January 15, 1980
A regular meeting of the City Council of the City of Laurel, Montana,
was held in the Coumcil Chambers and called to order by Mayor Larry D. Herman,
at 7:00 p.m., on January 15, 1980.
COUNCIL MEMBERS PRESENT: Albert Ehrlick Bill Brennan

COUNCIL MEMBERS ABSENT: Ervin Metzger
INVOCATION: Invocation given by Reverend Holt.
MINUTES: Minutes of the regular meeting of January 8, 1980, approved as
presented.
CORRESPONDENCE: Received a letter from Jim Straw of the Board of County
Commissioners advising the Mayor of a meeting on January 16, 1980, regarding
the feasibility of initiating a two-cent gasoline tax referendum for street
repairs. The Mayor requested that as many council members as possible attend
this meeting also.
Received a notice of preapplication review action from DOT, FAA, Rocky
Mountain Region, Airports Division, stating that we have reviewed your pre-
application for Federal assistance under Airport Development Aid Program and
have determined that your proposal is eligibie for funding by this agency and
can compete with similar applications from other grantees.
Therefore, we suggest that you file a formal application with us by
March 3, 1980.
Based upon the funds available for this program over the last two fiscal
years and the number of applications reviewed, or pending, we anticipate that
funds for which you are competing will be available after March, 1980. You
requested $211,600.00 Federal Funding in your preapplication form, and we are
agreeable to consideration of approximately this amount in the formal applica-
tion. A preapplication conference will not be necessary.
Motion by Alderman Ehrlick to compiete the formal application to FAA,
seconded by Alderman Meyers. Carried.
Motion by Alderman Ehrlick to retain HKM Assoc. as engineers for the
airport project, pending approval of the grant.
Received a report from the Laurel Reserve & Auxiliary Police stating the
hours each individual worked during the 4th quarter, 1979.
NUTTING BROTHERS SUBDIVISION -- PETITION FOR GARBAGE PICKUP: Received a
petition from all residents except one, requesting City of Laurel garbage
service. Since this area is now being serviced by a private carrier, the
petition was referred to the city attorney for a legal opinion.
ORDINANCE NO. 673
BEING AN ORDINANCE PROHIBITING THE DEPOSITING
OF GARBAGE, TRASH, AND WASTE IN MUNICIPAL CON-
TAINERS BY OUT OF CITY RESIDENTS.
Motion by Alderman ENrlick that Ordinance No. 673 be passed and adopted,
seconded by AIderman Meyers. Upon taking a roll call vote, all aldermen
present voted yes.

SID 103: John Mohr asked the council to consider a resolution declaring their
intent to create SID 103.
Basically the ~reas that will be affected are the city lots in Murray
Heights, Malit Subdivision, parts of Laurmac, Casa Linda, with the exception
of Block 4, and Willow Creek, also parts of Mountain View Subdivision.
Dave McCullough of HKM Assoc. presented the District Boundary and maps
in more detail and explained the project costs and the work to be done, such
as pavement, curb and gutter where non-existent, water and sewer service
stubbed into vacant lots, and subsurface drainage in the Willow Creek Sub-
division. Discussion followed -- mostly regarding property which is in the
city abutting property in the county. The city does not want to pave just
haif a street. There was a question as to the possibility of creating a
RSID in areas where city and county property are involved with SID 103.
Terry Fink will try to set up a meeting with the County Commissioners to dis-
cuss this problem.
RESOLUTION NO. 1773
A RESOLUTION DECLARING IT TO BE THE INTENTION
OF THE COUNCIL OF THE CITY OF LAUREL, MONTANA,
TO CREATE SPECIAL IMPROVEMENT DISTRICT NO. 103
DESIGNATING AND DESCRIBING THE NUMBER AND
BOUNDARIES OF SAID DISTRICT, STATING THE GENERAL
CHARACTER OF THE IMPROVEMENTS WHICH ARE TO BE
MADE THEREIN, THE APPROXIMATE ESTIMATED COST OF
SAID IMPROVEMENTS, AND THE TIME WHEN AND THE
PLACE WHERE THE COUNCIL OF THE CITY OF LAUREL,
MONTANA, WILL HEAR AND PASS UPON ALL PROTESTS
OF THE MAKING OF SAID IMPROVEMENTS AND THE
CREATION OF SAID DISTRICT.
Motion by Alderman Fink that Resolution No. 1773 be passed and adopted,
seconded by Alderman Meyers. Carried.
Permission was granted by the Council for Dave McCullough and Larry Herman
to write a joint letter to bonding companies to solicit their opinion as to
whether or not an $850,000.00 bond issue can be sold some time in March (a
letter was sent to Boettcher & Co. of Denver and D. A. Davidson in Billings).
DON MEYERS -- PUBLIC UTILITIES COMMITTEE: Presented the minutes of the meeting
on January 9, 1980. Mr. Meyers indicated that an emergency budget is needed
to replace approximately 800 feet of sewer line in Nutting Brothers Subdivision.
RESOLUTION NO. 1774
BEING A RESOLUTION DECLARING AN EMERGENCY EXISTS
REQUIRING ADDITIONAL EXPENDITURES FROM THE SEWER
FUND AND DIRECTING PUBLICATION OF NOTICE OF A
PUBLIC HEARING.
Motion by Alderman Meyers that Resolution No. 1774 be passed and adopted,
seconded by Alderman Fink. Carried.
Motion by Alderman Behm that the minutes of the Public Utilities Committee
meeting of January 9, 1980, be entered into the record, seconded by Alderman
Brennan. Carried.
Permission granted to Bob Burns to leave the state.

MAYOR'S COMMENTS: Received a letter of resignation from the Chief of Police,
Don Lenhardt, and also requesting that he be reinstated as Sergeant.
Motion by Alderman Fink to accept Don Lenhardt's resignation as Chief
of Police and to reinstate him as Sergeant, seconded by Alderman Meyers
Carried. ·
There being no further bufin~.~s to come before the Council at this time
