OWS?O N £ CITY-COUNTY PLANNING BOARD November ]2, 1992 The Laurel-Yellowstone City-County Planning Board meeting was brought to order at 7:00 p.m. ~ith the following members present: John Hawley Smith, Chairman Larry Thomas, City Rep. Gerald Shay, Member at Large Jim Ziegler, County Rep. Donald Gudgell, County Rep. Clarence Foos, County Rep. Billielou Lance, County Rep. Joseph M. Bradley, City Rep. Others present: Cal Cumin, City Planner Cheryll Lund, City Secretary Gail & L.D. Collins, 401 Cottonwood Mr. & Mrs. Voehler Suzette, Yellowstone County Surveyor's Office Robin Still, 518 Cottonwood Members absent: Donna Kilpatrick Lonnie Kellogg The minutes of the October 8, 1992 meeting were reviewed, Motion by Billielou Lance, seconded by Gerald Shay, to accept the minutes as written. Motion carried. A bill of $200 for November administrative services was presented. Motion by Billielou Lance, seconded by Don Gudgell to approve the paying of the bill. Motion carried. Yellowstone County Surveyor's Office- Suzette Summers Suzette Summers attended the Planning Board meeting to get some input on signage for Fir and E. 8th. There have been many complaints about no stop sign on the north and south corners of Fir. There is a sight problem due to a mobile home that is placed too close to the corner on Fir. This has been the cause of a recent accident. Suzette feels that the City and County both have their necks out on this corner, if no signage is placed. She recommends stop signs for the north and south bound lanes on Fir Avenue to make 8th Street the thru street. She is waiting for a traffic study, but needs the Board's input within the next week. It is suggested that she contact Albert Ehrlick as he is the Chairman of the Street and Alley's committee. Suzette has worked with Jim Worthington on this matter, and Jim also feels that stop signs should be placed on both sides of Fir. Home Occupation- BKS Sports- Bryan Still- 518 Cottonwood Robin Still was present representing her husband's proposed home occupation at 518 Cottonwood. They propose to sell sports equipment out of their home. They would have only 3 customers per day, and would make sure they would be spaced an hour apart. The goods they sell are ordered out of catalogs and then sent directly to the customer's home. There would be no big trucks making deliveries at the house, only an occasional UPS truck. Joe states that having customer's come to their home and keeping any stock in trade at their house is a direct violation of City Ordinances, and the Board cannot approve it. He wonders if they would be willing to amend the application to read that there would be no customers to the home and no stock. She states that this would definately be considered as it would be easy to take the catalogs to the customer's homes. She states that she will talk to her husband and come in on Friday the 13th to amend the application. Cal recommends approval subject to no traffic or customers coming to the home. Motion by Billielou Lance, seconded by Gerald Shay, to recommend approval of the Home Occupation of Bryan Still, subject to the amendment of no traffic or sales at the home. Motion carried 8--0. Public Hearing to consider definition of Flea markets. The public hearing was opened at 7:30 p.m. L.D. Collins was the only person to speak, and he voiced his opinion in favor of the definition of a flea market that was advertised in the Laurel Outlook. (see attached copy) Discussion. Public Hearing closed at 7:45 p.m. Motion by Gerald Shay, seconded by Don Gudgell that we recommend the definition of a flea market as written in the legal advertisement. Motion carried 7--1 with Joe Bradley voting "NO". Motion by Gerald Shay, seconded by Billielou Lance, recommend no 2nd Public Hearing before the City Council. carried 7--1 with Joe Bradley voting "NO". that we Motion Joe stated that he has had several people complain to him about the storing of unoccupied Camp trailers and R.V.'s. Billings has an Ordinance that prohibits the storage in anywhere but a back yard or a covered garage. He wants some direction as to what the City of Laurel wants to do. After a short discussion it was the general consensus that Laurel not do anything at this time, as the complaints are few and far between. for his tow business. The City has received many complaints about his storing approximately 20 old vehicles on his property, which he promised the Planning Board that he would not do. He has also failed to pay for his Business License. Joe has written one letter to him regarding this and has not received a response. Joe plans to charge him in court in the near future. Ca! stated that the old Boise Cascade building has been sold to another modular home business. Information: Law dictates that no sign other than one giving the name and occupation, and not more than one square foot in area be displayed. Will more than 25 percent of the area of one story of the building be devoted to the home occupation? Will any equipment be used in the home occupation which creates noise vibration, glare, fumes, odors, or electrical interference? Will any equipment or process be used which creates visual or audible interference in any radio or television receivers off the premises? Information , Home Occupations are deemed to be both site specific and owner specific CITY OF LAUREL HOME ACCUPATION REQUEST FOPM Page 2 thus, the use of a portion of a structure as a home occupation will not permit a subsequent owner an automatic home occupation designation. Procedure 1. Complete home occupation request form and submit it to the City seven (7) working days prior to a regularly scheduled meeting of the Planning Board. 2. The Planning Board will consider the request at their regu- larly scheduled meeting. Attendance at this meeting is required by the applicant or his/her representative. 3. The Planning Board will make a recommendation to the City Council that the specific request for a home occupation designation be granted or denied. 4- The City Council will consider the Planning Board's recom- mendation conce inning the specific home occupation designation and approve or deny it at their next regularly scheduled meeting.
