March 14, 1991
The City-County Planning Board meeting of March 14, 1991,
came to order at 7:15 p.m., with the following members present:
John Hawley Smith, Chairman
Joseph Bradley, City Rep.
Russell Bray, County Rep.
Lonnie Kellogg, City Rep.
Clarence Foos, County Rep.

Billie Lou Lance, County Rep.

The minutes of the February 14, 1991, meeting were approved
unanimously.
Larry Thomas and Billie Lou Lance, new Board members were
introduced and welcomed.
Cal wants to amend the last meeting's action regarding home
occupation as per #8 on form. So moved and seconded, and passed
unanimously.
John adjourns the meeting and opens the:Public hearing for
the "Windsor Adult Foster Care" special review.
Those present for the Public Hearing are:

Terry Bummer, 1105 W. Maryland

Darla & Brad Greenig, 1007 W. Maryland
Marlane Johnson, 1012 llth Ave.
Randie windsor spoke concerning her "Adult Foster Care" home. The
facility will care for four people, maximum, and is the first level
of care available and provided for the clients who need help
living in a home, but do not need nursing care. Nursing Care is
not part of the license. Clients must be able ~o live by
themselves with minimum care.
The facility is licensed by the State and two employees will help
with the care. The license is good for one year and the County
office which administers the program does make periodic inspections.
The license review rep. is June Collins in Billings- 252-5601.
Randie reads from the document outlining the program, and Joe
Bradley requests a copy to be p~ovided for the Planning Board
record.
Don Gudgell asks about parking. Joe Bradley notes that up to
six vehicles could be at the facility.
Marlene Johnson spoke in opposition. She is concerned about
the amount of parking needed and the kind of clients that would
be housed in the home, such as mentally retarded or handicapped.
She feels that the homes in the area are meant for single families,
and that the modifications made to the home already will now
allow it to be a two family home. She is concerned about the
additional traffic.
Darla Greenig offers Randie parking spaces at her house. She
feels that the facility will be no more damaging than that already
in the neighborhood. Another man (unidentified) also offers
parking space at his adjacent house.
Harold Gremmer questions about what kind of adults will be allowed
to live in the home, and also questions parking and traffic,
Randie states that the people she will house will become part
of her family. She has remodeled the basement for her immediate
family, and the home will be upstairs. She also has plans to
sell a truck that she owns to help with the parking situation.
Two letters of protest (Gremmer and Jansma) are read into the
record.
The Chairman closed the public hearing and re-opened the Planning
Board meeting.
Joe Bradley reads specific statutes dealing with such homes,
from the State codes.
Cai Cumins stated that such facilities are badly needed and
should be in nice residential neighborhoods. This use is allowed
in residential zones but the City has the right to review potential
problem areas and require certain actions.
Cal recommends approval to the City Council subject to:
The area beside the house (there is no garage) be paved
and developed as parking. This must be done prior to
licensing or via some form of binding contract;
2. Clients must be 60 years or older;
3. Approval is to licensee and to address specifically;
4. Subject to licensing by State, and no further hearing
be requested.

Joe Bradley makes a motion, seconded by Billie Lou Lance, that
the City Council hold a second Public Hearing before approving
Windsor's request. Motion carries unanimously.
Joe Bradley makes a motion, seconded by Russ Bray, that the
Board recommend approval of the application, subject to Cal's
recommendations and conditions. Motion carried unanimously.
Randie clarified the title of the home to "Adult Foster Family
Care Home". So noted.
Cal discussed the subdivision bills before the Legislature. There
will probably be a major change in subdivision laws which will
require public hearings andalot of local amendments of local
laws.
Cal discussed potention confusion of not allowing livestock in the
RE-20,000 zone which surrounds Laurel if livestock has not been
on the land for 30 days. This is the way the City ordinance
presently reads.
Lots of discussion. Cal will make some r~medial suggests for
the Planning Board to consider at the next meeting.
The meeting was adjourned at 8:30 p.m..
