June 17, 1980
A regular meeting of the City Council of the City of Laurel, Montana was
held in the Couneil Chambers and called to order by Mayor Larry D. Herman, at
7:00 p.m., on June 17, 1§80.

Motion by Alderman Metzger as follows:
Whereas through oversight and clerical error a formal resolution was in-
voluntarily omitted for the purchase of a street sweeper, the minutes of May
1980, be amended nunc pro tune as follows:

A RESOLUTION AUTHORIZING AGREEMENT WITH MODERN MACHINERY AND TO
PAY FOR THE STREET SWEEPER FROM SWEEPING DISTRICT ASSESSMENTS.
Seconded by Alderman Ehrliek. Carried.

Motion by Alderman Burns that the license requests he approved as presented.
Seconded by Alderman Brennan. Carried.

PUBLIC HEARING: Change in subdivision and zoning regulation.
This being the time and place advertised, a public hearing was held.
A question by Inez Vaughn regarding the zoning regulation and
the location of her garage right up to the sidewalk. "Could I
build on to my garage if I wanted to?"
Answer: The two (2) feet offset is for new construction and
you would have to go through the Board of Adjustment to get
a variance.
There being no further questions or comments, the hearing was closed.
Consideration on passage approving the changes will be done at a later date.
CURT McKENZIE--"601" FUNDS
Curt reported on the "$50,O00.00 Mapping Grant and a news release re-
garding the Farmers Home Administration Grant.
Motion by Alderman Brennan to give the Mayor authority to sign the contract
on the 601 Energy Impact Funds .for the topographical mapping and to accept the
grant money on behalf of the City of Laurel and to give the Mayor authority to
sign the draw down ~equests, Seconded by Alderman Ehrlick. Carried.
City Clerk's and City Treasurer'~inancial Statements were presented for
approval.
Motion by Alderman Metzger to approve the Clerk's and Treasurer's Financial
Statements as presented. Seconded by Alderwoman Carter. Carried.
i ~_~--Laure! J C's Mel Tiensvold
The JC"s request that they be allowed to use Riverside Park to hold a dance
the night of July 3, 1980. Instead of being a street dance, they will have it
outside the hall at Riverside Park, sell beer and have consession stands, and
they also would like to use Fireman's Park the following day for a pancake
breakfast. The J C's will have their own policing.
Motion by Alderman Metzser to grant permission for the Laurel JC's to use
Riverside Park for a dance on the night of July 3rd and also to use Firemen's
Park on July 4th for a pancake breakfast. Seconded by Alderman Meyers. Carried.

This being th~ time and place advertised, bids w~re opened and read aloud
follows:

Cashier's check enclosed for bid bond in the amount of $348.80.
Midwest Fence Company $4,495.00

Bid Bond attached for 10% of the bid.
Motion by Alderwoman Carter to accept the low bid, with the assumption
that labor is included, and award it to Frontier Fence Co. in the amount of
$3,488.00. Seconded by Alderman Meyers. Carried.

Bid Opening--Used water truck for Fire Department.
This being the time and place advertised bids were opened as follows:
One bid was received from Cenex in the amount of $13,500.00
Bid bond attached in the amount of 5% of the bid.
Farmers Union Central Exchange, d/b/a Cenex, market price is $16,226.15.
They will donate the difference of $2,726.15 ~ontingent upon acceptance of the
bid.
Motion by Alderman Meyers to accept the Cortex bid in the amount of
$13,500.00, payable out of next year's budget. Seconded by Alderman Metzger.
Carried.
i Don Meyers~--Long John Strong Circus~Wanted to know if anyone was opposed
to having the same circus in town as last year, provided a city license is
purchased and a proof of insurance is filed with the City. This would be held
at Thompson Park, with dates yet to be determined.
Motion by Alderman Metzger to grant permission for Long John Strong Circus
to have a two (2) day show at Thompson Park, provided the city license and
insurance requirements are met. Seconded by Alderman Burns. Carried.
1979-80 Audit Proposal
Irv Metzger presented an audit proposal from Tom Albert, CPA, for fiscal
year 1979-80, in the amount of $4,980.00
Motion by Alderman Metzger to accept the audit proposal from Tom Albert,
CPA. Seconded by Alderman Fink. Motion failed 2 to $. Alderman Metzger and
Fink voting "yes" and Alderman, Ehrlick, Burns, Meyers, Brennan and Carter
voting , "no".
Motion by Alderman Meyers to put th~ 1979-80 audit out for bid. Seconded
by Alderman Ehrlick. Carried with Alderman Metzger and Fink voting "no".
Tom Bradley announced that his son Joe is joining him in his law praeti~e
and that he might be sitting in for him at some of the Council meetings in the
future.
Without any objection from the Council, Mayor Herman appointed Joe Bradley
as Deputy City Attorney, without pay.
The next matter to come before the Council is a discussion of a complaint
that has been filed against Officer Larry Johnson, Police Off~oer~of the City,
it is the Mayor's determination:
1. That the matter of individual privacy is involved.
2. That such privacy demands protection of the individual for the sake of
reputation and otherwise that little, if anything, could be gained by publicly
disclosing the information to be discussed and
3. That the demand of individual privacy in this matter clearly exceeds
the merits of public disclosure.
There being no further business to ~ before the Council at this time:
the meeting was adjourned at 7:35 p.m.
