Herman, at 7:00 p.m., on June 5,1979. COUNCIL MEMBERS PRESENT: Albert Ehrlick Bill Brennan I~, Harold Burns Susan Carter Duane Behm Terry Fink Donald Meyers Ervin Metzger COUNCIL MEMBERS ABSENT: none i INVOCATION: Invocation given by Reverend Wilhelm. ~I MINUTES: Minutes of the May 15, 1879, regular meeting approved as presented. Minutes of the May 21, 1979, special meeting approved as presented. Minutes of the May 22, 1979, special meeting approved as presented. I, COMMITTEE APPOINTMENTS: Committee appointments were made by the Mayor, see II attached list.. Motion by Alderman Meyers to approve these appointments, seconded by I, Alderman Metzger. Carrieda 'i WESTSIDE SUBDIVISION: I RESOLUTION N0. 1733 A RESOLUTION CONDITIONALLY APPRQVING WESTSIDE SUBDI:VISION~ I~ AS AN ADDITION TO THE CITY OF LAUREL, MONTANA. 'i Motion by Alderman Metzger that Resolution No. 1733 be passed and adopted, seconded by Alderman Brennan. Carried. CHERRY HILLS SUBDIVISION, 2nd FILING: ESOLUTION N0. 1734 A RESOLUTION CONDITIONALLY APPROVING CHERRY HILL SUBDIVISION, 2nd FILING, AS AN ADDITION TO THE CITY OF LAUREL, MONTANA.. Motion by Alderman Fink that Resolution No. 1734 be passed and adopted, seconded by Alderman Meyers. Carried. MATHIS SUBDIVISION: The Planning Board recommended that the property be annexed; however, the property owner should try to include all of Block 1 in this request prior to the Council annexing just a portion of the block. Further., the Council should include the south half of 13th Street in the annexation to protect the service lines of the City. Motion by Alderman Ehrlick to accept the Planning Board's recommendation, seconded by Alderman Fink. Discussion followed. The other property owners in this block did not want to be annexed at this time. After the discussion, Alderman Ehrlick and Fink withdrew their original motion and second. ~ RESOLUTION N0. 1735 EXTENDING THE BOUNDARIES OF THE CITY OF LAUREL, ~ MONTANA, TO INCLUDE LOTS SIX (6), SEVEN (7), EIGHT (8), NINE (g), TEN (10), ELEVEN (11), TWELVE (12), THIRTEEN (13), FOURTEEN {14), AND FIFTEEN (15), IN BLOCK ONE (1), MATHIS SUBDIVISION, YELLOWSTONE.CQUNTY, MONTANA. Motion by Alderman Ehrlick that Resolution No. 1735 be passed and adopted, seconded by Alderman Fink. I~ LISPS officials say that they do not pay for a building permit. After some discussion it was decided to waive the building permit, but they will have to pay for plan check, tap and costs, surcharge, city license, I street opening and blacktop. Letter from State of Montana regarding application for eligibility Federal Surplus Personal Property Program. RESOLUTION N0. 1738 AUTHORIZING CITY REPRESENTATIVES TO ACQUIRE FEDERAL. SURPLUS PRQPERTY. II Motion by Alderman Ehrlick that Resolution No. 1738 be passed and adopted, seconded by Alderman Meyers. Carried. ROGER REICH - HKM ASSOC.:. EPA Sanitary Sewer Rehabilitation - construction on this is moving slow, because of other utility lines and a 20 ft. wide alley I, making it rather difficult to move equipment around.. Because of this-~ they I are requesting a change in completion date from June 28, 1979, to September 1, 197g, and additional engineering costs of $10,416 of which $2,604 would be I the Czty's share. Motion by Alderman Me~Zers to grant the change in completion date to September 1, lg7g, but no additional money far engineering costs, seconded by Alderman Fink. Carried. Sewer Rate Study - Discussed rate study, resolution I and ordinance that EPA requires in order to get EPA funding. Motion by Alderman Fink to authorize Roger Reich to present the sewer rate projections to EPA, seconded by Alderman Behm. Carried. RESOLUTION N0. 1736 A RESOLUTION STATING NO INDUSTRY IS PRESENTLY SERVED BY THE CITY'S WASTEWATER TREATMENT PLANT AND ANY INDUSTRY TO BE SERVED IN THE FUTURE WILL PAY BACK ITS FAIR SHARE OF THE CITY'S FEDERAL SEWAGE WORKS GRANT MONIES. Motion by Alderman Ehrlick that Resolution No. 1736 be passed and adopted, seconded by Alderman Burns. Carried. ORDINANCE N0. 664 AN ORDINANCE ESTABLISHING THE PROCEDURE FOR DETERMINING EQUITABLE SERVICE CHARGES TO BE LEVIED ON ALL USERS WHICH DISCHARGE WASTEWATER TO THE WASTEWATER SYSTEM OPERATED BY THE CITY OF LAUREL AND PROVIDING CERTAIN PROHIBITIONS. Motion by Alderman Meyers that Ordinance No. 664 be passed and adopted, seconded by Alderman Burns. Upon taking roll call vote, all Council members present voted "yes." 7th STREET SEWER LINE - COAL BOARD GRANT and HUD GRANT: HKM would like approval 'i to start design work so that when funds are released July 20th, construction _ can start this year instead of waiting another year. There is a meeting in ~ Denver July 12th to go over the final program for the HUD grant, and a meeting I in Hardin June 9th for final application on the Coal Board grant. 'i Carried. I BURLINGTON NORTHERN EASEMENT: No easement has been received yet from Burlington Northern. The Council agreed that if the City does not have the easement within 10 days, the City will proceed with condemnation proceedings.. DAVE POWERS: Requested the Council give approval for the fire department to burn a house on 4th Avenue. There has been no_objections by the property , owners in the immediate area and the release papers will be signed. prior 'I to t e burning. Requested that the Council approve sending 2 men to the Stat Volunteer Fireman's convention in Butte, June 14, 15, and 16. Motion by Alderman Burns to send 2 Laurel Volunteer Firemen to the ~I Stat convention, seconded by Alderman Metzger. Carried. I Requested that the Council approve a fireworks display on July 4th in Athletic Park. I i I I I i i ~ i page s ~/jinutes of the City Council of Laurel RESOLUTION No. 1737 TO NOMINATE DICK METZGER TO $E ON THE CONSULTANT SELECTION AND REVIEW BOARD FOR THE CARBON, STILL- ~ WATER, AND YELLOWSTONE COUNTY SOLID WASTE PLANNING PROJECT, i Motion b~ Al~ermari EY~rlick that Resolution No. 1737 be passed and adopted, seconded by Alderman Burns. Carried. ALBERT EHRLICK - ALLEY ON SOUTHSIDE: Long Construction has not. completed their phase of work to the alley between Woodland and Cedar Avenues from South 2nd Street to South 4th Street. He suggested that ',i this be rEpaired by June 15th or we will take appropriate action. A ~ letter is to be written to Long Construction informing them of this action. Also, Mrs. Allen, East of the Jr. High wants to put concrete or rocks on her boulevard. She should submit a written request for this ~ because there is an ordinance controlling the boulevards. Then the Council can take appropriate action. SUE CARTER: Announced that the swimming pool is scheduled to open on Friday, June 8th. -Fees for this year are as follows: i Season Family $14.00 Season Individual 6.00 Daily fee .75 Lessons 5.00 I, Any family having problems paying for these fees should contact Sue. The Council was reminded of a Special meeting on June 12th at 5:00 p.m. -There being no further busine to come before the Council at this time, the meeting adjourned at 8 55 p. on d L.
