Dear Mrs. Namen:
Regarding the use of approximately four acres of land located at
904 South Yellowstone just south of the City Limits of Laurel: This
property is presently zoned Residential Mobile Home (RMH) under
zoning which is administered by the City of Laurel (for an area up
to one mile outside of the City). This zone does not allow a commer-
cial kennel. (I have attached the definitions of kennels from the
Zoning Ordinance for your information.)
An option which is open to you is to request a zone change from
RMH to Agricultural -Open Space (AO) which does allow commercial
kennels. I do not know how successful you would be in obtaining
this zone because the neighbors could protest your request. All
of the neighbors within 300 feet would be notified by mail (as
well as a Notice of Public Hearing regarding your requested zone
change being advertised in the Laurel newspaper); protestors could
speak at the public hearing as well as before the City Council.
If 20 percent of the property owners on any side of the property
protested your request, it would take three - fourths of all the
members of the City Council to approve it. Consequently, I do feel
the big thing is the neighbors in the area; if they don't object,
I wouldn't think the City would.
As to whether you could keep animals on your four acres if you end
up acquiring the property but do not get a zone change to A0: The
Zoning Ordinance does not provide for keeping farm animals in any
residential zones. However, if farm animals have traditionally been
kept on a property, they can continue to be kept if such keeping has
been continuous since before the adoption of the current Zoning Ordi-
nance.
