic, seconded. by Donna
Kilpatrick. Motion was carried unanimously.
Dean Albert Nepstad, 502 1st Ave., has applied for a Home Occupation.
Dean plans to operate a hot dog cart throughout the City and the
City Parks, and wants to keep his cart at his home. He plans tc
sell between 11:00 a.m. and 7:00 p.m.
Discussion on the American Legion having specific selling rights
in the parks to finance the baseball teams. Mr. Nepstad agrees
to stay away from the ball park during the time that the American
Legion concession stand is open.
Motion by Joe Bradley to approve the Home Occ. providing that
Mr. Nepstad first acquire the proper health permits, and no food
sales to be done at his home, seconded by Don Gudgell. Motion
carried unanimously.

Minutes were approved, for the April 14, 1988 meeting.
Bills for May and June Administrative services for $ 400.00 were
presented, along with a bill for $ 3,375.00 for Cumins Associates
services.
Motion by Don Gudqell to approve payment of the bills, seconded
by Donna Kilpatrick. Motion carried unanimously.
Discussion on population projections for Laurel, done by the
Cumin Associates.
Discussion on house in the 900 block of 8th Avenue that has
semi's in the yard.
Discussion on Rudy Groshelle's trailer court starting up by the
Laurel Creamery's hold - station. Cal will investigate.
Discussion on a Mr. Hoppel who lives in the 800 block of 7th
Avenue. He has quite a few cars in front of his house, and
is possibly running an engine pulling business.
Discussion on any application's for the vacant County Rep. seat
on the Board. No application's have been received.
Motion by Don Gudgell to adjourn the meeting, seconded by
Grace Edwards. Motion carried.
Meeting was adjourned at 8:00 p.m.

a letter of resignation from the City County Planning Board. We
realize that your job has prevented you from attending the
meetings, and if it is unlikely that the situation will change
by next month, the Commissioners would like an opportunity to
appoint someone else to the position. If you would simply write
a note addressed to the Yellowstone County Commissioners stating
that you reluctantly resign as County Representative on the
n Laurel City County Planning Board, I will deliver it to the
Commissioners.

thus, the use of a portion of a structure as a home occupation will not r1
permit a subsequent owner an automatic home occupation designation.
Procedure
1. Complete home occupation request form and submit it to the
City seven (7) working days prior to a regularly scheduled
meeting of the Planning Board.
• 2. The Planning Board will consider the request at their regu-
larly scheduled meeting. Attendance at this meeting is
required by the applicant or his /her representative. -
3. The Planning Board will make a recommendation to the City
Council that the specific request for a home occupation
designation be granted or denied.
4. The City Council will consider the Planning Board's recom-
mendation concerning the specific home occupation designation
and approve or deny it at their next regularly scheduled
meeting. Attendance by the applicant or his /her represent-
ative is required at this meeting.

WHEREAS, an Application for Home Occupation was filed
with the City by Joe Keener on the 19th day
of May , 198 8 , and a copy of the Application

is attached hereto:
WHEREAS, the matter having come before the Laurel City- County
Planning Board for recommendation;
WHEREAS, the Planning Board, after full consideration of the
Application at its regular meeting of June 9, 1988 , it was
moved by Cal Cumin , seconded by Donna Kilpatrick that
the Planning Board recommend to the City Council that the
Application be granted /INIdX M, and the said motion was passed/
defeated by a vote of 7 in favor and 0 opposed
(MCA Section 76 -1 -304) requiring the concurrence of at least
six Board members to take any official action.)
Therefore, the Laurel City Council is hereby informed that
the Planning Board recommends that the Application for Home
Occupation by Joe Kenner be:
K Granted, subject to the following special conditions:
no customer's coming to the home, if in the future
customer's come to the home then another application
must be made and reviewed before the committee.
Denied.
