Tom Nelson called the meeting to order at 5:42.
The group reviewed the minutes from the December 18 meeting. Tom moved that the minutes be
approved as presented. Bill Mountsier seconded. The motion carried.
Tom opened the floor for the Rod and Gun Club to talk about the lease template. Iry reported that the
Rod and Gun Club have given him and Curtis the ability to negotiate on behalf of the group.
Curtis went through each article of the lease template and discussed the Rod and Gun Clubs concerns or
requests They are listed below.
Article 1:
• The lease agreement is for the purpose of the Rod and Gun Club general business, including
monthly meetings, and membership party, turkey shoots and more.
Article 2:
• The identified building for the lease is the log structure located in Riverside Park, also known as
the Rod and Gun Club, along with surrounding ground.
• Suggested cost of lease for a period of 5 Years would be $25 to be paid annually. Payment of
rent includes use of said area identified in lease. Lessee will pay for utilities including, gas,
electric and garbage. If a care taker were to be hired the Rod and Gun aub would contribute to
lawn care costs.
Artide 6:
• Rod and Gun Club assumes the City will be insuring the building against casualty and the Rod
and Gun will be insuring against personal property.
• Rod and Gun Club Assumes City will do all major repairs.
• The question of painting was an issue. There was some discussion. Curtis added that in the past
they have remodeled and repaired areas of the club, including the roof. Rod and Gun would like
to see ADA compliance in the building, specifically the restrooms, once restoration occurs. The
Rod and Gun also expressed the interest in being involved in the restoration discussion because
of their ambitions of seeing certain improvements, specifically the flooring.
Article 7:
• Rod and Gun would not entertain "as is" language until the building were restored.
Articles 9.
• Rod and Gun Ciub agrees to the right of inspection with 24 hour notice.
Article 10
• Rod and Gun Curb would like to add language that includes daily or weekly rentals. Rentals
occurring for 3 days or less would not need prior approval.
Article 12
• liability insurance: currently the Rod and Gun club has $1M policy, they are unsure if their
current insurance is acceptable, the lease template requests $2M aggregate
Article 14: Rod and Gun would like to see clarification of the following items.
• (R) Right of entry already included in Article 9.
• (0) Repairs are already mentioned in Article 6 and the language is contradictory, the Rod and
Gun Club would like to see this language clarified.
Artu le 16:
• Mentions subletting again as mentioned in Article 10, Rod and Gun Club wants to stress that this
is not for short term leasing.
Attic le 17:
• Upon termination of lease, Rod and Gun Club would like to have 30 days prior notice and then
have any hold overs have a penalty of 100 dollars per day. Would lie to drop this to 100 dollars
per month
Iry mentioned that he did not see an "escape clause" or appeal mechanism to end the lease.
Additionally he did not notice or termination timeframe or how it is to be delivered. Iry also believed
that the Rod and Gun club should have the same option to terminate the lease. The group agreed that
the Rod and Gun would be held to the same standards as the City, being a 30 day notice period.
Bill suggested that Iry and Curtis check with their insurance carrier to see if it meets the standard
language of the lease template.
Iry relayed to the group - there is no information to report from the NRA.
Torn summarized the discussion adding that it would be moved forward for consideration once legal
counsel has reviewed the lease and report back to the Rod and Gun Club.
Rill motioned to adjourn the meeting at 6:35. Tom seconded. The motion carried.
