Continued from February 6, 1979 meeting. A letter has been received Ili, I III
from James P. Murphy stating that he has negotiated a private sale of the bonds i ~i
to Property Supervision, Inc. I
Leon Howe recommended that the construction bid for $29,841.88 by '
Adams Brothers, and the sale of the bonds be accepted.
Motion b Alderman Meyers: To award the construction bid to Adams i ~I, Y ~
Bro~.hers. Seconded by Alderman Burns. Motion carried. I,
Motion by Alderman Masseys To accept the sale of bonds to Property ~ I
Supervision, Inc. Seconded by Alderman Burns. Motion carried. '
CITY LICENSE:
Ronald Gifford requested a City License for making refrigeration service calls from his home at 508 5th Ave. i

The City Attorney advised that there was a city ordinance prohibiting ' %
- a business being located in a residential. neighborhood. Even though the business
was primarily service calls away from the house, advertising and phone calls directed
at the residential address constituted a business in the area. Nir. Gifford was informed that if he wished, he could apply for a variance to the Board of adjust-
F.A.P. COMPLEX:
Dave Powers discussed several problems with the building since the
construction was completed.
Repairs to be done by the contractor at no charge to the city are: Warped door panels, roof leaks and damaged ceiling tile. '
The soffits need to be replaced and Slovarp Construction indicated
this could be done at a cost of $959.00. Mr. Powers mentioned that the city ,
still owes Slovarp $300.OQ that was held back from the original bid.
Don Lenhardt reported that Southern Steel has not completed lighting
the jail properly.
Mr. Powers indicated that letters have been written in the past to E.F.

Jahn MacMartin urged the council to hold a public hearing for recommen-
dation to adopt a new zoning ordinance. A_Public hearing date of_Ma_rch 2Qth was

The Mayor would like council approval of his appointment of Maurice III Kaiser to the T~mbulance Committee. ~I
Motion ~ Alderman Rodgers: To approve the appointment of Mauri Kaiser II
to the ambulance committee. Seconded by Alderman Metzger. Motion I!

The Council accepted the resignation of Lee-Kerr as Assistant Ambulance
Director.

AZderm~n Meyers asked the question, "Where does the property owners ~
water line begin"? Discussion followed, It appears that the curb box is where
it begins. However it was felt that a property owners line that mays be located
under a public road or street should be repaired ~y the city. Mr. Meyers is to take the current bills for frozen water Line repairs to his committee to review
who should pay the repair cost.

Alderman Burns indicated that the Police Captain and Police Sargent ~
were not being paid the correct salary since September 1978. '
Motion b~ Alderman Burns: To clarify the record that the Captain was
to make $150.00 a month and Sargent $1Q0.00 a month over and above what
the patrolman make. Seconded by Alderman Carter.. Motion carried.
Apparently the increase was figured on the wrong base and the captain _ should have back pay of $84.00 a month and Sargent $32.00 a month from September
19, 1978. A a~' , ~

Motion by Alderman Ehrlick: To make up the back pay for police captain '
and Sargent. Seconded by Alderman Meyers. Motion carried.

Permission granted for Alderman Metzger to leave the State.
There being no further business to ,before the Council at this
time, the meeting was adjourned.

Re: Special Improvement District #101
Dear Sir:
At the City Council meeting on January 16, 1979, the
contract in SID #101 was awarded to Adams Brothers Con-
struction of Park City, Montana, subject to sale of the
municipal bonds since a bond bid was not received. I
have now negotiated a private sale of the bonds to
Property Supervisions, Inc. I have requested the printer
in Minneapolis to prepare the bonds and will deliver them
to you as soon as I receive them. The bond amount of the
district will be $41,000.00 and I anticipate delivering
the bonds to you within three to four weeks.

PARTIAL VETO BY THE MAYOR OF THE CITY OF
LAUREL OF THE CITY COUNCIL RESOLUTION
ABOLISHING THE POSITION OF ASSISTANT
AMBULANCE DIRECTOR
RECITALS
1. On February 6, 19790 the City Council of the City of Laurel,
County of Yellowstone, State of Montana, at a spacial meeting
called by at least two members of the City Council, by resolution
abolished the position of assistant director o! the Laurel
Ambulance Service and transfering the ambulance billing to
the City Clerk.
2. Abolition of said position was done in closed session of
the City Council without consultation with the ambulance
committee.
3. The Laurel, Ambulance Service is a volunteer unit not unlike
that of the Volunteer Fire Department,
4. The drivers and attendants of the Laurel Ambulance Service
are volunteers and not permanent employees of the city. All
drivers and attendants must become qualified under state law
to perforce ambulance services. The volunteered duties mutt
not be in conflict with the volunteer's permanent employment.
5. The position of police captain is that of liason and
training officer of the Ambulance Service and the Police
Auxillary. The duties of the police captain do not include
being a driver or attendant on the ambulance.
6. The City Council's resolution abolishing the office} of
Assistant Director also, in effect, aboli8hed the assistant
director's salary.

T. The ambulance committee is of the opinion that a chain of
command is necessary in the Laurel Ambulance Service in the
absence of the Ambulance Director. The Ambulance Coamittee
is of the opinion that a volunteer *saber of the Ambulance
Service should hold the position of Assistant Director. The
Mayor is of the position that the reasoning of the Ambulance
CoNnIttee is sound.
S. No ordinance, resolution, or state statute prohibits a
city employee from volunteering for duties with the Ambulance
Service or Fire Department. The volunteered time, however,
must not be during the city employees normal work hours with
the city, but on the employees own time. Volunteering when
in conflict with permanent city employment in disoouraged
and should be avoided.
9. The City Council's resolution recognised that a city employee
volunteering as a driver or attendant should be compensated as
other drivers and attendants.
VETO
NOW THEREFORE, I, Larry D. Herman, Mayor of the City of
Laurel, County of Yellowstone, State of Montana, under authority
granted under ordinance $ 2.08.020 and 8 7-5-4205, MCA, do
hereby veto that portion of the City Council resolution abolishing
the position of assistant ambulance director.
That portion of the City Council's resolution abolishing
the salary of the assistant director and transfering the ambulance
billing to the City Clerk in hereby approved.
It being agecifically understood that an assistant director
performing duties as a volunteer ambulance driver or attendant

shall receive the same comPensation as other volunteer ambulance
drivers or attenuntS. It iS recowmended to the City Council
consideration of Giving an additional twenty dollars ($20.00)
