HomeMy WebLinkAboutCity Council Minutes 06.04.2013 MINUTES OF THE CITY COUNCIL OF LAUREL June 4, 2013 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor Ken Olson at 6:30 p.m. on June 4, 2013. COUNCIL MEMBERS PRESENT: Doug Poehls Mark Mace Scot Stokes Chuck Dickerson Bill Mountsier COUNCIL MEMBERS ABSENT: Emelie Eaton Bruce McGee Tom Nelson OTHER STAFF PRESENT: None Mayor Olson led the Pledge of Allegiance to the American flag. Mayor Olson asked the council to observe a moment of silence. MINUTES: Motion by Council Member Dickerson to approve the minutes of the regular meeting of May 21, 2013, as presented, seconded by Council Member Mace. There was no public comment or council discussion. A vote was taken on the motion. All five council members present voted aye. Motion carried 5 -0. CORRESPONDENCE: None. PUBLIC HEARING: None. CONSENT ITEMS: • Claims for the month of May 2013 in the amount of $236,391.60. A complete listing of the claims and their amounts is on file in the Clerk- Treasurer's Office. • Approval of Payroll Register for PPE 05/26/2013 totaling $138,573.43. • Receiving the Committee Reports into the Record. -- Budget/Finance Committee minutes of May 21, 2013 were presented. -- Public Works Committee minutes of May 13, 2013 were presented. - -Park Board minutes of May 16, 2013 were presented. -- Council Workshop minutes of May 28, 2013 were presented. - -Tree Board minutes of April 18, 2013 were presented. SCHEDULED MATTERS: • Confirmation of Appointments. • Resolution No. R13 -27: Resolution relating to Special Improvement District No. 115; Declaring it to be the intention of the City Council to create the District for the purpose of undertaking certain local improvements and financing the costs thereof and incidental thereto through the issuance of Special Improvement District Bonds secured by the City's Special Improvement District Revolving Fund. Motion by Council Member Poehls to approve Resolution No. R13 -27, seconded by Council Member Dickerson. There was no public comment or council discussion. A vote was taken on the motion. All five council members present voted aye. All five council members present voted aye. Motion carried 5 -0. • Resolution No. R13 -30: A resolution of the City Council authorizing the Mayor to sign renewal agreements with Blue Cross Blue Shield of Montana, Delta Dental and VSP for the provision of the Employee Health Insurance Program. Motion by Council Member Stokes to approve Resolution No. R13 -30, seconded by Council Member Mace. There was no public comment or council discussion. A vote was taken on the motion. All five council members present voted aye. Motion carried 5 -0. • Resolution No. R13 -31: A resolution approving an agreement between the City of Laurel and the City of Billings relating to solid waste disposal. Motion by Council Member Mountsier to approve Resolution No. R13 -31, seconded by Council Member Dickerson. There was no public comment or council discussion. A vote was taken on the motion. All five council members present voted aye. Motion carried 5 -0. • Laurel Rifle Club's request to use the outside small bore shooting range at Riverside Park for the Big Sky State Games on Saturday, July 20, 2013, from 7:00 a.m. to 5:00 p.m. Motion by Council Member Mace to approve the Laurel Rifle Club's request to use the outside small bore shooting range at Riverside Park for the Big Sky State Games on Saturday, July 20, 2013, from 7:00 a.m. to 5:00 p.m., providing that the written protocol and proof of adequate insurance are provided, seconded by Council Member Mountsier. Iry Wilke, 1017 Seventh Avenue, stated that he provided the required documents today. The protocol is similar to the one provided for the recent trap shooting event, with changes made to the things pertaining to this event. A schedule provided showed when the two separate disciplines are scheduled. The first one is a NRA prone discipline where all the shots are from the prone position. The other one is a three position discipline shot at different distances. Iry provided the insurance 2 Council Minutes of June 4, 2013 information for the Laurel Rifle Club and an email regarding insurance coverage for the Big Sky State Games. Council Member Mace asked regarding the map (a copy is attached) of the small bore shooting range. Iry explained that the covered area has a series of orange dots, which are the firing points where the competitor shoots at the two orange lines that that go north and south. The first orange line is the 50 -yard line for one discipline and the other orange line is the 60 -yard line for the second discipline. The dotted orange line designates the bottom of the berm at the 100 -yard line. The dotted line across the south perimeter shows where a safe zone will be designated. He does not know how many competitors will participate, but it could be as many as sixty. Steve Krum and Darrell Johnson will ' run the program and will try to enlist volunteer help from Billings to assist. The Small Bore Rifle Prone event starts at 9:30 a.m. and the Small Bore Rifle 3- Position event starts at 12:30 p.m. There are 65 firing points, but there might not be enough target stands so the competition might be run in relays with ten or fifteen shooters at a time. COMMUNITY ANNOUNCEMENTS (ONE- MINUTE LIMIT): None. COUNCIL DISCUSSION: • Review of Monthly Reports: Police, Fire, Ambulance, and Code Enforcement: None. Council Member Mace stated that someone asked him what is happening at the refinery and why it is so loud. Mayor Olson stated that he could not speak for the refinery, but the loud noise is often when work is done on the furnaces. They replace the mortar in the furnaces and have to allow for