ORDINANCE 719
AN ORDINANCE ANNEXING TRACT 1-B,
CERTIFICATE OF SURVEY NO. 2147
WHEREAS, a petition in writing has been presented to
the City Council requesting annexation of Tract 1-B, Certificate
of Survey No. 2147, Yellowstone County, Montana;
WHEREAS, the area to be annexed meets the requirements of
Sections 7-2-4734 and 7-2-4735, MCA;
WHEREAS, the City can provide the services to the area as
set forth in the report required by Section 7-2-4731, MCA;
The City Council of the City of Laurel does ordain as
follows:
a. That Tract 1-B, Certificate of Survey No. 2147,
Yellowstone County, Montana, is hereby annexed to the
corporate limits of the City of Laurel;
b. That the map of the City of Laurel be amended to
reflect the annexation of said tract;
c. That a Waiver of Protest of special improvements be
filed by the owner of said tract and that the annex-
ation become effective upon the filing of the Waiver
and a Certified Copy of this Ordinance with the Clerk
and Recorder of Yellowstone County.

Passed by the City Council of the City of Laurel, on October
19, 1982.
Approved by the Mayor on October 19,1982.

RECOMMENDATION TO THE
LAUREL CITY COUNCIL
Gentlemen:
Please take notice .that at a meeting of the Laurel-Yellowstone
City-County Planning Board held September 16, 1982, the Board
makes the following recommendation regarding GEL Properties
requested annexation of Tract 1B, C/S 2147:
We recommend that this property be annexed; however,
the City should ask for the additional 20' right-of-
way and 1/9th park dedication.

John MacMartin, Cumin Associates, Billings
Minutes of previous meeting approved as corrected. Bills
approved for payment: Cumin Associates, Planning Advisory
Services for July, August & September, 1982, as per contract
in the amount of $3,375.00;.Montana Dept. of Commerce for six
subdivision, planning & surveying books; Engineering Department
in the amount of $400.00 for Administrative Services in August
and September.
GEL PROPERTIES: Annexation request referred by the Laurel
City Council. C/S 2147 displayed and discussed by John Mac-
Martin. This property has already been zoned RMF. Tract 1B is
requested to be annexed. Larry Peterson, City Engineer, and
John MacMartin studied the annexation report. Special
consideration should be given to park dedication, probably
in cash. Also additional right-of-way on 8th Avenue should
be addressed. It shows as a major collector in the Transpor-
tation Plan. No other dedication of 80' row has been done
along 8th Ave. Discussion. Everything else seems to be in
order. This will be elderly housing similar to Meadowlark
and Laurel Gardens. He could rent them for low income housing,
if enough elderly did not apply. This is subsidized rental
property for the next 30 years, with FmHA financing. 1/9th
park dedication would be approximately $2,000 at $10,000/acre.
Utilities are privately owned, parking lot is private, entrance
road is private.
Motion from Ken Christian to recommend that this property
be annexed; however, the City should ask for the additional
20' right-of-way and 1/9th park dedication, seconded by R. M.
Williams. Carried with Bradley, Shay and Christian voting,
"No," because the developer was not present at this meeting.

PROGRESS REPORT FROM JOHN MAC MARTIN:. John MacMartin's
professional services for the last quarter included:
1) Dealing with gravel pit "park" next to Village Subdivision.
2) Research for City regarding SIDs and RSIDs namely regarding
Beartooth Drive.
3) Research regarding flood plain administration.
4) Met with BN regarding Nutting Drain and trying to reactivate
same.
5) Gel Properties paperwork (Sprucegrove).
6) Correspondence regarding "601" projects.
7) Meetings regarding Village Subdivision.
8) Airport research.
9) Closed out "601" landfill grant, research solid waste.
10) Economic development for Chamber of Commerce in Billings,
as they are trying to promote Laurel.
Secretary directed to write a letter to the, Laurel Chamber
of Commerce regarding parking in the CBD.
Correspondence from the County Attorney's office regarding
Roger Anderson. John MacMartin will answer the letter.
AIRPORT: Discussion. A revised map will be forthcoming.
Discussion of solid waste steam plants. The landfill must
still be maintained to dispose of sludge, ashes, etc.
Meeting adjourned at 8:01 p.m.

on September 7, 1982, passed Resolution No. 1938 proposing
to annex Tract 1-B, Certificate of"Survey No. 2147 located
west'of 8th Avenue, Laurel, Yellowstone County,- Montana.
And you are further notified that the City Council of
the City of Laurel, or the Gity Clerk, shall receive protests
or objections, if any, in writing or in person up to and
including the next regular Council meeting after the expiration
of 15 days from the first publication of this notice, said
date being the 5th day of October, 1982:
