COUNCIL CHAMBERS MEMBERS PRESENT: Gerald Shay, Chairman Ed Thurner, City Rep. (arrived at 7:05 pm) Kurt Baltmsch, County Rep. Betty Hart, County Rep. Ziggy Ziegler, County Rep. Laurel Haggart, City Rep. Steve O'Neil, City Rep. OTHERS PRESENT: Cai Cumin, City Planner Cheryll Lund, City Secretary Jim Stevens, Fire and Code Official Bill Maibauer, Aquaneering Joan Torres Ernie Dutton 1 other person, not identified The minutes of the November 2, 2000 meeting were approved as written. PRELIMINARY PLAT: FIGGINS SUBDIVISION - OLD HIGHWAY 10 Bill Maibauer of Aquaneering, Inc. presented the proposed subdivision. This preliminary plat consists of one 9.5529-acre lot being split into 2 lots. One lot will be 2.3122 acres and one lot will be 7.2081 acres. Road access will be off of Figgins Circle, but there is an approved approach offofthe 1-90 access road. Lots will be serviced by a multi-use on-site wastewater system and served by individual water cisterns. There were no opponents present at the meeting. Discussion. Cai suggested the following: 1) SIA paragraph 2A "Letter from a licensed water hauler is attached" needs to be deleted; 2) SIA paragraph J regarding future improvements needs to reflect either construction prior to the final plat or a financing plan for those improvements; 3) All items in the "Declaration of Covenants" need to be in the SIA in order to be enforceable by the City; 4) Topography needs to be added onto the plat; 5) DEQ approval; waiver of protest to include fire hydrants; and roads must meet county standards. Motion by Kurt Baltmsch, second by Betty Hart, to approval the preliminary plat of Figgins Subdivision, subject to the above 5 conditions. Motion carried. PRELIMINARY PLAT - ENTERTAINMENT SUBDIVISION This preliminary plat consists of taking a 5-acre lot and splitting it into 3 tracts. The tracts are within the city limits and the Public Works Department will be involved in the development of the tracts. It will have city services. Cai recommends that 1) a noxious weed maintenance control agreement be rednced in size and included in the SIA; 2) landscaping be extended eastward to cover these tracts and be listed in the SIA. Discussion. Cai also said that the owner needs to take care of the noxious weeds on the undeveloped part of the land; owner agreed. Motion by Laurel Haggart, second by Kurt Baltrusch to recommend approval of the preliminary plat for Entertainment Subdivision subject to the conditions above. Motion carried. DISCUSSION ON PROPOSED CHANGES TO CHILD CARE ORDINANCES There has been confusion in the public works department in regards to people who want to start day care within their home. In reading the ordinances Cai found some inconsistencies within our and would like to re-define the definitions and try to match them to the states defmitions. There are also some other ordinances within Section 17 that need to be "cleaned up" that are incorrect (see attached). Discussion. This item was tabled until the January 4, 2001 meeting to give the bdard more time to read the ordinances. Cai will also look into adult daycare facilities. LETTER TO FISHER AND ASSOCIATES - HIGHWAY 212 PROJECT Cai drafted a letter for the board to send to Fisher and Associates regarding the Highway 212 Project. (See attached letter) The board also requested to be notified of any future meetings regarding this project. Motion by Ed Thumer, second by Laurel Haggart to send the letter to Fisher and Associates. December 7, 2000 HW~ 212 Project Fischer and Associates 2815 Montana Avenue Billings, MT 59101 Dear Fischer and Associates and Project 212 Team: Regarding the planned Rockvale to Laurel Highway Project we would like to provide the following comments: 1. Any new or rebuilt highway must provide for bike lanes on either side. 2. How is access going to be con, oiled? There are multiple accesses onto the highway now, and that is one of the problems. Is there any plan m con~:ol such access or to provide a frontage mad? After the new project is completed, how are requests for new accesses onto the road going to be handled? Will there be a process to address th/s, or w/Il new accesses just be robber-stamped sim/Jar to how they are done now? 3. If a river route is chosen for new coustmctior~ the environmental issues w/Il be paramount and must be addressed in the planning process ahead of design approval. 4. If the new highway is relocated, will the existing highway be closed--especially to commercial mack l~affic? 5. The valley where this roadway is presently located--and the planned rebuild is also located-- is very beautiful. It should be designated a Scenic Highway if possible. If such designation is not possible, prohibitions to additional billboards, unsightly land uses, and such similar blight should be part of the standards applied.
