December 2, 1980
A regular meeting of the City Council of the City of Laurel, Montana,
was held in_the Council Chambers and called to order by Mayor Larry D. Herman,
at 7:05 p.m., on December 2, 1980.
COUNCIL MEMBERS PRESENT: Albert Ehrlick Bill Brennan
Harold Burns Terry Fink
Donald Meyers Ervin Metzger
COUNCIL MEMBERS ABSENT: Duane Behm Susan Carter
INVOCATION: Invocation given by Reverend Wilhelm.
MINUTES: Minutes of the regular meeting of November 18, 1980, approved as
presented.
CORRESPONDENCE; Received a card of thanks from the family of Edith Easton
for the flowers which the City purchased in her memory.
Received a letter from HKM Assoc. regarding the final stages of the storm
sewer contract and the guarantee period.
Discussion.
Motion by Alde.rm.a.n M~yers to accept October 29, 1980, as the beginning
date for the one year guarantee period, except for the two items on the punch
list and a letter of satisfaction from the Burlington Northern Railroad, and
that retainage be withheld in sufficient amount to cover the punch list items,
seconded by Alderman Burns. Carried.
CLAIMS: A copy of the "Statement of Items Released for Payment" for the
November claims has been presented to the Council for review and approval.
Motion by Alderman Metzger to approve the November claims as presented,
seconded by Alderman Ehrlick. Carried.
JOHN MacMARTIN - CUMIN ASSOCIATES: Mr. MacMartin presented and summarized
the report on U. S. Department of Agriculture, Farmers Home Administration
Section 601, Compliance Planning Addendum, for Laurel, Montana.
Discussion.
Motion by Alderman Ehrlick to approve the plan to the Department of
Agriculture, Farmers Home Administration, o~ the Comprehensive Planning
Addendum for the City of Laurel, prepared by Cumin Associates, dated November,
1980, seconded by Alderman Meyers. Carried.
TOM BRADLEY - SID 100 (MOGAN SUBDIVISION}: Mr. Bradley informed the Council
that the City has problems with SID 100.
1. Taxes are not being paid and money has to be borrowed from the Revolving
Fund to pay the principal and interest on the bonds.
2. The water level in that area is very high. Barry O'Leary has completed
the street improvements but the water bubbles up through the street.
There is no way you can put a cap or surface on it with the amount of
water that is coming up. The engineering firm that designed that district
did not take into account the excessive water level in that area. Barry
O'Leary, who did the construction work, has now presented a claim for
final payment. If we approve it, you will have a street that will not
stay up and will not support any type of surface.
There has been a suggestion of an underground drainage system that could
be put in the middle of the street with perforated pipe to drain off the water
and lead it into our storm drain system. It has been estimated to cost $10,000.

The owner and the district said they do not have the money and won't pay it.
This could also overload the storm drain at times.
I, quite frankly, think this is a problem between the owner and the
design engineers. The owner picked the engineer and attorney for the dis-
trict. It is my opinion that the owner should turn to that attorney that
they hired and paid and have him sue the design engineer. I do not feel
that the City should accept this problem.
There is talk that part of the problem is excessive water from the
Nutting Drain which is inactive. It is clogged up and dirty. But the
engineer who surveyed that knew the drain was there. It has been there
for years. I think it is a problem of the design engineer who laid out
that SID district.
Discussion.
The engineering firm for the SID is SS & G (Sanderson/Stewart/Gaston)
whom the City has had problems with on other projects.
Motion by Alde.rman Metzger that a letter be directed to the owner
(Paul Mogan) informing him what the problems are that he has to get cor-
rected and also indicate to him that payments on all construction claims
will be withheld until the project meets the City's approval, seconded by
Alderman Meyers. Carried.
BOB ADAMS - LOCUST STREET - NUTTING BROTHERS SUBDIVISDN: There is a one
block section of 7th Street' between Juniper & Locust that is nothing but
a mud hole when it rains. I would like to see it gravelled or something
done about it.
This was turned over to the Street & Alley Committee for review.
ERVIN METZGER: Mr. Metzger asked Tom Bradley about the people that paid
their garbage under protest~ if we still have to continue keeping this
money in a separate cash account. Some of them have had adjustments and
appear to be happy with it.
Tom Bradley - We wrote to their attorney and have not had a response to it~
so it is still up in the air. In the meantime the Mayor has appointed a
committee to study the rates.
Alderman Metzger also brought up the problem of the sewer backing up
at the H. R. Batt residence at 924 4th Avenue.
Discussion.
This was turned over to the Utility Committee for review and they are
to report back to the Council.
MAYOR'S COMMENTS: Reported that the 5th member of the garbage study committee
was John Lackman.
The Mayor also read a letter of resignation from Ken Beven effective
January 31, 1981. Ken is retiring after thirty years of service with the
City.
DAVE POWERS - FIRE DEPARTMENT: Mr. Powers requested that we advertise for
bids on a pager system. This item is in the budget.
Motion by Alderman Meyers that we advertise for bids on a pager system~
bids to be opened at the Council meeting on January 6~ 1981, Seconded by
Alderman Metzger. Carried.

DON MEYERS: Announced that the City of Laurel Christmas Party will be
held at the Rod and Gun Club Saturday at 6:30 p.m.
DARRELL McGILLEN - FIRE DEPARTMENT: Presented a film taken during a
presentation by the Laurel Volunteer Fire Department at the Graff Elementary
School, regarding the Do's and Don'ts of Fire Safety and Prevention.
There being no further busines~/~.~ome before the Council at this
