August 7, 1979
A regular meeting of the City Council of the City of Laurel, Montana, was
held in the Council Chambers and called to order by Mayor, Larry D. Herman, II
at 7:00 p.m., on August 7, 1978. ~ I

MINUTES: Minutes of the regular meeting of July 17th approved as presented.
Minutes of the special meeting of July 25th approved as presented.
CORRESPONDENCE: Letter from HKM stating there were three more items which need I
to be taken care of before EPA will release funds for Step III sewer rehabili-
tation: 1) The City must pass a resolution indicating that they
will enact the proposed sewer users rate, primarily
as to format, that was approved by the City Council
in June..
2) Correct a typing error.
3) Send EPA a copy of the proposed rate schedule for sewage users.
RESOLUTION N0. 1760 ~
A RESOLUTION STATING THAT TO REMAIN IN COMPLIANCE
WITH EPA REQUIREMENTS THE CITY WILL ENACT AN ACCEPT-
ABLE SEWAGE USERS CHARGE PRIOR TO THE COMPLETED CONSTRUCTZON OF THE NEW UPGRADED CITY SEWAGE TREAT-
MENT PLANT.

Letter from HKM regarding water rate study referred to Public Utilities Ili
Committee for recommendation.
Letter from Governor Judge expressing his gratitude of our support of the I,
National Guard. j
Mayor informed the Council of preapplication for FHA assistance in utility I
systems mapping and planning in the amount of $200,000.00.
~ Also a preapplication to FHA for land purchase for sewer plant in the
amount of $26,250.00.

PUBLIC HEARING MC LELLAND PROPERTY, B & R DEVELOPMENT CO., ZONE CHANGE, ANNEXATION, AND SPECIAL REVIEW: This being the time and place advertised,
a public hearing was held.-
Petitions in protest were accepted and entered into the record.
Bruce Peterson, President of B & R Development Co., gave a presentation
of the proposed development, outlining the reasons for the design, planning and marketing of the subdivision.
According to his figures it would not be economically feasible to build
single family dwellings, and therefore has proposed "row housing," making it a higher density area (75 single family dwellings vs 124 row houses).
People in attendance, who were opposed to this development for various
reasons were:

Motion made by Alderman Metzger to accept the recommendation of the
Planning Board, to deny the zone change, annexation and special review,
seconded by Alderman Brennan. Carried with Alder~aoman Carter voting "no." i
Meeting adjourned for a 15-minute recess.

OR AUTOMOBILES ON ANY PREMISES WITHIN THE CITY LIMITS.
Motion by Alderman Fink that Qrdinance No. 667 be passed and adopted,.
seconded by Alderman Behm. Upon taking a roll call vote all aldermen
present voted "yes" except Aldermen Brennan and Ehrlick who voted "no."
Motion carried 4--2.

The bid was referred to department heads for review and to bring back
a recommendation for the August lath meeting.
BIDS WATER LINE REPLACEMENT: The bids were opened on July 17th and
taken under advisement.
Motion by Alderman Ehrlick to accept the low bid of $77,734.15 from
Adams Brothers and to give the Mayor authority to sign the contract, seconded
by Alderman Metzger. Carried.
MAYOR'S COMMENTS: Reminded the Council of the meetings in August.
Mentioned the 2¢ per gallon county-wide gas tax that was discussed at the July 30th Billings City Council meeting,
KEN BEVEN: Reported an water plant modification and water line costs~ant~"funding.
There being no further business to come before the council at this time,
the meeting was adjourned at 8:55 p

annexation, and special review on the E4, SE2f NEI of Sec. 9,
T2S, R24E, Yellowstone County, Laurel, Montana, from RE-20,000
zone to allow RLMF multi-family zone.
At a meeting of the Laurel-Yellowstone City-County Planning
Board held on July 12, 1979, after public notice and a public
hearing having been held, the Board recommends to the Laurel
City Council that the petition for a zone designation of RLMF
in the above matter be denied. The Board recommends to the
Laurel City Council that the petition for annexation in the
above matter be denied. The Board recommends to the Laurel
City Council that the petition for special review in the above
matter be denied.

RE: B&R "Townhouses" & zone change
My husband and I feel we must express our concerns involving
the zone change proposed on the 20 acre tract (formerly the
McLelland Property) for the development of "townhouses.' We have
many concerns that make my husband, myself, and our neigh-
bors against this project.
We are opposed to the density of population proposed in this
development. The fl1w of traffic on Washington is going to
be greatly increased. Because of the layout of this develop-
ment, with Eighth Street being the only through street, most
of the residences of this development, emergency ve4cles, service
crews, and visitors will probably use the Eighth and Wash-
ington exit. This will involve a lot of traffic going right
in front of our homes. One of the reasons we bought our home
in this area is because of the low traffic flow currently on
this street.
We are also concerned about the impact on the Fred Graff school
that will be caused by the dense population proposed for this
development. These "homes" will be in the agfordable range
for the young family just starting out, with children. Such
an immediate gain in the school population is going to require
immediate growth of our school.
In this dense of a population, 7:ave they taken into account the
number of dogs in the development? With fences not being re-
quired, we'll have to hire another dog catcher for this

development alone.
We are also concerned that this development will not only
depreciate the value of our homes, but the entire area.
Our homes are in an established area with trees and yards,
all well cared for. All our homes are built on double lots,
with fenced yards, close to schools and within walking dis-
tance of the downtown area. As it is, it sounds like an ideal
real estate ad; now add, across the street from 20 acres of
strip houses.
Will this development become a "ghetto" as others of' ]i_ts
type have in other areas? How will this project look
years? The developer has spoken of a "probable" internal
citizen's group to be formed in this area. We have no writ-
ten guarantee that this will become a reality and enforced
in the future.
I t was mentioned that this area is not feasible for single
family dwellings because of the cost of S.I.D.'s. Must we
settle for 2nd best or worse? We feel there isn't a need for
this type of development in Laurel. Billings has a lot of
things Laurel would not want to imitate and we should learn
from their mistakes. A little trim and siding does not make
this project that much different from Billings' mistake on
Jackson Street. If the developer cannot sell all these
"townhouses", what is to stop him from simply renting them out?
This has happened in Missoula.
Lastly, I do want to mention the drainage problem in this
area. Although, it is tempting to build this development
just to see if the cities holding pond idea will work, I
don't feel this is an adequate reason for giving this devel-
opment the go ahead. This field has been a natural holding
pond for water that would otherwise have gone into our cellars.
We are concerned, not only for our own homes, but for the
prospective buyers. Will they be given the figures from this
year's watertable (a particularly dry year), or from the
previous year when there was several inches of surface water
in that field. Although we do not havd funds to hire several
engineers, I do believe what I have seen with my own eyes.
Although we are not against seeing Laurel expand, we want
to see it do so in a reasonable and beneficial way. We do
not want, or need,strip houses on this piece of property
and must protest thid zone change. We urge the members of the
City Council to defeat this zone change. We may sound
emotional and unprofessional, but we love our homes. Although
the City Council makes the final decision, in the end we have
to lave across the street from it.
