HomeMy WebLinkAboutCity Council Minutes 11.20.1979Minutes of the City Council of Laurel November 20, 1979 A regular meeting of the City Council of the City of Laure~ Montana~ was held in the Council Chambers and called to order by Mayor Larry D. Herman, at 7:00 p.m., on Tuesday, November 20~ 1979. COUNCIL MEMBERS PRESENT: Albert Ehrlick Bill Brennan Harold Burns Susan Carter Duane Behm Terry Fink Er¥in Metzger COUNCIL MEMBERS ABSENT: Donald Meyers INVOCATION: Invocation given by Reverend Wilhelm. MINUTES: Minutes of the regular meeting of November 6, 1979, approved as presented. PRELIMINARY PLAT OF SHERROW PARK SUBDIVISION: This being the time for a public hearing on Sherrow Park Subdivision, John MacMartin was asked to give the recom- mendation of the Planning Board. MacMartin stated that the Planning Board and Department Heads recommend conditional approval o£:the preliminary plat subject to the following 14 items: 1 The water line in Ridge Drive should be a 12" line 2 The fire hydrants placed as requested by the Fire Chief 3As requested, 6-inch water lines will be allowed in the cul-de-sacs 4The water lines be located in the streets as per the request of Public Works Director 5Change Alberta to Idaho and all the use of "Drive" to "Street" where noted 6A determination of the need for vacation of right of way along the northern property line 7Work with the Public Works Director to determine the exact sewer connection 8The garbage cans taken out of the cul-de-sacs 9Stop signs on the local streets where they intersect the collector 10 Explore the creation of a maintenance district for storm sewer and create, if possible 11 Grading o£ Nutting Drain through the site 12 Rollback taxes to be addressed 13 Subdivision Improvements Agreement to be revised 14 Ditches should be covered or possibly left open NOTE: The condiffonal approval should b~ for an overall design on the entire tract, a preliminary plat on the entire tract, the annexation of Phase I, and the zoning change on Phase I. Much discussion regarding the Nutting Drain. This matter held over until the next council meeting foPS'further study. The Department Heads to make a meeting available with the developers. LAUREL EAST TRAILER COURT: Planning Board recommends conditional approval of the preliminary plat subject to the following 13 items: 1) Subject to annexation to the city 2) The delineation of the single wide vs double wide lots 3) A central parking/storage area page 2 Minutes of the City Council of Laurel 4) An office or marquee area delineated 5) Additional right of way, no access strip, and landscaping along Yard Office Road 6) A park which meets either the zoning or subdivision regulations 7) A redesign of the intersection along Santa Fe Drive A right of way dedication along the eastern property edge (Ronan Road) 9) Draft of rules for the court 10) A delineation of possible phases 11) The plat put into proper form 12) An adequate handling of the storm drainage Include roilback tax review RESOLUTION NO. 1767 A RESOLUTION APPROVING LAUREL EAST TRAILER COURT AS AN ADDITION TO THE CITY OF LAUREL, MONTANA. Motion by Alderman Ehrliek that Resolution No. 1767 be passed and adopted and that the preliminary plat of Laurel East Trailer Court is conditionally approved as set forth in the recommendation of the Planning Board, seconded by Alderman Fink. Motion carried. DEFERRED COMPENSATION PLAN: Security Federal Savings & Loan met today with several of the city employees. Some employees have indicated that they would like to start putting their money in the Deferred Compensation Plan. This would not cost the city anything but before this could be implemented the city would have to pass a resolution approving an agreement between the City of Laurel and Security Federal Savings & Loan setting up this Deffered Compensation Plan. RESOLUTION NO. 1768 A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF LAUREL AND SECURITY FEDERAL SAVINGS & LOAN ASSOC., SAID AGREEMENT RELATING TO DEFERRED COMPENSATION. Motion by Alderman Fink that Resolution No. 1768 be passed and adopted, seconded by Alderman Ehrlick. Motion carried. CITY ENGINEER'S REPORT: Mayor read the Progress Report from the City Engineer. The 7th Street Sanitary Sewer project requires a $600.00 change order for a sanitary sewer hookup for the Merchant Apartments. With no objections from the Council the Mayor approved the $600.00 change order. Permission granted for Alderman Metzger to leave the state. DAVE JOHNSON: Mr. Johnson stated that he would like to register a complaint against the Sweeping District. The Mayor stated that a public hearing was held Aprii 17, 1979, and the Councii acted on it. The only thing he can do at this time is pay his taxes under protest. He is objecting to being taxed for his property on 5th Avenue. The Mayor suggested a petition to withdraw his property on 5th Avenue from the district for next year's assessment. Mr. Johnson stated that a couple of years ago he deeded almost 30 feet to the city for street purposes. City Engineer to cheek into this and if Mr. Johnson was charged for this 30 feet it should be adjusted. page3 Minutes of the City Council of Laurel DUANE BEHM - GARBAGE COMMITTEE: Committee has reviewed the rates from Garbage I and Garbage II, and there is the need for a major change in the rates. The garbage charge will be taken off the tax roll and put on with the water and sewer bills. Proposed rate: Residential rate $4.25 mo. or $51.00 yr. for twice a week pickup. Commercial District -- container charge of $204.00 for twice a week pickup or $612.00 for 6 day a week pickup. After discussion, it was decided to hold a preliminary hearing at the December 4th council meeting and a final hearing at the December 18th council meeting. Notice to be published in the Laurel Outlook.
