A regular meeting of the City Council of the City of Laurel,
Montana~ was held in the Council Chambers and called to order by
Mayor Larry D. Herman, at 7:00 p.m., on February 5~ 1980.

INVOCATION: Invocation given by Reverend Wilhelm.
MINUTES: Minutes of the regular meeting of January 15, 1980, approved
as presented.
CORRESPONDENCE: Received a letter from the Montana League of Cities
and Towns regarding a collective bargaining workshop in Billings on
March 31, April 1, and 2.
Received a letter from Mouat and Martinson, Attorneys for Mr. &
Mrs. David Johnston, regarding Sweeping District tax paid under protest.
The letter was referred to the City Attorney.
A petition to have South 5th Avenue removed from the Sweeping
District was received from David & Joyce Johnston and entered into the
record on December 4, 1979. This petition was referred to the Street
and Alley Committee, and at their meeting on December 11, 1979, went
on record as being opposed to such a removal. These minutes were entered
into the record on December 18, 1979.
CLAIMS: See "Items Released for Payment" register.
Motion by Alderman Meyers to pay claims for January, 1980, seconded
by Alderman Ehrlick. Carried.
PUBLIC HEARING - EMERGENCY BUDGET (SEWER FUND): This being the time
and place advertised, a public hearing was held.
No opposition expressed from the public.
Some discussion by council members.
Motion by Alderman Fink to adopt the Emergency Budget in the Sewer
Fund in the amount of $15,000.00 for about 800 feet of Nutting Sewer
Replacement, seconded by Alderman Meyers. Carried.
INEZ VAUGHN: RSVP has invited the Mayor, Council and spouses to a
Valentines Dinner at the Senior Citizens Center at 6:00 p.m., on
February 14, 1980. Please let the City Clerk know by February 8th
so they will know how many plan to attend.
She also wanted to know what could be done about all the poles and
wires in back of her house. It was suggested that she contact the utility
companies.
MAYOR'S COMMENTS: Reminded the Council of the Special meeting on
February 12th regarding the hearing on SID 103.
Also of a meeting on February 7th regarding the County-wide Gas Tax
proposal.

The Mayor proposed several ordinances. Discussion followed.
ORDINANCE NO. 674
ANNEXATIONS
Motion by Alderman Fink that Ordinance No. 674 be passed and
adopted, seconded by Alderman Brennan. Upon taking a roll call vote,
all aldermen present voted "yes."
ORDINANCE NO. 675
UTILITIES AND LOT IMPROVEMENTS
Motion by Alderman Ehrlick that Ordinance No. 675 be passed and
adopted, seconded by Alderman Meyers. Upon taking a roll call vote,
all aidermen present voted "yes."
ORDINANCE NO. 676
BUILDING PERMITS REGARDING SUBDIVISIONS
Motion by Alderman Meyers that Ordinance No. 676 be passed and
adopted, seconded by Alderman Behm. Upon taking a roll call vote,
all aldermen present voted "yes."
ORDINANCE NO. 677
STREETS
Motion by Alderman Ehrliek that Ordinance No. 677 be passed and
adopted, seconded by Alderman Brennan. Upon taking a roll call vote,
all aldermen present voted "yes."
DUANE BEHM: Reported that he has reviewed the 6-month budget report
for this fiscal year and it appears that most departments are fairly
close to 50% of their budget. A more detailed review will be made by
the next regular council meeting.
TOM BRADLEY - FIRE DISTRICT #5: There is a problem with the Fire
District north of town. Approximately 38 homeowners were taxed in
1979 for Fire District No. 5 and they are in the eity.
A list was submitted to the County in the latter part of November,
but this was too late to be taken off the tax rolls.
The fire district is created outside the city's jurisdiction and
the city has nothing to do with it. Once the boundaries are set by
the County Commissioners then it takes action by the County Commissioners
to take the people out of the district.

want this property dropped from the assessment rolls." However, this
must be done before the 1st of March or it will appear on the tax
assessments.
The 1979 assessment was included in the first half payment, then
the county refunded it, and then determined that this was wrongfully
done and turned around and re-billed the people which is to be included
with their seeond half payment in May.

This problem is not the city!s responsibility; however, it was
referred to the Police & Fire Committee to try and work out some type
of solution. They will try to set up a meeting with the trustees of
the district and also with the County Clerk & Recorder and then report
baek to the Council with their recommendations.
There being no further busines~-~r~come before the Council at this
