Approve minutes of previous meeting 3. Activity Report Minutes of the Yellowstone County Air Pollution Control meeting held October 9, 2001 at the Yellowstone County Air Pollution Control Office. Members Present: Mr. L.D. Collins, Ms. Michelle Reed, Mr. Nick Shyne, Mr. Bill Shikany, and Dr. Mark Waddington, and Mr. Rich Schilf. Others Present: Mr. Russell Boschee, Mr. Bob Martin, Department of Environmental Quality Administrative Rules representative, Mr. Gray Harris, Yellowstone Valley Citizen's Council representative, Ms. Leona Waldhausen, Northern Plains Resource Council representative, Ms. Sandy Weiss, a concerned citizen. Vice Chairman Mark Waddington called the meeting to order at 7:35 P.M. Mr. Shyne moved to accept the minutes of the August 14`h meeting as written. Ms. Reed seconded, and the motion passed. In the first order of business, a public hearing was held concerning the proposed revisions to our agency's regulations as stated in the public notice. Mr. Bob Martin, DEQ representative, worked closely with Mr. Steve Duganz, YCAPC Director, concerning these revisions. He reviewed these changes for the Board and public present. First, he said that the Odor Regulation (Regulation 001) has been suggested for removal from the regulations. He noted few states have odor regulations, and public nuisance complaints are very difficult to enforce. Next, he said that the Emergency Episode Plan has been suggested for removal. He noted that the YCAPC has no jurisdiction over the seven major sources, so it cannot legally curtail any activity. Also, the YCAPC does not have a resident meteorologist on staff as required by the regulation to do meteorological surveillance during an episode. Therefore, the YCAPC Emergency Episode Plan is less, stringent which is not allowable under H13605. He noted that the DEQ has a regional office in Billings, which would be in charge of any emergency episode. Mr. Martin completed his presentation and answered many questions from the Board. Chainnan L.D. Collins opened the public hearing for any comments from the public. Mr. Gray Harris, YVCC representative, said his organization opposes any reduction in the regulations especially concerning the Odor Regulation. He said the YCAPC needs all the teeth in its regulation it can get to combat pollution. He said odors are usually on indication of greater problems; he said it is better to have YCAPC representatives investigate odors complains than average citizens because the offenders listen better to government officials. Ms. Leona Waldhausen, NPRC representative, echoed the same concerns saying her organization opposes any reduction in regulations, which help control air pollution in Yellowstone County. After the public comments were completed, Mr. Shyne moved to remove the Odor Regulation (Regulation 001) from the Yellowstone County Air Pollution Control Regulations. Dr. Mark Waddington seconded, and the motion was opened for discussion. After much discussion by the Board, Chairman L.D. Collins asked Dr. Waddington to remove his second. Dr. Waddington removed his second, and the matter was tabled until the next meeting. I? ?n FPn 1ov L CIi?-_URL Concerning the emergency episode plan, no public comments were made. The Board discussed the proposed change to the regulations and decided to table the matter until the next meeting. Chairman L. D. Collins closed the public hearing and thanked everyone for their participation. Concerning September's Industrial Compliance, Mr. Boschee noted Mr. Duganz inspected Rocky Mountain Concrete Products saying there were several improvements to the operation. He noted that they now received an operating permit from the DEQ. Mr. Boschee noted Mr. Duganz inspected Fox Distributing in Laurel saying our agency has received complaints concerning their sawdust piles. He noted they would be installing storage bin to alleviate the problem. Regarding September's Administration, Mr. Boschee said Mr. Duganz said the web site for ambient data is now operational, and he listed the web address in the report. He noted the EMPACT project is now complete. Mr. Shikany wanted to know when the news conference concerning the EMPACT project would be held. Mr. Boschee said he would refer the matter to Mr. Duganz. Concerning September's Air Quality, Mr. Boschee said our agency is still issuing burning permits this late in the season. Chairman L.D. Collins adjourned the meeting at 9:15 P.M. INDUSTRIAL COMPLIANCE A. Therc were no inspections of industrial sources during October. 11. ADMINISTRATION A. With 3311/% of the fiscal year over, we have expended approximately 29% of our budgeted funds. We have received the first quarter's reimbursement from the State. B. Discussion and action should be taken at this Board meeting regarding our proposed regulation changes. We have received no further comments since the public hearing in October. C. We have had three wood stove complaints this Fall compared to none last year. Information was sent to two individuals regarding the proper method of burning wood. D. The EMPACT web site received 741 hits during October. Now that the site seems to be operating properly, a news release will be issued soon. A short article on the project appeared in Governing magazine, a copy of which is enclosed. 111. MEETINGS A. Mr. Boschec and Mr. Duganz attended the semi-annual Visible Emissions School in Helena. B. Mr. Duganz attended a meeting to discuss procedures on handling mail to avoid the possible spread of antluax. n V E U')D CITY OF LAUREL s 1V. AIR QUALITY A. During the month of October, 34 open burning permits were issued. B. The Mount Olive site near 24°r St. West and Central came on line in October. Both sulfur dioxide and carbon monoxide are being monitored. We are currently looking into the cost of adding the site to the web page. C.
