I, Herman, at 7:20 p.m., on July 17, 1979. COUNCIL MEMBERS PRESENT: Albert Ehrlick Bill Brennan Y Harold Burns Terry Fink Duane Behm Donald Meyers I i COUNCIL MEMBERS ABSENT: Susan Carter Ervin Metzger INVOCATION: Invocation given by Alderman Meyers. MINUTES: Minutes of the July 3rd regular meeting approved as presented. BIDS WATER LINE REPLACEMENT: Bids were to be opened at S:OO p.m. but due I~ to the lack of a quorum .the opening was continued until the 7:00 p.m. meeting. ' I~ Bids were opened and read aloud as follows: Jimts Excavating $137,088.00 II, Adams Brothers 77,734.15 ' Merckol Construction 126,396.00 The bids were taken under advisement. ' CORRESPONDENCE: Thank you cards received from Dick Metzger and Ollie Mae Gass were read. ~ I Letter from Mayor Fox of Billings reminding the council of a meeting in the Billings City Council Chambers on Monday, July 30, lg7g, at 7:00 p.m., ' regarding a 2¢ county-wide local option gas tax. Letter from_Reverend Al Carlock.of Calvary Baptist Church requesting i permission to have a patriotic musical program on Saturday night, August 4th, and Sunday afternoon, August 5th, at Thompson Park. Permission was granted by the Council. ' ~ Liquor license was approved for Moose Lodge ~~1g21. DON MEYERS JAYCEE'S CIRCUS: Requested that the Jaycees be ~.llowed to sponsor a children's circus at Thompson Park on August lgth at 3:00 p.m. 'i and 5:00 p.m. j Motion by Alderman Behm to allow the Jaycees to have a circus at Thompson Park, seconded by Alderman Ehrlick. Carried. I, BURLINGTON NORTHERN: The council gave the mayor authority to sign the Burlington Northern agreement. SID 102 PROTEST HEARING: .This being the time and place indicated in the publi- ''i cation of June lg, 1g79, a protest hearing was held. Letters of protest were read from Mr. Clarence & Kayla Eastlick, Dr. Matt Calvert and Dr. Lee Richardson. Discussion followed: i Speaking were Dr. Matt Calvert, Clarence Eastlick, and Dr. Richardson. They felt that the SID was not fair to everyone. I Pat Mullaney questioned the engineer about curb and gutter on the north side of Maryland Lane, if the grade of the street will be brought up from the curb and gutter to the present paving and if the damaged areas will be repaired by the contractor who did the digging? The engineer answered "yes" to all these questions. Mr. Sheridan wants the council to make a decision one way or another. More discussion followed. Motion by Alderman Fink that Resolution No. 1741 be passed and adopted, seconded by Alderman Brennan. Division of the house: Alderman Fink "yes" Alderman Behm "yes" Alderman Brennan "yes' Alderman Burns "no" Alderman Meyers "no" Alderman Ehrlick "no" The Mayor broke the tie with a vote in favor of the SID. PAT MULLANEY HERBSTFEST: Requests permission to block off First Avenue between Main Street and First Street on September 15th for Herbstfest booths ' and other activities. Alderman Burns expressed concern about the area being cleaned up properly afterwards. The Mayor said that he and the Chief of Police would write a letter to the Retail Trades organization stating what would be required of them. Motion by Alderman Ehrlick to grant permission as requested, seconded by Alderman Fink. Carried. DAVE POWERS FIRE DISTRICT N0. 7: Fire District ~~7 was legally formed ' July I0, 1g79, and trustees were appointed by the County Commissioners.. A contract is proposed for an 11-month period (August 1, 1979, to June 30, 1880) in the amount of $12,031.25. Motion ~ Alderman Fink to give Dave Powers authority to enter the City of Laurel into a contract with the trusttes of Fire District No. 7, ' effective August 1, 1979, seconded by Alderman Ehrlick. Carried. WESTGARTEN SUBDIVISION: The Council agreed to accept the Planning Board's recommendation. RESOLUTION N0. 1742 I, A RESQLUTION CONDITIONALLY APPROVING WESTGARTEN SUBDIVISION AS AN ADDITION TO THE CITY OF LAUREL, ~'I MONTANA. Motion by Alderman Ehrlick that Resoltuion No. 1742 be passed and adopted, seconded by Alderman Meyers. Carried. SWEEPING DISTRICT: .Ordinance No. 659 passed on April 17, 1978, created the Sweeping District but the assessment per lot had not been determined. An amount of $45 had been discussed previously, for a lot with a 30' frontage. Motion by Alderman-Fink that the assessment for the Sweeping District ~~l be set at 1.50 a frontage foot, seconded by Alderman Burns. Carried. DON MEYERS CATERPILLAR AT THE.LANDFILL: The Cat has been sitting here for several months and something should be done with it. Either fix it up or sell 1't . Dick Metzger will check with a machinery appraiser to see what the Cat is worth and try to come up with a recommendation. MAYOR'S COMMENTS: Reminded the Council of a special meeting on July 25th to review preliminary budgets. Mentioned that he was signing the Lockrem Const. contract which was previously authorized. There being no further bus Hess to come before the Council at this time, the meeting was adjourned at 9: 0 .m.
