Gerald Shay pointed out that the Laurel Outlook stated Helena
Chemical was a company dealing in agricultural additives, not
fertilizer. He thinks they should be made aware of that error.
Motion by Don Gudgell, seconded by Billielou Lance, to approve
the minutes of the February 10, 1994 meeting. Motion carried.
Home occupation- New Beginnings- 602 S. Yellowstone
Tom and Peggy Petrosky of 602 S. Yellowstone have requested a home
occupation to operate a Credit Counseling service out of their
home. They feel that a service such as what they provide is needed
in Laurel. Basically they inform people of what they can do to
improve their credit report. Their "office" consists of the
kitchen table and a chair.
Cal recommends approval subject to no traffic coming to their home.
Motion by Don Gudgell, seconded by Gerald Shay, to recommend
approval of the home occupation for Tom & Peggy Petrosky, subject
to no customer traffic coming to their home.
Cal also stated that because the business is out of the city limits
they do not need to purchase a business license.

Mike Baney has requested a home occupation to run a home
maintenance business out of his home. He will contract with
customers to do home maintenance. He will do some work in his
garage with power tools, but most work will be done at customers
homes.
He has contacted all the neighbors within a 100 foot radius and no
one has problems with him doing this. He also states that everyone
he contacted have power tools that they use on a regular basis, in
their garages.
Cal stated he has no problem with this request, providing that the
noise from the tools s%ay in the shop, with the door closed, even
during nice days.
Motion by Gerald Shay, seconded by Billielou Lance, to
recommend approval of Mike Baney's home occupation, subject to him
keeping the noise within the confines of the garage. Motion
carried.
Public Hearing- AirDort Zoninq
Cal spoke about the proposed changes to the Airport Zoning. We are
looking at this because of the rising importance of the Laurel
Airport, and the activity that is starting to pick up both in the
amount of air traffic and also the building of residences around
the airport. We need to look at this on a long-term basis, because
the airport is an important part of Montana's transportation system
and will be for many years to come.
We need to consider that the airport is going to steadily increase
and in order for it to continue to be an important part of the
transportation in this region there needs to be some consideration
of the adjacent property owner's developing at the airport. One of
the ways of doing this is to limit the amount of development that
can be done in the zoning. We are proposing to control the land
use in the flight pattern area of the airport.
Commercial property needs to come to us for approval, through the
Special Review Process. But, residential areas are not required to
do so. We do have some height restrictions and lot coverage
restrictions.
What is being proposed is that new residences that are being built
in that area must apply for and obtain, from Laurel, a use permit
($25 fee). The application is then looked at through our planning
staff and if it conforms, or has problems, it is addressed at that
point.
What the $25 fee does is give the airport the air rights above the
proposed house. It's an acknowledgement that the air traffic is
there, air traffic will increase over time, and if residents are
going to locate in that air, then they can expect noise.
Bob Graham questioned what exactly this would do to his plans for
a subdivision in that area, with 25 homes possibly being built. Me
is concerned about the restrictions. Me doesn't want the
possibility of the airport board telling him that he couldn't build
on his own land.
Cal states that the intent is that people building in that area be
made aware of "air navigational" space. Me would like Bob to put
the correct wording in his covenants that will go along with his
subdivision.
Cal states that we need to do this now.
Question on use permit. Would it be a one time deal, or would that
use permit go with the property?
Cal states that the intent is to have it go with the property. He
feels that some of these will slip through the cracks. But, over
the years the subdivisions will hopefully have the restrictions put
into their covenants.
Cal is concerned with the long-term noise, and that people in the
future could come back at the airport and claim the air traffic is
making noise that they can't live with.
The public hearing was closed at 7:35 p.m., with the motion being
made by Billielou Lance, and seconded by Gerald Shay. Motion was
carried.
Cal also feels that these changes need more fine tuning. We will
discuss it again next month before we take anything to the City
Council.
Pat Mullaney
Pat Mullaney spoke on the property he owns on Montana Avenue.
Me states that when he first came to the City about covering the
ditch, he was told by Jim Worthington that the City would like to
participate in the covering of the ditch. Then Jim got ill,
retired and now the City wants nothing to do with covering the
ditch (which is in the county).
Pat was told to go to the County and that they would maybe
participate. Jim Ziegler came out and looked at it and indicated
that the county did not want to participate. So, Pat is back to
ask the City to participate.
The rest of the discussion was on what types of land uses Pat, and
others going in on his venture, could have on that land. He went
down the list of what is allowed in that zone and had many
questions. Me also addressed what his neighbors can do on the
adjoining property.
Cal told Pat that the City would have to consider what he proposes
to do when he has plans and drawings.
Pat was very unhappy that everything is not cut and dried. He felt
that he needs to know the answers to many questions before people
will go in with him in his venture.
Cal again told Pat that he will have to come up with some firm
ideas and then the City will consider what he wants to do.
Motion by Don Gudgell, seconded by Billielou Lance, to approve
the bill for $400 for Administrative Services (February and March
of 1994). Motion carried.
Motion to adjourned by Do~ Gudgell, seconded by Billielou
Lance. Motion carried.
The meeting was adjourned at 8:10 p.m.
