August 19, 1980
A regular meeting of the City Council of the City of Laurel, Montana,
was held in the Council Chambers and called to order by ~ayor Larry D.
Herman, at 7:00 p.m., on August 19, 1980.

MINUTES: Minutes of the regular meeting of August 5, 1980, approved as
presented.
Minutes of the special meeting of August 6, 1980, approved as
presented~
CORRESPONDENCE: Letter from City-County Planning Board recommending that
the governing bodies spend $8,000.00 to place curb and gutters around the
north and east sides of Murray Park in order that future park development
will be delineated both horizontally and vertically.
Motion by Alderman Ehrlick to approve the request of $8,000.00 from
the City-County Park fund and that the letter be sent to the County Com-
missioners for their approval, seconded by Alderman Brennan. Motion
carried.
MAYOR'S VETO:
Fichtner Chevrolet change from Class 3, Level C, to Class 6, Level A.
The reason for the veto is that it is felt that the two (2} car dealerships
should be treated the same for the year 1980 in user Class 6, Level A, in
the sum of $360.00 a year. The Mayor also recommends that all class and
level categories be reviewed prior to establishing the garbage fees for
residential and commercial users for the year 1981.
Veto to Resolution #1803 allowing a 10% vacancy factor for multiple residen-
tial dwellings (three or more units} based on the annual rate. The reason
for the veto being that it is felt that the 10% vacancy factor would prove
to be difficult to impiement by the Clerk's Office and does not adequately
reflect the true vacancies in multiple residential dwellings.
It is the recommendation of the Mayor that the most equitable manner
of determining the vacancy factor is to go strictly to an occupied unit as
opposed to a vacancy factor. It is the recommendation of the Mayor that
Ordinance No. 681 be amended to provide that the rate applies to occupied
units and that it would be the responsibility of the owner of the multiple
residential dwelling and mobile home courts to notify the Clerk's Office of
the occupancy throughout the year. The occupied unit is presently being used
by the Clerk's Office for all multiple residential dwellings and mobile home
courts with the water and sewer rate. It is the feeling of the Clerk that
the method utilized with water, as approved by the Public Service Commission,
would be suitable to the refuse collection fees.
In addition, it is recommended by the Mayor that Ordinance No. 681 be
further amended to reflect that motels and other rooming facilities having
family units, as defined by the Public Service Commission, shall be charged
the same for the family units as with other multiple residential dwellings.

DUANE BEHM - GARBAGE COMMITTEE: Duane stated that the men from Tractor and
Equipment were here to see what hae been decided about the bids on the compactor.
They would like to discuss the methods of financing. According to the bid
under a 60-month lease/purchase plan the payment would be $2~706.14 a month.
Tractor & Equipment said they would be more than happy to sit down with the
committee to make whatever arrangements are necessary to meet our financial
needs. Much discussion as to whether the City can afford the compactor at
this time or if they should wait a year. Alderman Fink feels we should wait
a year to see what is decided about the business district. Discussion about
repairs to the cat. Estimated repairs would run about $26,15B.00. Arrange-
ments could be made to pay for the repairs over the next 2 years.
Motion by Alderman Behm to accept the low bid on the compactor from
Tractor & Equipment for the 60-month lease/purchase agreement at $2,706.14
a month, seconded by Alderwoman Carter. Motion carried with Alderman Fink
voting "no."
SAFEWAY'S GARBAGE: There has been an error in computing the garbage charge
for Safeways. They used to have 5 containers but had 2 of them picked up.
Their charge should be adjusted from $2,400.00 a year to somewhere around
$1,680.00 per year. .According to the procedures~ Dick has the jurisdiction
to review the rates and make any adjustments if necessary. Dick to look at
the schedule and see which level and class Safeway's should be placed in.
COMPONENT STRUCTURES GARBAGE: They were billed $540.00 and they do not feel
they should have to pay this because Big Sky hauls their garbage. The $540.00
charge is for using the landfill. If they do not want to pay the $540.00
then they will have to pay by the load each time they dump, and it would cost
them more. If they do not pay this charge it will go on their 1980 tax state-
ment. Dick to talk to them and inform them what the charges are for.
PROTESTS: Duane stated that there were about 15 more protest letters and
he would like to set a date for a final protest hearing. Meeting set for
September 3rd at 7:00 p.m.
MAYOR'S COMMENTS: The next matter to come before the Council is the discussion
of the labor contract. Therefore, under state law it is permissible to go
into an executive session for d±scussion and request the meeting to be closed
to the public. At this time the meeting was adjourned 8:BO p.m.
