10.16.010 ~peed Limits.A.A person operating or driving a
vehicle of any character on a public highway of this municipality
shall drive it in a careful and prudent manner~ and at a rate
of speed no greater than is reasonable or proper under the con-
ditions existing at the point of operation~ taking into account
the amount and character of traffic, condition of brakes, weight
of vehicle, grade and width of highway, condition of surface,
and freedom of obstruction to view ahead, and he shall drive it
so as not to unduly or unreasonably endanger the life, limb,
property, or other rights of a person entitled to the use of the
street or highway.
B. Where no special hazard exists that requires lower speed
for compliance with paragraph A of this section, the following
speed limits shall apply to streets in the municipality, except
for those streets or parts of streets where the limits have been
altered in Section 10.52.010:
1) Fifteen miles per hour in any school zone. For the
purpose of this section~ "school zone" shall mean that part of
any street which runs
building. The street
placed no closer than
directly adjacent to any public school
signs posting this speed limit shall be
one-half block to the beginning of the
school zone;
2) Twenty-five miles per hour in any urban district;
3) Thirty-five miles per hour on any streets under construc-
tion or repair;
4) Fifty-five miles per hour in other locations during the
nighttime, except that the nighttime speed limit on completed
sections of interstate highways is sixty-five miles per hour.
"Daytime" means from a half~hour before sunrise to a half-
hour after sunset. "Nighttime" means at any other hour.
5) Whenever the municipality shall determine, upon the
basis of an engineering and traffic investigation, that any
speed provided in paragraph 3 of this section is greater or
less than is reasonable or safe under the conditions found to
exist upon a highway or part of a highway, the municipality may
d~termine and declare a reasonable and safe speed limit thereat
which, when appropriate signs giving notice thereof are erected,
shall be effective at all times or during hours of daylight or
darkness or at such other times as may be determined for such
highways or parts of highways.
No alteration of any state speed limits declared by the
municipality shall be effective unless such alteration is authorized
by S 61-8-410 of the Montana Code Annotated. Sueh declared speed
limit may be specifically indicated in Chapter 10.52 of this code,
but a failure to include the speed limits in that chapter shall
not affect the validity of such limits.
6) The driver of every vehiele shall consistent with the
requirements of subseetion 1, drive at an appropriate reduced
speed when approaching and crossing an intersection or railway
grade crossing, when approaching and going around a curve, when
approaehing a hill crest, when traveling upon any narrow or winding
roadway, and when special hazard exists with respect to pedestrians
or other traffic or by reason of weather or highway condition.
