LAUREL CITY - COUNTY PLANNING BOARD
March 6, 2014 6:00 pm

CALL TO ORDER: Chairman Kathy Siegrist called the meeting to order at 6:00 pm.
ROLL CALL: A roll call was taken. Members present were Koch, Fritzler, Goldsby, Richardson,
McDermott, VanAken, Nelson and Siegrist.
PUBLIC COMMENT:
Citizens may address the Board regarding any item of City business not on the agenda. The duration for
an individual speaking under Public Input is limited to three minutes. While all comments are welcome,
the Board will not take action on any item not on the agenda.
No one from the public spoke.
APPROVAL OF MINUTES FROM PREVIOUS MEETING: A motion was made by Judy Goldsby and
seconded by Dan Koch to approve the minutes of the February 6, 2014 meeting. The motion was passed
by a vote of 6 — 0. (Klein arrived after vote)
NEW BUSINESS:
There was no new business to come before the board.
Old Business: Fence Heights
At the February 6, 2014 Planning Board meeting, after conducting a public hearing, the board sent their
recommendations for changes to the L.M.C. 17.48.050 to the City Council. After the Council reviewed
the proposed changes they asked the Planning Board to revisit some of the language that they feel is
confusing. Monica relayed those proposed changes to Building Official Gary Colley and he made the
requested changes to the ordinance.

Monica passed out the draft with the City Council's recommendations (see attached).
A motion was made by Judy Goldsby to recommend approval of L.M.C. 17.48.050 with changes as
suggested by the Laurel City Council. The motion was seconded by Dan Koch.
Discussion.
There was no discussion. A vote was taken on the motion to approve and was passed by a vote of 7 -0.
Discussion series: Overlay Districts
Monica spoke regarding Overlay Districts.
Overlay Districts are defined as a regulatory tool that creates a special zoning district, placed over an
existing base zone(s), which identifies special provisions in addition to those in the underlying base zone.
The overlay district can share common boundaries with base zones or take on new boundaries.
Regulations are attached to the overlay district to protect a specific resource or guide development
within a specific area.
Potential Uses:
• Preserve /enhance a special district
• Encourage economic development
• Preserve character
• Protect quality of surface water or ground water
• Preserve sensitive areas
• Protect aesthetics
Common Uses
Development Guidance:
Overlay zones may be applied to protect historical areas or encourage or discourage specific types of
development. Land within the overlay district may be subject to a specific set of requirements that
protects the aesthetics of the area (e.g. materials, fagade design, or color.) Furthermore, a community
might use overlay zones to encourage target uses or control appearance (City of Laurel Entryway
Zoning.)
Creating Overlay Districts
1. Define the purpose of the district
2. Identify the boundaries of the district
3. Develop specific rules that apply to the identified district
4. Adoption is the same procedure as other zoning ordinances

Implementation
1. Planning and Building Department (Permits and Plan Review)
Monica stated that overlay districts can be used to protect a town's aesthetics such as they have done in
Colonial Virginia.
The overlay district can benefit a municipality by enhancing its character without being too restrictive.
Laurel has an overlay district in place called "Community Entryway Zoning District ". The purpose of the
Community Entryway Zoning District is to regulate outdoor advertising, outdoor advertising signs, and
outdoor signs of all types, to provide fair and comprehensive regulations that will foster a good visual
environment for Laurel, enhancing the area in which Laurel citizens live, and creating an aesthetic and
enjoyable appearance for all Laurel residents and visitors.
Monica stated that overlay districts are generally brought forward by city staff or concerned citizens that
contact city staff.
Miscellaneous
Monica stated there is no inter -local agreement between Yellowstone County and the City of Laurel for
her work done outside of the city limits. She is working with the City Attorney on an agreement.
New by -laws also need to be written. Monica will bring a draft of both the Inter -local agreement and
the proposed by -laws to the board on April 3, 2014 for discussion.
There will be a meeting on April 3, 2014.
Monica invited all interested board members to attend a Long Range Transportation Plan meeting to be
held on Monday, March 10, 2014 at 6:00 pm in the Laurel Council Chambers.
The meeting was adjourned at 6:45 pm.

Delete entire Section 17.48.050
Insert Section 17.48.050 as follows:
17.48.50 Fences, walls and hedges.
A. Fences, walls and hedges may be erected or maintained in any zoning district
provided the height, setback , and material provisions outlined below are followed
and a permit is secured as per Laurel Municipal Code Chapter 15.20. "Fence" for
the purposes of this section means any fence, wall or hedge. No fence shall be
erected or maintained in the public right -of -way, closer than one (1) foot from a
sidewalk : • - . - - - - - -• • • - -. Fences shall be constructed on
private property.
B. Height. Height for the purposes of this section shall be defined as the vertical
distance from the top rail, board or wire to the ground directly below.
C. Setbacks required. Fences, walls and hedges of up to four (4) feet may be erected
or maintained in the required front yard and side yard adjacent to street setback as
dcfincd in LMC scctions 17.16.020 and '�, 0 . Fences, walls and hedges up to
six (6) feet may be erected or maintained in rear yard and side yard not adjacent to
street, except as noted in section D. •. - • -, - _ - - •
LMC scctions 17.16.020 and 17.20.020. None of the above setback requirements
shall apply to lands located in AG, CBD, CC, HC, LI, and HI zones.
D. Side yard adjacent to street fences. If the property abuts an alley the rear yard side
yard adjacent to the street fence may be erected and maintained up to six feet (6)
from the rear of the dwelling to the alley as well as along the alley. Clear vision at
alley shall apply.
E. Setbacks for clear vision areas. No fence, wall or hedge greater than thirty (30)
inches may be erected or maintained in any zoning district within a clear vision
zone as defined by City of Laurel Resolution No. R03 -63. Fences of chain link,
woven wire or other similar type fence which provide no more than ten (10) percent
obstruction to visibility through the fence when constructed can extend to four (4)
feet in height may be constructed in this area.
F. Material permitted. All fences in residential, agricultural and commercial zoning
districts shall be constructed from materials which are commonly used for fencing. ( pp
Commonly used fence materials include wood, brick, stone, split railing, wire, •

vinyl, and ornamental iron work. In HI and LI zones fences may be constructed of
finished or coated steel or aluminum building panels. Fences shall not be
constructed from railroad ties, wooden pallets, tires, rubble or salvaged material.
Materials not listed are subject to special review by the city planning group.
G. Material exception - Barbed wire and electric fence. In the city limits no barbed
wire or electrical fencing shall be permitted in residential zoning Barbed
wire and electrical fencing shall be allowed in AG and RT zoning districts.
Electrically charged fencing along any public way shall be posted with warning
signs or fluorescent marking at intervals not to exceed one hundred fifty (150) feet.
H. Security fences. In AG, CBD, CC, HC, LI, and HI zones security fences may
maintain a barbed wire fence on top of a non - barbed wire fence as long as the
lowest strand of barbed wire is eight (8) feet above grade.
I. Miscellaneous exceptions. These provisions shall not apply to fences required to
surround and enclose existing junk yards and public utility installations or to
enclose school ground and public playgrounds.
J. Penalties. Any person violating a provision of this chapter may, upon conviction
thereof, be punished as set forth in Section 1.36.010 of this code.
