A special meeting of the City-County Planning Board was
called to order at 7:00 p.m. on June 27, 1991, with the following
members present:
John Hawley Smith, Chairman
Donna Kilpatrick, City Rep.
Russell Bray, County Rep.
Clarence Foos, County Rep.
Lonnie Kellogg, City Rep.
Don Gudgell, County Rep.
Joe Bradley, City Rep.
Others present:
Cal Cumin, City Planner
Jim Worthington, City Engineer
Bill_4~, Burger King Rep.
A special meeting was called to order to review a submittal
that was presented to the Planning Board for a minor plat review
in November of 1988.
At that time there was a final motion made to require a cement
sidewalk to run along S. First Avenue before the minor plat
was approved. Burger King agreed to go along with whatever
it took to accomodate the City, if possible. But, this meant
that they needed to get approval by the Federal government
to put in sidewalk due to a portion of the property being on
no-access highway right-of-way.
The non-access highway right-of-way runs along the south side
of the property, adjacent to the off-ramp, and on the west
side of the property, approximately 30 feet back from the existing
entrance to the Conoco station. The property owners of the
Conoco station, and Burger King, have an agreement to share
the access that the Conoco station uses.
Jim states that when this proposal was made, there was no
existing curb and gutter in the proposed Burger King area.
Since that time the Highway Dept. came through and put curb
and gutter the north side of the ramp, around the corner, and
to the corner of the Conoco station.
There is no curb and gutter from Taco John's to the north of
the Town Pump. Town Pump put in curb and gutter when they
did their improvements several years ago.
On the east side of First Avenue South there is curb and gutter
& sidewalk from Hardee's to the south side of IGA's parking
lot. There is an open gap, which would be where South 3rd
would be. Then, only curb and gutter runs in front of the
the Exxon station, Terry's Quik Stop to South 4th. Sidewalk
does run in front of the car wash, around to South 4th alley
line. There is no sidewalk on the South side of South Fourth,
but there is curb and gutter in front of the Conoco station.
We are here tonight to clarify how much curb and gutter & sidewalk
the Board wants put in.
Jim states that the curb and gutter that the State put in front
of the Burger King does not abute the Burger King's property.
The State is worried that if ~the sidewalk is put in they feel
it would put people going across the off-ramp from the highway.
They want people walking to Cenex on the west side of Town
Pump.
Joe feels that the Board made a decision to require Burger
King to put in sidewalk, and that we should stick to that
decision. There is sidewalk along most of the East side of
First Avenue South, and he feels it should extend all the way
down First Avenue South.
Cai feels that if they blacktop it to the curb people would
be able to walk along the front of Burger King easily.
Jim feels that the State might have a problem giving permission
for a sidewalk because they do not want to have the responsibility
of liability for people walking by the off-ramp.
Bill R~an from Burger King says that he would have no problem
%;ith putting in a sidewalk or whatever the City wants.
Motion by Joe Bradley, seconded by Lonnie Kellogg, to
amend the motion of November 1988, to read" to require Burger
King to place a 3 foot wide (minimum), unencumbered asphalt or
concrete walkway paralleling the Highway 310 frontage of the
Burger Kings' lot and extending its entire frontageS' Motion
carried unanimously.
