HomeMy WebLinkAboutCity Council Minutes 03.06.1979 Minutes of the City Council of Laurel March 6, 1979 A regular meeting of the City Council of the City of Laurel, Montana, was held in the council chambers and called to order by Mayor, Larry D. ~ .Herman, at 7:00 p.m., on Tuesday, March 6, 1979. COUNCIL MEMBERS PRESENT: Albert Ehrlick Susan Carter Thamas Kilpatrick Ronald Massey Donald Meyers Ervin Metzger Charles Rodgers Harold Burns COUNCIL MEMBERS ABSENT: None. INVOCATION: I Invocation was given by Reverend Wilhelm. MINUTES: ~'i Request by Harold Burns to amend the minutes of the regular council meeting of February 28, 1979, regarding back pay for police captain-and Sargent. I~ The back pay for both should be $75.00 a month fbr five (5) months I for a total of $37.00 each. The monthly salary for the captain will be I $1,300.00 a month and the Sargent $1,250.00 a month. This takes into account the $150.00 and $100.00 raises mentioned in the minutes of Septiember lg, 1978, and February 28, 1979. Motion by Alderman Burns to approve the minutes. of the regular meeting I', of February 28, 1979, as amended, seconded by Alderman Metzger. Carried. i Mayor ordered the. clerk to prepare claims and issue warrants for the back pay. I The minutes of the special meeting of February 2@, 1979, approved as I, presented. I Motion by Alderman Ehrlick that Resolution No. 1725 be passed and ' adopted, seconded by Alderman Kilpatrick. Carried. TRUCK ROUTE: The clerk was instructed to write a letter to Adams Brothers Construction advising them to use 8th Avenue as a truck route. S I D 102: Jim Murphy presented a petition to create Special Improvement District No. 102 in Sheridan, Whitfield and Magnus Subdivisions. RESOLUTION N0. 1726 A RESOLUTION DECLARING IT TO BE THE INTENTION OF THE COUNCIL OF THE CITY OF LAUREL, MQNTANA, TO CREATE SPECIAL IMPROVEMENT DSTRIGT N0. 102 Motion by Alderman Burns that Resolution No. 1726 be passed and adopted, seconded by Alderman Ehrlick. Carried. The clerk was directed to publish the notice in the Laurel Outlook and to notify the property owners in the improvement district as required by law. WESTGARTEN SUBDIVISION: Jerry Gaston, Engineer, representing ?r. R. L. Turcotte for application j of annexation to the City of Laurel, Westgarten Subdivision. ~ The Mayor referred this to the City-County Planning Board for review and ail recommendation. CHERRY HILL SUBDIVISION, 2nd FILING: Jim Worthington representing Mace Realty for Cherry Hill Subdivision, 2nd filing, requested the council to consider a proposal from the developer to proceed with the development of the subdivision, with-the understanding that 1, Lle UCVC1Vj~C I' 1S 1Jl'C ~:1 cli"CU l+V (J c'l i"411:1 ~J c1. l.C 1i1 t~i.1C I.V~L Vl 1~11C 1i1 l.Ci l,.C~l liVl ~ Wllcl l+ has been referred to in the past as the 7th Avenue Interceptor. This is one that will take the load aff of the west :end. Once this is installed it has been determined that the city will be able to handle the additional load. With this in mind, the developer requests permission to connect~.~o water and sewer caith the stipulation that no actual connections be accomplished until the interceptor is installed. The reason that a request is made at .this time is that the application for the grant funding for the interceptor is being processed at the present I, time on the State level. The city has been informed that it is a very strong possibility that between the 9th and 16th of March, the grant will be approved. Motion by Alderman Meyers to authorize the developer to proceed with I the preliminary plat with the condition that the surface drainage will be taken care of and that no connections are made to sanitary sewer until such j time that the interceptor is completed or under construction, seconded by I Alderman Metzger. Motion carried with Alderman Massey abstaining. Financing was discussed and the mayor appointed Alderman Metzger, Alderwoman Carter, and Alderman Meyers to a committee for the purpose of how to determine equitably what amount should be charged to the developers. i I _ p, 3 Minutes of the City Council of Laurel FOX TRAILER PARK: Jim Worthington representing George Fox for Fox Trailer Park request _ for consideration of the application for annexation of the property with the intent of annexing through a flag or strip type of development down the hightaay. Discussion followed-and a committee of Alderman Meyers, Alderman Burns, and. Alderman Ehrlick was appointed by the mayor to meet with Mr. Worthington and .the Department Heads to look into the types of problems that can be created by this type of development.. They are to report back to the council of their findings and recommendations. DON MEYERS, PUBLIC UTILITIES