ATTORNEY FOR SPECIAL IMPROVEMENT DISTRICTS
BE IT ORDAINED by the Council of the City of Laurel,
Montana, that there is hereby added to the Laurel Municipal
Code C~apter 11.60 as follow~ :
Section 11.60.010 Appointment of Attorney The Mayor,
with the approval of the City Coun¢il~ shall appoint an
attorney, group of attorneys, a professional legal corporation,
or the City Attorney to perform services of a legal nature
for every Special Improvement District proposed and created.
Section 11.60.020 Duties It shall be the duty of the
attorney for the Special Improvement District to see to the
completion of all proceedings required in formation of a
district. It shall be the duty of the attorney to draft or
supervise the phraseology of any contract, ordinance, resolu-
tion~ bond, or other documents or instruments necessary to
the Special Improvement District. It shall be the duty of
the attorney to represent the district in litigation affecting
the district.
Section ll.60.OBO Advice The attorney shall be the
legal advisor of the Special Improvement District, and shall
render advice in ali legal questions affecting the City and
district, whenever requested to do so by the Mayor or by the
City Council. Upon request by the Mayor or the City Council,
he shall reduce any such opinion to writing. In addition,
the attorney shall prosecute and litigate any claim or action
the Special Improvement District may have arising out of any
contract for services or contract for construction necessary
to completion of the special improvements.
Section 11.60.040 Compensation 1) The attorney shall
receive such compensation as may be authorized by the City
Council. Such compensation shall not exceed five per cent (5%}
of the first fifty-thousand dollars ($50,000.00) of the dis-
trict's bond issue and two per cent (2%) of the bond issue in
excess of fifty-thousand dollars ($50,000.00), except that it
shall not be less than one-thousand dollars ($1,000.00};
2) The usual duties of the City Attorney do not include Special
Improvement District proceedings. If the City Attorney is
appointed to serve as the attorney for a Special Improvement
District he may receive such additional compensation as may
be authorized by the City Council, except that it shall not
exceed the amount set forth in paragraph one of this section.
