March 20, 1879
A regular meeting of the City Council of the City of Laurel, Montana,
was held in the council chambers and called to order by Mayor, Larry D.
Herman, at 7:00 p.m., on Tuesday, March 20, 1978.

The minutes of the regular meeting and special meeting of March 6, ~ ' 1979,. were approved as presented.
E P A AUTHORIZATION: ~ I
The Mayor received a letter of authorization to award the construction
contract for sewer between 1st and Main, to Holm-Sutherland Inc., the
low responsive responsible bidder. The total amount of the contract. ' is $281,27Q.25, all of which is eligible for Federal participation.
Construction to begin at the city's convenience.
Motion by Alderman Meyers to give the mayor authority to sign the I'
above mentioned contract, seconded by Alderman Metzger. Carried.
PUBLIC UTILITIES COMMITTEE: Motion by Alderman Meyers that the minutes of the Public Utilities

by Alderman Burns Carried.
FOX TRAILER PARK:
Ken Tolliver, Attorney for the developer, talked about "flag pole" annexation and city water and sewer service to this property.
Tom Bradley, City Attorney,- said that he was expecting a written
memorandum from Mr. Tolliver stating the proposals for the development
of the property, but as of this date he has not received anytihing.
Don Meyers requested that another committee meeting be held,
because there are several questions that still need to be answered
before a decision can be made on this matter.
CEMETERY: '
At the Cemetery Board meeting of March 19, 1979, it was recommended
that a new lawn mower be purchased. The present one is quite old and ~ d extensive re air. nee s A
After checking with various companies, the one that the board felt
was the. best buy, was a Ford 16 hp mower with a 42" cut for $2,987.00.
Since the mower was no't included in the current budget, it was agreed
to by the board that they would forgo the $3,000.00 paving project and

Motion by Alderman Ehrlick to authorize the change in the budget and for the Cemetery Board to purchase the Ford lawn mower, seconded
by Alderman Burns. Carried.
MAYOR'S COMMENTS:
Ken Beven went to Denver today to meet with the HUD people concerning
the final application for the HUD grant. The City of Laurel was granted approval to apply for a $151,000.00 grant. This money is to be used
on the 8th Avenue interceptor line.
PUBLIC HEARING:
A public hearing was held in accordance with Public Notice dated
February 21, 1g79, regarding the adoption of a new zoning ordinance and accompanying map. I~'

John MacMartin gave a presentation and explanation of the proposed changes in the zoning ordinance.
Several verbal protests were expressed from people in the I I
audience against zone changes throughout different areas in the
city. They were reminded that to formally register their complaint
it must be presented in writing. i
The decision to adopt or reject this ordinance was deferred until ! i
the April 17th city council meeting and the hearing will continue at ~
that time.. This will give the Planning Board time to review the 'I I
protests at their April 12th meeting and report back to the council
on the 17th. j
Protestors were advised to attend the Planning Board meeting
on the 12th.

POLICE COMMITTEE:
Harold Burns reported on a Police Committee meeting regarding the dog situation. Much discussion followed about the problem of
Loose and stray dogs, catching, disposing,. financing and trying to
find a satisfactory solution.
Motion by Alderman Burns to hire a person-for part-time dog I~,'
catcher and part-time meter person and to adopt an emergency budget
~s necessary. to implement, seconded by Alderman Meyers.
This motion was deferred until the April 4th council meeting I',
so that Don Lenhardt and Dick Metzger could have time to contact the
Montana Job Service as to the availability of a CETA person for this
job
Permission granted for Alderman Metzger ~o leave the state.
There being no further business to come before-the council at
this time, the meeting was ad ourne~ t g:00 p.m.

Dear Mayor Herman:
This letter will constitute your authorization to award the con-
struction contract to Holm - Sutherland Inc., the low responsive
responsible bidder. The total amount of the contract is $281,270.25,
all of which is eligible for Federal participation.
The grant increase has been approved by the Montana Department of
Health and Environmental Sciences and is under review by this office:
Construction may now begin at your convenience. Please furnish
this office with two copies of the authorization to the contractor to
begin construction, and two copies of the signed contract documents
through the 14ontana Department of Health and Environmental Sciences.
The required EEO documentation will be requested by separate letter
and must be submitted to the Office of Civil Rights and Urban Affairs
no later than 30 days after award of contract.
Title 40 CFR 35.935-3, requires that contractors maintain adequate
fire and extended coverage (where appropriate), workmen's compensation,
public liability and property damage, and "all risk" builders risk
insurance (including blasting where appropriate) during the construction
phase of the contract. Please send the workmen's compensation and
insurance certificates, performance and payment bonds, and signed state-
inent of Hurl-segregated -Facilities for all contractors and subcontractors.
This is an appropriate time to remind you that the instructions
for carrying out the President's Executive Order No.11246 require
that this office be notified immediately upon issuance of all work
orders. A statement should also be furnished by the authorized rep-
resentative that the instructions contained in the informational

materials distributed by EPA Region VIII for the implementation of
Executive Order No. 11246 have been complied with.

DISCUSSION OF PROPOSED WATER LINE: on Railroad Street from
Burlington Northern to city limits, also property owners south
of railroad now being served by the railroad. Tom Bradley
stated the city does not know who all is served on that line.
Burlington Northern would like the city to tal-e over the water
utility. Should have meter installed and billed properly.
Tom Bradley stated the city should probably stay clear of
Yovetich's property. Tom Bradley stated the Public Service
Commission would try to exempt the city from serving any
additional properties. Was there originally any designated
number of services the BN would allow? BN replied the people
were supposed to have an agreement with the BN, but it has
gotten out of hand by others hooking up with no agreement.
Since 1956 the city has maintained the low pressure pumps
at the plant.
Meyers wants to increase the line to 10" for fire protection.
8" pipe has already been purchased by BN.
Meyers wants "waiver of annexation" with property descriptions.
BN would try to get these for the city.
If city decides on 10" line, perhaps the city could use the
8" pipe elsewhere and supply the 10".
Marv Carter feels BN's own 6" fire line is insufficient.
Mueller 107 fire hydrants should be used; however, the price
of this model is going sky high.' Perhaps a substitute could
be used -- the Centurion would be acceptable to the Fire Chief.
Our ordinance and specifications would have to be updated.
BN will check into their 6" fire line.
Will BN help inserting the 8" or 10" line? City may want to
run the line a different or shorter way in order to make a
loop. City will check with its engineer regarding SDP reno-
vation and hooking on.
What about new hookups? Who would be responsible. City would
be responsible to curb stop.
Meyers says if we can agree on this, the city would allow the
modulating valve. Meyers wants BN to be involved in the survey
of the roads. Also, these are county roads. Anywhere a water
line is laid must be within the city limits.
BN agrees as per March 17th, 1978, letter to furnish materials
and city will supply the labor.
Perhaps plug a short section of the line between Lindy Lane
and the interstate and use the casing already installed
underneath the interstate.
City may need control of the modulating valve for, a short
time while SDP is being renovated. Would need agreement with
BN in order to do this.