COMMITTEE: Discussed B.N. water line and letter of February 27, lg7g, which was received from Burlington Northern. I Motion by Alderman Metzger that a meeting with B.N. be set up to pursue the I .matter of getting the water line problem resolved, seconded by Alderwoman Carter. Carried. The mayor appointed the Utility Committee to meet with Burlington Northern. WATER LINE REPAIR'CHARGES: Public- Utilities Committee recommended to refund digging expense for frozen-water lines from the main to curb stop effective January 1, 1979.. This is to include Mrs. Milligan and her having a private contractor do I some work from the curb stop to the main. Motion by Alderman Kilpatrick to accept the Utilities Committee recom- mendation for refunds on frozen water lines, seconded by Alderman Ehrlick. Carried. RULES AND REGULATIONS FOR WATER SERVICES: RESOLUTION N0. 1727 ~ RULES AND REGULATIONS FOR WATER SERVICES Motion by Alderman Meyers that Resolution No. 172 be passed and I adopted, seconded by Alderman Burns. Carried. Motion bar Alderman Meyers that the minutes of the Utilities Committee meeting of February 28, lg7g, be entered into the record, seconded by Alderman Rodgers. Carried. Motion by Alderman Ehrlick that the minutes of the Street and Alley Committee meeting of February 27, 1979, be entered into the record, seconded by Alderman Kilpatrick. Carried.. The mayor directed the clerk to make refunds to the people that have paid their repair bill and to notify the ones that have not been paid,' that their bill is no longer due. MAYOR'S COMMENTS: The mayor asked the council for their ideas on painting and carpeting the council chambers. Motion by Alderwoman Carter to paint and carpet the city council chambers, seconded by Alderman Metzger. Motion by Alderman Kilpatrick to divide the original motion into a i ' separate vote for painting and separate vote for carpeting, seconded by i I Alderman Meyers. Vote was 5 3 in favor of this motion. ' The motion for painting carried.. j The motion for carpeting was a 4 4 tie, with the mayor breaking this tie with a-vote in favor of carpeting. COMMENTS FROM AUDIENCE: ' The doh problem was brought up and the council was reminded of an ordinance about owners letting their dogs run loose. The mayor and council are aware of this problem, and the police are doing what they can. A suggestion was made that the city try to find funds so that a doh catcher 'I can be budgeted for next year. The mayor turned this matter over to Alderman Burns' committee and to report back to the council as to recommendations for a possible solution to this problem. The mayor accepted the resignation of Judy Kettenring as the Laurel Ambulance Director. Alderman Kilpatrick wanted to clarify paragraph two, under reasons j for resignation, "not to use policemen." This was not the intent; policemen li can work on the ambulance as long as they are not on police duty. The Ambulance Committee has made a recommendation that David Little be appointed Director and Dale Wood as Assistant Director of the Laurel Ambulance Service. Mayor asked for acceptance of resignation and appointments. j Motion by Alderman Rodgers to accept the resignation of Judy Kettenring I and the appointments of David Little and Dale Wood, seconded by Alderman I Meyers. Carried. Mayor asked for confirmation of the appointment of Ruth Ann Wood as I an auxiliar member of the Laurel Reserve and Auxiliar Police. Carried. Don Meyers thanked Judy for the fine job she did as Ambulance Director. Box 6 Laurel, Montana 59044 Dear Mr. Herman: With reference to the City of Laurel's application for a pipeline permit dated January 25, 1979, covering the pro- posed 60 inch storm sewer crossing of Burlington Northern Inc. right-of-way at Laurel, Montana. To date, the matter concerning water service to Burlington Northern and the residences of the Nutting II Subdivision near Laurel has not been resolved. My letter of March 17, 1978 to Mr. Ken Beven, Public Utilities Director, advised of Burlington Northern's willingness to proceed along the lines advanced at a meeting with several Laurel officials to resolve this matter. This proposal was rejected by the City of Laurel, and Mr. Bevens so advised this office with his letter of March 31, 1978. It is our contention that the City of Laurel's proposal to construct a storm sewer line and the situation relating to water service to B.N. and other residences, must be considered as a total package involving total City utility services. For this reason,,the City of Laurel's pipeline application will be held in abeyance until the sewer construction and water supply problem can be resolved. We will await reply from the City of Laurel as to a solution of this matter. Sincerely, D.
