HomeMy WebLinkAboutCity/County Planning Board Minutes 02.14.1991 LAU R £ L -Y£LLO WSTO N E: CITY-COUNTY PLANNING BOARD LAUREL, MONTANA 550,44 February 14, 1991 The Laurel-Yellowstone City-County Planning Board meeting of February 14, 1991, was brought to order at 7:05 p.m. with the following members present: Donna Kilpatrick, City Rep. Joseph M. Bradley, City Rep. Lonnie Kellogg, City Rep. Gerald Shay, Member at Large Donald Gudgell, County Rep. Clarence Foos, County Rep. Members absent: John H. Smith, Chairman Jim Ziegler, County Rep. Russell Bray, County Rep. Others present: Cal Cumin, City Planner Cheryll Lund, City Secretary Linda Kellogg, 918 E. 5th Dick Clayton, 210 7th Ave. Richard Hedman, 1902 Downy Rd. Larry Thomas, 10~% Main St. Motion by Lonnie Kellogg, seconded by Dohna Kilpatrick to approve the minutes of the January 10, 1991 meeting. Motion carried. Motion by Donna Kilpatrick, the Administrative services bill Motion carried. seconded by Don Gudgell, to pay for $200 for February services. Public Hearing- Ordinance to prohibit on premises consumption of alcohol where motor vehicle fuels are sold. No opponents spoke at hearing. Motion by Joe Bradley, seconded by Lonnie Kellogg to close the Public Hearing. Motion carried.6--0. Joe questions whether or not this Ordinance would hold up if someone drags it to court. The State reserves the right to issue a Liquor license to anyone it deems fit. Cal states that this would be a Zoning requirement and the State does let the City sets it's own zoning requirements. The point, according to Joe is how do you distinguish between on-premise consumption and someone that comes in and buys a 6 pack and drinks it in his car on the way home? Gerald Shay wonders what the difference is between having a beer atTown Pump or Sid's. You have to drive to both places to purchase the beer- and drive back home. He feels that you are calling it a Zoning issue and yet are singling out one type of business. How can you let Little Big Men, Locomotive and other business in the area sell beer and let their customers drive off in their cars- and not let Town Pump, because they sell gasoline? Joe says we assume that if they have a couple of beers, fill up their gas tank and drive off, they are intoxicated. He thinks we need hard facts, not assumptions. Clarence Foos asks if anyone could drive to the Kwik Way, purchase a six pack of beer and drink it in the car? Joe says yes, there are some restrictions concerning the open container law, but basically you can. He states that there is no state law in Montana against drinking while you are driving. Laurel has an open container Ordinance against walking down the street drinking a beer, and in some parking lots. Joe says that lack of public interest at tonight's Public Hearing should show the Planning Board that people don't feel that this is an important issue at this time. Motion by Joe Bradley, seconded by Clarence Foos that the Ordinance be tabled indefinately. Motion failed with a 5--1 vote with Lonnie Kellogg voting "No". Because this was not tabled, any member can bring it up at a future date. Applicant's for City/County vacancy on Board. Dick Clayton, 210 7th Ave., introduced himself. He is a retired government employing looking for something to do. in his spare time. He has lived in Laurel for 19 years and would like to be more involved in his community. He would like to see the area progress so that the kids in the community can stay here and find work careers. He was a mine inspector.~ Richard Hedman, 1902 Downy Rd., introduced himself. He is currently working at EMC, has worked with Jim Kraft from the County. He feels he is familiar with mapping, construction, and could lend a great deal to the Planning Board. He would also like to be involved in community affairs. Larry Thomas, 101% E. Main, introduced himself. He is the manager of the Weichert Apartments, and has lived in Laurel for %hree months, and in Yel%owstone County for 5 years. He is a part time auditor for a company. He does do alot of traveling but mainly between the months of November and February. He can pick and choose which "jobs" he wants to take. Page 2 City-County Planning Bd. minutes of Feb. 14, 1991 Billie Lou Lance, an applicant for the County position, was unable to be present. She lives in the south part of Laurel,~ ~ and the general feeling is that the Board needs a representative from this side of town. They would like to see her appointed to the Board. .~ The Board is wondering why they have been asked to screen the applicants, as this has never been ask of them before now. Cal stated that he had suggested that the Board have a chance to meet the applicant's and have a say in the selection. Don Gudgell brought up the project of E. Marylan~ Lane. After a short discussion it was brought up that it will be started again on March 28th. For more details contact the City Engineer. Clarence asked about the stop sign study. The City Engineer is still working on the project. He is going to do a traffic count, and accident report before completing the study and making recommendations. Cal gave a run down of the Legislature action. Cal talked about the possible resurrection of Nutting Drain. It hasn't been in operation for over 20 years, but has caused problems recently. The ditch is over runnigg at a certain point into another ditch and causing flooding. Cal said the county, city, and the railroad are all involved in this and he is hoping that the cost can be split 3 ways. Clarence Foos says he has paid an assessment on Nutting Drain since 1937. A question is raised as to why he has paid taxes on this for so long, when no one in the County Offices says there is a fund for Nutting Drain. Cal will look into this and report back. Don Gudgell mentioned that addressing on North River Road and South River road is very confusing. This is on the very edge of the County and the Fire Service area. Cal says that it has been that way for a very long time. More discussion on confusing addresses. Cai talked about Home Occupation requests. He feels that there should be a place on the form to require signatures from adjacent neighbors, or put a paragraph on that states that they should contact their neighbors as to what they are doing. More discussion on Home Occupations. It is decided that there will be a new space on the Home Occupatin request that says: List adjacent property owners. This will mean that they will have to do a little more leg work for their application. Cal questioned whether or not we should require letters to be sent Registered mail for Special Reviews. The concensus was that they be only sent through regular mail. The meeting was adjourned at 8:15 p.m. Respectfully submitted Cheryll Lurid, Secretary