a drying time, so they force air through without a fire to dry the mortar. Council Member Dickerson expressed concern regarding the potholes in heavily populated areas that are progressively getting bigger and causing drivers to dodge them into other lanes of traffic. Mayor Olson stated that the city is prioritizing the potholes as quickly as possible. He encouraged council members to have constituents call the Public Works Department at 628 -4796 to report a pothole and have the secretary put the information on a work order. Maintenance Superintendent Matt Wheeler then prioritizes the list for the city crew. Council Member Mace stated that calling the Public Works Department would get the information to them faster than stating it at a council meeting. He suggested that the phone number to report potholes should be included in the next newsletter. Mayor Olson agreed and asked the newspaper to include the phone number in the report of tonight's council meeting. He will see that the information is included in the next city newsletter. Council Member Mountsier stated that a constituent contacted him regarding issues with the garbage cans that sit behind Mabel's. He spoke regarding the liability issues and suggested that the garbage cans should be moved to a more suitable location, as the garbage sometimes blows into the neighbors' yards. Mayor Olson explained that he spoke with the constituent when he was giving the complaint to the Public Works Department. The Public Works is aware of the situation and is trying to find the best way to resolve it. Mayor Olson spoke regarding today's video conference call with Senator Tester. During the call, Senator Tester was informed of the city's issues with the river and the need for assistance from his staff to help Laurel resolve the issues with the permitting agencies and the funding agencies to find an answer for the two problems at the river. The first issue is the bank restoration on the south bank 3 �/l , Council Minutes of June 4, 2013 and the second issue is the long -term solution for the water intake. Senator Tester is aware of both issues and asked the city to inform him of any issues with the permitting or the regulatory agencies. Mayor Olson stated that it was a very productive meeting. Mayor Olson announced his official statement that he will not seek reelection for Mayor. He expressed appreciation for the opportunity to serve the people of the City of Laurel, and stated that he has been blessed to serve on the council and with all those who served on the council during his tenure. He appreciates those who have decided to seek reelection. Mayor Olson stated that Laurel is an exciting community and there is a lot going on in the City of Laurel. UNSCHEDULED MATTERS: None. This event would be shot on the outdoor 100 yard covered range located in Riverside Park, Laurel on July 20 2013. This event starts shooting at 0930 AM for the first of two disciplines. First discipline is called the NRA Prone event. The second discipline is a three position event where as the competitor shoots from a prone, kneeing, and standing positions. The second event starts shooting at 12:30PM and should be concluded by 5:00 PM. The small bore prone event is a 50 shot 50 yard course of fire. The three position event is a 60 shot 50 yard course of fire. Big Sky State Games itself provides liability insurance and require all competitors to also have insurance. The city of Laurel will be listed on the insurance for this event. An email from the State Games office is attached to this request with a copy of Laurel Rifle Clubs insurance as requested by Laurel City Council. Shoot competition State Games Special Small Bore Event 2. Rules of National Rifle Association Small Bore 3 position, and Prone 3. Laurel Rifle Club members run the event, and a range safety officer will be assigned. 4. Range officer will maintain control of coming and leaving shooters plus the range perimeter. 5. This match is offered to provide opportunities for State wide competitors to compete. 6. The range officers' duties are to patrol the perimeter of the club grounds and the range. 7. The range officer will maintain visual on all participants as to firearms handling from vehicle to range and placement of firearms into racks. Range officer will be identified by a blaze orange cap. Range out Line 1. Orientation of the range /firing line is set NRA Small Bore standards as laid out by concrete walk way and covered firing points. 2. Spectators are at or near ready area of the range. Benches used by shooters and on lookers as well. 3. Fall out is out to 100 yards beyond the firing line. 4. There will be no cleaning of firearms on the range or ready area during the event. 5. A map of the range shooting area to be attached. SAFE FIREARMS HANDLING RULES 1. ALWAYS POINT YOUR FIREARM IN A SAFE DIRECTION. 2. ALWAYS TREAT ALL FIREARMS AS IF THEY WERE LOADED. 3. ALWAYS KNOW YOUR TARGET AND BEYOND. SIGHT SPECIFIC RANGE RULES 1. Always Treat all firearms as if they are loaded. 2. Always keep actions open except when ready to fire. 3. Always keep firearm muzzle pointed in a safe direction. 4. Always be sure of your back stop. 5. Always know your firearm and ammunition. 6. Eye and hear protection is required by all shooters on the firing line. 7. Always be sure of your target. 8. NEVER MIX firearms and alcohol. 9. INSTANTLY OBEY ALL FIRING LINE COMMANDS. 10. Any shooter may call a cease fire if an unsafe condition exists. FIRING LINE COMMANDS called be chief range officer 1. Competitors are told that they are required to have their own insurance. We gladly list the City of Laurel as additionally insured on the policy for events on city property.
