HomeMy WebLinkAboutCity Council Minutes 05.20.1980Minutes of the City Council of Laurel May 20, -1980 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor Larry D. Herman, at 7:00 p.m., on May 20, 1980. COUNCIL MEMBERS PRESENT: Albert Ehrlick Harold Burns Donald Meyers COUNCIL MEMBERS ABSENT: Duane Behm Bill Brennan Susan Carter Terry Fink Ervin Metzger INVOCATION: Invocation given by Reverend Ferguson. MINUTES: Minutes of the regular meeting of May 6, 1980, approved as presented. CORRESPONDENCE: Received quotation from Modern Machinery regarding financing of the new FMC Model 2-984 Sweeper. Motion by.Alderman Ehrlick to pay for the sweeper on a 3-year installment plan, seconded by Alderman Metzger. Carried. Mayor Herman noted that both Laurel banks were interested in buying the contract from Modern Machinery. JOHN JOHNSON, President of the Laurel Volunteer Fire Department requested permission to hold a fireworks display at Thompson Park on the 4th of July. There was a question regarding liability insurance, because the City policy does not cover fireworks displays. Mr. Johnson mentioned that there was an insurance coverage available for $125.00 of which they are considering. Motion by Alderman Metzger to grant permission for the Laurel Volunteer Fire Department to hold a fireworks display on July 4, 1980, seconded by AIderman Ehrlick. Carried. Requested permission for two men to attend the State convention. Permission was granted without any objection (since this was in the budget, no motion was necessary). Requested the City Council's endorsement for holding the 1981 State convention in Laurel. The Mayor and City Council extended their endorsements without any objections. DAVE POWERS, Fire Chief, discussed agreements with Fire District No. 5 and No. 7. The committee has recommended that we keep the same dollar amount as last year. Motion by Alderman Fink that we keep the contract with Fire District No. 5 and No. 7 at the same level as last year, seconded by Alderman Burns. Carried. RESOLUTION NO. 1784 AGREEMENT WITH FIRE DISTRICT NO. 5 Motion by Alderman Fink that Resolution No. 1784 be passed and adopted, seconded by Alderman Burns. Carried. page 2 Minutes of the City Council of Laurel RESOLUTION NO. 1785 AGREEMENT WITH FIRE DISTRICT NO. 7 Motion by Alderman Fink that Resolution No. 1785 be passed and adopted, seconded by Alderman Burns. Carried. As you may know Park City called~us last month because they were in need of some water and we sent a tanker up with one truck to help them out at no expense to the City. We thought it would be good to have a mutual aid agreement with Park City to cover us for liability reasons and to be a good neighbor. They are in favor~to such an agree- ment, so we had a contract drawn up like the one we have with the Bil- lings Fire Department, Yellowstone Boys Ranch, and Cenex Refinery. I request that the Council approve such a contract. Motion by Alderman Ehrlick to approve a mutual aid contract with Park City Volunteer Fire Department and to give the Mayor authority to sign this contract, seconded by Alderman Meyers. Carried. RESOLUTION NO. 1783 AGREEMENT FOR MUTUAL AID IN FIRE PROTECTION (PARK CITY) Motion by Alderman Ehrlick that Resolution No. 1783 be passed and adopted, seconded by Alderman Meyers. Carried. FIRE COMMITTEE: We took on Fire District No. 7 last year on a one- year tr~a~is with the equipment we have. We are about 5 miles from the farthest point and our water supply is hauled by a 6x6o We did not know whether it was going to work or not and we have had some problems. We already chipped a tooth off of one of the gears. Cenex Transportation Co. just bought 30 new units and now they are selling their used trucks. They have a 1974 Kenworth with a 4,000 gallon tank for $13,500 and it would take another $3~000 to put it into service. Mr. Powers would like to put this into next years budget and also look at the possibility of a lease/purchase. The City Attorney will review the legal aspects of a lease/purchase. Motion by Aldert Ehrlick to give authority to review the feasibility of leasing the truck, seconded by Alderman Meyers. Carried. BID OPENING -- STREET MATERIALS: This being the time and place advertised, bids received were opened and read aloud as follows: Mossmain Industries $36,475.00 William Krug & Sons 35,150.00 Bids were referred to the Maintenance Director and City Engineer for review and to make a recommendation at the next regular council meeting. ALBERT EHRLICK -- GARBAGE COMMITTEE: There was some discussion regarding the proposed commercial garbage rates. RESOLUTION NO. 1782 ESTABLISHING COMMERCIAL GARBAGE RATES FOR THE YEAR 1980. page B Minutes of the City Council of Laurel Motion by Alderman Ehrlick that Resolution No. 1782 be passed and adopted, seconded by Alderman Meyers. Carried. ORDINANCE NO. 681 ESTABLISHING GARBAGE REGULATIONS AND SETTING GARBAGE FEES FOR RESIDENTIAL AND COMMERCIAL ESTABLISHMENTS FOR THE YEAR 1980. Motion by Alderman Fink that Ordinance No. 681 be passed and adopted, seconded by Alderwoman Carter. Upon taking a roll call vote, all aldermen present voted "yes." City Clerk's and City Treasurer's April Financial Statements were presented for approval. Motion by Alderman Metzger to approve the Clerks' and Treasurers' Financial Statements as presented, seconded by Alderwoman Carter. Carried. DANIEL JUHL - NUTTING BROTHERS SUBDIVISION: The City received a petition from residents in Nutting Brothers Subdivision for a zone change from RLMF to R7500 single family dwellings. The petition was referred to the Laurel-Yellowstone City-County Planning Board for recommendation. There was also discussion regarding when the City is going to pro- vide garbage service to this area. There is one residence being cur- rently serviced by D & F Sanitation and since the B-year limitation will be up in July they would like service to begin at that time. A petition was turned in {refer to minutes of 1/15/80) signed by all residents except one. It was suggested that a letter be written to D & F Sanitation notifying them of the City's intentions. SUE CARTER -- TENNIS COURTS: Requested that bids be advertised for a fence at the tennis courts. Motion by Alderman Meyers to advertise for bids, fence for the tennis courts at Thompson Park, seconded by Alderman Metzger. Carried. There being no further business to come before the Council at this time, the meeting was adjourned~:O0 p.m. ~Don~ L.
