Members absent: Joe Bradley Others present: Pat Mullaney Loretta Metzger Mary Henman CM Cumin and others Public Hearing-Special Review Process The public heating on proposed changes and corrections to the Special Review process (see attached) in the Laurel Zoning Ordinance was opened for public comment; there was none. Gerry Shay feels that the Board should have some leverage on these applications. The Board was told by Cal that we could not deny the applications if they are a use allowed in a district by Special Review--that all we could do is put whatever restrictions we think are necessary on the application. Gerry wants the right to deny the application entirely. Motion by Donna Kilpatrick with second by Gerald Shay to close the public heating; motion carded. Motion by Gerald Shay with second by Billielou Lance to recommend to the Council that the draf~ changes be adopted as is; motion carried. Public Hearing--Rear Yard Setbacks in Mobile Home Zone The public hearing on proposed changes in the rear yard setback requirements in the RMH Zone was opened for public comment; there was none, and the hearing was closed. The City Engineer's Office would like to change the rear yard setback from ten feet to five feet (see attached) to accommodate the new, longer trailers (up to eight feet), Gerald Shay is wondering if reducing the setback as proposed and bringing the rear ends of the trailers within 10 feet of each other is a fire fighting problem or hazard. Cai states that the setbacks are the same as for side yard setbacks for residential houging units in other zones. Motion by Billielou Lance with second by Gerald Shay to table the item until Cai talks to the Fire Department; motion carded. Airport Zoning The heating concerning changes to the Airport Zoning was opened for public input; there was none and the hearing was closed. The Helena Office of the FAA did review the draft and make some suggestions, and these were included by Cai in the final draft for consideration tonight. Cai requested that this item be tabled until February because he is still investigating the use of Air Navigatioh Easements near the Airport. Pat Mullaney Complaint Pat Mullowney spoke about his property on Montana and East Maryland Lane adjacent to George Metzger's property. He is concerned about his investment. The Metzger property, he feels, is in violation of zoning codes. The zoning is RE 20,000 which does not allow animals unless such use is grandfathered on a site. Mullaney is mainly complaining about pigs and other livestock on the Metzger property. He would like the Board to enforce the zOning and protect his investment. Cai asked him what specifically he would like enforced, since the underlying issue is whether or not the animals are a grandfathered use. Mrs. Metzger spoke saying they have lived on the property since 1952, and not once in that time have they heard any complaints by neighbors--until tonight. Over the time they bare lived there, they have had several kinds of animals for the enjoyment of their clfildren and for food. iVh-s. Metzger also asked about putting a beauty shop on her property--this is why she came to the meeting tonight. She realizes that if they put a beauty shop on the property, the animals would probably no longer be there. Cai stated that they can apply to the Planning Board for a land use variance but such variances require proof of hardship; he doesn't think she can show that. Mr. MuIlaney would like to see the property in the area zoned commercial. He feels this would solve the whole problem. Cai stated that Laurel has a Comprehensive Plan that does not allow for a commercial land use node in this area (but the request could be made ifa large enough area applied-at least one city block in size). Mr. Mullaney then asked why he wasn't told he could also apply for a land use variance. Cal said that--over the last couple of years he has been answering questions on this issue for Mr. Mullaney--he has told.him--as well as other options. ISTEA Meeting in Helena Cal said there is a meeting January 20th in Helena with the State Department of Transportation regarding ISTEA that either he or the City Engineer should go to. Motion by Don C_mdgell with second by Billielou Lance that Cai be allowed mileage to this meeting and board and room if necessary; motion carried. Other Motion by Billielou Lance with second by Donna Kilpatrick to approve bill for $200 from the City for administrative services; motion carried. Don Gudgell stated that when Cheryll doesn't attend the meeting as secretary, the City should provide an alternate. He would like this to go to the City Council. The Board feels that if they are paying for such services, there should be someone present. Gerald Shay stated that he would like it also understood that Cheryll does not miss that many meetings. Motion by Don Gudgell with second by Billielou Lance that the Counc'd be asked to consider an alternative for the Board secretary when she cannot attend the meeting; motion carried. Regarding approval of the last month's Board meeting minutes: Cal said the motion to recommend approval of the Special Review for Community Hope needed to show that the Planning Board made the recommendation subject to the City approving the site and construction layout plan and that a traffic mm around be addressed by the applicant to the satisfaction of the City; minutes Were approved as amended.
