Herman, at 7:00 p.m., on May 15, 1979. !I COUNCIL MEMBERS PRESENT: Albert Ehrlick Bill Brennan ~i Duane Behm Susan Carter Donald Meyers Terry Fink Ervin Metzger COUNCIL MEMBERS ABSENT: Harold Burns ~ INVOCATION: Invocation given by Reverend Ferguson. MINUTES: Minutes of the May 1, 1979, regular meeting approved as presented. Minutes of the May 8, 1979, special meeting approved as presented. CORRESPONDENCE: A thank you card from Ron Massey. ~i~ A letter of thanks from the Laurel Chamber of Commerce for making time ~I available at the April 17, 1879, City Council meeting for their Substance Abuse Program. CdUNCIL OFFICERS: Motion by Alderman Meyers, seconded by Alderman Fink, to nominate Ervin Metzger as President of the Council. Motion carried. Motion by Alderman Metzger, seconded by Alderman Meyers, to nominate Sue Carter as Vice-president of the Council. Motion carried. APPOINTMENTS: The Mayor submitted a list of nine 2-year appointments. Motion by Alderman Ehrlick t~ vote on each appointment on an indivi- dual basis, seconded by Alderman Metzger. Carried. Motion by Alderman Metzger to accept the appointment of Donald L. Hackmann as City Clerk, seconded by Alderwoman Carter. Carried. Motion by Alderman Meyers to accept the appointment of Thomas L. Bradley as City Attorney, seconded by Alderman Metzger. Carried. Motion by Alderman Fink to accept the appointment of Donald Lenhardt as Chief of Police, seconded by Alderman Meyers, Carried with a vote of 6--2. Motion by Alderman Meyers to accept the appointment of T. Curtis McKenzie as City Engineer, seconded by Alderman Metzger. Carried. ,Motion by Alderwoman Carter to accept the appointment of Richard Metzger as Maintenance Director, seconded by Alderman Brennan. Carried. Motion by Alderman Meyers to accept the appointment of Kenneth Beven as Public Utilities hector and Civil Defense Director, seconded by Alderman Behm. Carried. Motion by Alderwoman Carter to accept the appointment of Earl Linger to the Police Commission, seconded by Alderman Brennan. Carried. Motion by Alderman Metzger to accept the appointment of Dione Smith to the -Air Pollution Control Board, seconded by Alderman Behm. Carried. ZONING MAP: Motion by Alderman Behm to bring forth from the table the matter regarding the zoning of the Turcotte property, seconded by Alder- i man Meyers. Carried. I Motion b Alderman Behm to accept the Planning Board recommendation to zone the urcotte property RMH, seconded by Alderman Fink. Carried. VETO BY MAYOR: Veto by-the Mayor of the Laurel City Council's action. I establishing R-7500 single family dwelling designation in S & S Subdivision and ignoring the Laurel-Yellowstone City-County Planning Board's recommendation. 'I ORDINANCE N0. 662 ~ ZONING ORDINANCE AND ACCOMPANYING MAP Motion by Alderman Meyers that ordinance 662 be passed and adopted, seconded by Alderman Brennan. Upon taking a roll call vote all aldermen present voted "aye," except Alderman Ehrlick and Alderman Fink. Motion II passed 5--2 (copy on file in City Clerk's office.). j RESOLUTION N0. 1731 A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF LAUREL AND RURAL FIRE DISTRICT N0. 5, I, SAID AGREEMENT RELATING TO FIRE PROTECTION TO SAID DISTRICT. Motion b~ Alderman Ehrlick that Resolution No. 1731 be passed and II adopted, seconded by Alderman Meyers. Carried. JON RUTT, LAUREL JAYCEES: .Requested that the Jaycees be allowed to hold their annual street dance .and because of the new open alcoholic beverage container ordinance, he wanted to know if they could still sell beer, Motion by Alderman Meyers that the Jaycees be allowed to hold their street dance on July 3rd from the hours of g:00 p.m. to 2:00 a.m., between Main and West lst Street on 2nd Avenue and that alcoholic beverages may be served but confined to this area and the adjacent parking lot, seconded by Alderwoman Carter. Carried~6--1 with Alderman Brennan voting "no." ORDINANCE N0. 663 BEING AN ORDINANCE AMENDING SECTION 5.36.Og0 OF II THE MUNICIPAL CODE OF LAUREL, 1977, AND PROVIDING ' FOR THE HOURS WHEREIN LICENSED ESTABLISHMENTS CAN SELL ALCOHOLIC BEVERAGES. Motion by Alderman Ehrlick that ordinance 663 be passed and adopted, seconded by Alderman Fink. Upon taking roll call vote all aldermen present voted "aye." Motion carried. ALBERT EHRLICK mentioned the unsafe condition on 7th Avenue and 8th. The road is higher than the curb and is creating a hazard. He also brought up the matter of a culvert on Alder Avenue that needs replacing. The Mayor ordered Dick Metzger to blade down the road and replace the culvert and to i report back to the council. 'i DON MEYERS has had several complaints regarding junk autos around Modern Auto. The City is doing some work, but at the present time there is a lack of manpower. KEN BEVEN commented that an ad has been placed in the Outlook for water i treatment plant modification. The Mayor has ordered a special meeting I on June I2, I979, at 5:00 p.m. for the purpose of opening-these bids. SUE CARTER asked if we will be hiring seasonal help this year, and the Mayor's comment was "if the budgets can afford it." I~ MAYOR'S COMMENTS: Friday, May 18th, there will be a meeting of the League II of Cities and Tawns. A no-host luncheon at 2`x:00 at the Owl Cafe and the I meeting at 1:00 p.m. in the Council Chambers. I~ DUANE BEHM wanted to know if the ordinance regulating-the heights of trees over sidewalks applied to roadways also. The Mayor said it does if it becomes a hazard. This situation exists on 3rd Avenue, and Dick Metzger was told to check into this problem. ERVIN METZGER thanked the council for electing him president. ~ DON LENHARDT reminded everyone that the open container ordinance goes into I, effect May 17th. ~I INEZ VAUGHN commented that the cross walks from Penneys to Thriftway and surrounding area need to be painted. The Mayor indicated that some painting will be done this summer. HERMAN HAUCK wanted to share some thoughts with the new City Council. He thinks that developers many times are looked down upon and-feels that cooperation with everyone concerned pays off in the long run. He-says it is rather discouraging on what is_required.of a developer such as paving,-water and sewer line extension, park dedication fees, etc. He does not like what he calls "petty items" such as not being able to get a building permit before the fee is paid. He suggested that when there is a change in an ordinance that effects the building industry to pass this information along to a building committee to review it. This might better the relationship between the City and the developers. BARBARA SMITH and FRANK WHEELER questioned the Mayor's veto on the S & S Subdivision. They wanted to know on what grounds he made this veto. ,The Mayor said he felt the Planning Board's position was well taken.
