Minutes of the City Council of Laurel November 5, 1980 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor, Larry D. Herman, at 7:~0 p.m., on November 5, 1980. COUNCIL MEMBERS PRESENT: Albert Ehrlick Harold Burns Donald Meyers COUNCIL MEMBERS ABSENT: Duane Behm INVOCATION: Invocation given by Reverend Whanger0 MINUTES: Minutes of the regular meeting of October 'presented. CLAIMS: A copy of the "Statement of Items Released Bill Brennan Terry Fink Ervin Metzger Susan Carter 21, 1980, approved ss for Payment" for the October claims has been presented to the Council for review and approval. Motion by Alderman Metzger to approve the October claims as presented, seconded by Alderman Brennan. Carried. PUBLIC HEARING - HUD PRE-APPLICATION: This being the time and place adver- tised, a public hearing was held. Linda Stahl - Does HUD decide how much money we get and where it should be spent? Mayor Herman - We don't know what we are going to get. We have indicated areas where we need assistance, and they will tell us how many dollars we have. ~ Linda Stahl - Do they distribute the money on a percentage basis -- a cer- tain percent on this project, a certain percent for that project, etc.? Mayor Herman - We list the projects and their total value as I recall, and try to get assistance that way. So they may give us $50,000 and tell us to use it for any one of the projects listed. The reason you are here is for streets, right? Linda Stahl - Yes. Mayor Herman It will be some time in January before we find out if we are in iine for any money. David Stahl - How can we assist in obtaining this grant? hayor Herman and Ken Beven indicated that letters written to us in support of the project will help. These letters will then be forwarded to HUD. ©uestion - Are the loans on the housing project going to be low interest? Mayor Herman - We as a City would probably be able to set requirements for this. It could be just an outright grant, partial grant and partial loan, or couid be all loan at low interest. Linda Stahl - The Outlook indicated that there couid stilI be a substantial SID. Mayor Herman If we get the money, the amount of the grant would reduce the amount needed from the property owners in the SID. At this point the amount is unknown. MAYOR'S COMMENTS: Received a letter from Police ChiEf, Michael Bloom, regarding personnel residing outside corporate limits and is requesting that the Council make a ruling on this matter. Discussion. Motion by Alderman Meyers to propose that it be manditory that all city employees live within the Laurel telephone exchange number {628} and that final passage be delayed until the November 18th regular Council meeting, in order to allow more public input, seconded by Alderman Ehrlick. Carried. APPOINTEMNTS: Commercial Garbage Study Committee - The Chamber has submitted two names, the Mayor two names, and those four are to select a fifth member. The appointments are as follows: Curt Riemann Ken Hageman Lenore Waddell Larry Lorfing Motion by Alderman Ehrlick to approve the appointments to the Commercial Garbage Study Committee, seconded by Alderman Burns. Carried. Inter-local Government Study Commission - The Mayor has appointed Lorene Schardt to serve on this committee as Laurel's representative. Motion by Alderman Metzger to approve the appointment of Lorene Schardt to the Inter-local Government Study Commission, seconded by Alderman Brennan. Carried. JOHN MacMARTIH presented the deed to the City Council for property purchased from Cenex (6.5 acres), for the secondary sewer treatment plant. Money for this purchase came from a Farmers Home Administration grant. John also informed the Council that the final draft for the compliance planning update should be ready for the Council at a December meeting. BOB BURNS - GARBAGE RATE FOR SONNY O'DAYS BAR: I actually think, after re- viewing this with Duane Behm and going down to the bar a couple of times, that he is a hardship case and should have an adjustment. He is closing down the bar from one to three days a week. His garbage really amounts to nothing. I do feel in my own mind that with other adjustments we have given businesses, I think he is deserving of an adjustment. $360.00 is too much for the 'business that he has. Discussion. The base rate for bars is $360.00 and to go below that rate would require an ordinance change. Any change could be made retroactive and a rebate given. This matter was referred to the new Commercial Garbage Study Committee for a recommendation. The Mayor also instructed the committee to look at and consider the possibility of rebates for businesses that were considered to have too high of a garbage rate this year. The next matter to come before the Council is a discussion of some personnel matters dealing with the ambulance and it is the Mayor's deter- mination that matters of individual privacy are involved. Such privacy demands protection of the individuals for the sake of reputation and other- wise that little, if anything, could be gained by publicly disclosing the page 3 Minutes of the City Council of Laurel information to be discussed and that the demand of individual privacy in this matter clearly exceeds the merits of public disclosure, and therefore I am going to a closed meeting. CLOSED MEETING: Ambulance personnel and service. The Mayor informed the Council that he has put out a directive that no police officer may serve on the ambulance crew, because of conflict with police duties. Discussion followed. Ambulance committee minutes of October 30, 1980, were entered into the record. End of closed meeting. DON MEYERS announced 1950, at the Rod and that the Christmas party will be held Gun Club.
